City Manager Ron Wicker advised that the City Staff, who had reviewed -the bids and
who will be using the equipment, recommended award of bid to Case Power and Equipment
without trade-in. We will be keeeping the old backhoe as an alternate.
It was moved by Councilmember Smith, seconded by Councilmember Wolff, that Council
award Bid No. B89-6 to Case Power and Equipment for a Case 580K in the amount of
$25,512.00 and payment be made from the appropriate account.
Motion passed 5 to 0.
ORDINANCE NO. 573, ORDINANCE DNCLAR]9 G TM PLIC NECESSITY FOR TM MAINTENANCE OF
NASAWOOD DRIVE IN THE CITY AND FOR THE ACQUISITION OF RIGHT -OF --WAY FOR SAME, AND
DECLARING AN El ,'Y
City Manager Ron Wicker explained that it was determined that, at the last meeting,
there was a vote of 3 to 1 on this ordinance and the City Charter requires, on an
emergency reading, a 75/ majority to pass.
Ordinance No. 573 was read in caption by Councilmember Smith. (First and Final
Reading)

It was. moved by Councilmember Smith, seconded by Councilmember Bost, that Ordinance
No. 573 be passed and approved on the first and only reading, as an emergency
ordinance.
Said Ordinance No. 573 reads in caption as follows:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, DECLARING
THE PUBLIC NECESSITY FOR THE MAINTENANCE OF NASAWOOD DRIVE IN THE CITY AND
FOR THE ACQUISITION OF RIGHT-OF-WAY FOR SAME; DECLARING AN IMMEDIATE
PUBLIC ENERGENCY, AND HAVING OTHER PROVISIONS RELATED TO THE SUBJECT.
Voting "Aye" - Cotmcilmembers Bost, Smith, Wolff, Tetens and Miller.
Voting "No" - None.
Motion passed 5 to 0.
NEW BUSINESS
It was moved by Councilmember Bost, seconded by Councilmember Tetens, that Council
excuse the absence of Councilmember Willian Wolff from the Regular Meeting held on
July 10, 1989.
Motion passed 5 to 0.
