PURPOSE OF HEARING: TO DISCUSS THE FOLLOWING PROPOSED AMENDMENTS TO THE LAND USE AND
URBAN DEVELOPMENT ORDINANCE NO. 509 AND AMENDMENTS TO THE ZONING MAP:
1. AMENDMENT OF ORDINANCE NO. 509-A, SECTION 22, SIGN ORDINANCE.
2. AMENDMENT OF MINIMUM PARKING AREA REQUIREMENTS FOR TYPICAL PARKING ANGLES FROM
THE REQUIRED 10' STALL WIDTH TO 9' WIDTH.
3. REZONE GREEN TEE SUBDIVISION TOWNHOUSE RESERVE, BLOCKS 3, 7, AND 1/2 OF 8,
SECTION I AND 1/2 OF BLOCK 8, SECTION II FROM R-3 TO R-4.
4. REZONE CORRIGAN SUBDIVISION, SECTIONS 1-5 FROM R-4 TO R-2.
5. REZONE WILLOWICK SUBDIVISION FROM R-4 TO R-2.
6. REZONE SPRINGFIELD SUBDIVISION FROM R-3 TO R-2.
7. ZONE SHERWOOD SUBDIVISION (NO ZONE INDICATED) TO R-2.

Mayor Reid made some preparatory comments and advised that the Hearing tonight would
be divided into three categories: 1) amendment of minimum parking area requirements;
2) rezoning of five subdivisions; and 3) amendments to the Sign Regulations.

City Manager Ron Wicker explained the State law requirements for holding a Public
Hearing when there is an amendment to the Zoning Ordinance. For this Hearing, Mr.
Wicker said, post cards were sent out to every property owner in the City, notifying
them of these particular amendments.
1. AMENDMENT OF MINIMUM PARKING AREA REQUIREMENTS FOR TYPICAL PARKING ANGLES FROM
THE REQUIRED 10' STALL WIDTH TO 9' WIDTH
The proposed change to the minimum parking area requirements is recommended because
we have fotmd, through practical experience, that a 10' parking space is adequate for
a handicap parking space but it too wide for the normal car, Mr. Wicker said. This
will affect shopping centers and businesses that are required to have a certain
number of parking spaces.

2. REZONING OF FIVE SUBDIVISIONS
City Manager Ron Wicker explained that when the City amended its Land Use and Urban
Development Ordinance and the Zoning Map in 1986, there were some errors made in the
Zoning Map that we have since discovered. We are now proposing for these five
subdivisions to be rezoned to what they were originally intended to be zoned in order
to make them compatible with the present occupancy in these areas.
(a) REZONE GREEN TEE SUBDIVISION TOWNHOUSE RESERVE, BLOCKS 3, 7, AND 1/2 OF 8,
SECTION I AND 1/2 OF BLACK 8, SECTION II FROM R-3 TO R-4
City Manager Wicker informed that an R-3 zone is for medium density single family
dwelling units and an R-4 zone is for maximum density single family dwelling units.
This particular section of Green Tee was platted as townhouse reserve back in the
early 70's when Green Tee Subdivision was originally platted. An R-4 zone permits
patio homes, and with Planned Unit Development, townhomes and condominiums are
allowed.
(b) REZONE CORRIGAN SUBDIVISION, SECTIONS 1-5 FROM R-4 TO R-2
City Manager Wicker informed that an R-2 zone is the second most restrictive zone we
have in our Land Use and Urban Development Ordinance. It permits low density, single
family dwelling units. Mr. Wicker said that before 1986 these sections were zoned R-
2. The lots are basically 70' x 100' and this proposed zone change will change
Corrigan, Sections 1-5, back to what it was originally zoned.
(c) REZONE WILLOWICK SUBDIVISION FROM R-4 TO R-2
City Manager Wicker explained that the lots in this subdivision are basically 70' x
108' lots which exceed the minimum lot size for an R-2. The proposal is to correct
the zone and make it an R-2 subdivision.
(d) REZONE SPRINGFIELD SUBDMSION FROM R-3 TO R-2
City Manager Wicker explained this subdivision was originally platted in 60' x 100'
lots. Since that time the new owners have replatted the subdivision to 70' x 100'
lots; thereby making it more applicable to the R-2 zoning.
(e) ZONE SHERWOOD SUBDIVISION (NO ZONE INDICATED) TO R-2
City Manager Wicker informed that the zoning of this subdivision was inadvertently
left off the map that was revised in 1986. The lots there are 75' x 120' which
exceed the R-2 zone, but does not meet the minimum width requirements of an R-1 zone.
We proposed to zone this subdivision R-2, he said.

1. Dick Spooner, 4014 Spring Brook Ct. Mr. Spooner needed additional clarification
of an R-3 zone.
2. Carol Weisheit, 5014 Apple Springs. Ms. Weisheit needed further clarification on
the proposed zoning of Corrigan Subdivision.
3. Barbara Bamburg, 2824 Country Club. Ms. Bamburg needed further clarification of
the R-3 and R-4 zones.

3. AMENDMENT TO ORDINANCE NO. 509-A, SECTION 22, SIGN ORDINANCE
Mayor Reid informed that the Sign Review Committee consisted of two Councilmembers,
two members of the Planning and Zoning Commission, a representative from the private
sector and a member of City Staff. They had been instructed to look at certain areas
of the Ordinance in which citizens had expressed concerns. This Hearing tonight will
we
address only the changes that the Sig Review Committee recommended, Mayor Reid said.
City Manager Ron Wicker advised the audience that there were copies of the proposed
sign revisions at the register table for those who wanted to follow along. Mr.
Wicker projected on the screen the pages having proposed revisions with a brief
explanation of each and he answered questions from the audience.
D. A. Miller, Jr., 2707 Pinecone Lane. Mr. Miller questioned if the City permitted
signs in the extraterritorial jurisdiction. Mr. Wicker responded that, by law, we
have the authority but, at this time, we do not exercise that right.

PERSONS SPEAKING IN OPPOSITION TO THE CHANGES:
1. Richard Simpson, 2712 Country Club. Mr. Simpson had questions about some of the
revisions. He expressed his opposition to several of the other proposed
revisions which included: fees for portable signs; section concerning removal of
portable signs during a state of emergency; requirement of on -premise free
standing signs to be 75 feet from another such sign; section concerning unsafe
signs and the section on registration of signs.
Mayor Reid announced that these proposed changes will be considered by the Planning
and Zoning Commission, followed by their recommendation to the Council.
Leroy Savoie, Chairman of the Planning and Zoning Commission, stated that the
Planning and Zoning Commission will take into consideration the public comments of
this evening.
