RESOLUTION R2020- CUP20-00018 A resolution of the City Council of the City of Pearland, Texas, approving a Conditional Use Permit (CUP) to allow an accessory dwelling unit within the Suburban Residential-15 (SR-15) District, Beingl.5 acres out of Lot 43 of the Subdivision of the G. C. Smith Survey, Section 22, Abstract 548, according to the Plat recorded in Volume 2, Page 51 of the Deed Records of Brazoria County, Texas. (Located at 3610 Curtiss Rd. Pearland TX). Conditional Use Permit Application No CUP20-00018, within the Suburban Residential -15 (SR-15) District, at the request by Bruce V. Kirby, applicant and owner containing a savings clause, a severability clause, and an effective date and other provisions related to the subject. WHEREAS, Bruce V. Kirby, applicant and owner, is requesting approval of a Conditional Use Permit (CUP) for an accessory dwelling unit within the Suburban Residential-15 (SR-15) District; said property being legally described in the legal description attached hereto and made a part hereof for all purposes as Exhibit "A," and more graphically depicted in the vicinity map attached hereto and made a part hereof for all purposes as Exhibit "B"; and WHEREAS, on the 16th of November, 2020, a Joint Special Meeting was held before the Planning and Zoning Commission and. the City Council of the City of Pearland, Texas, notice being given by online publication on the City website, a copy of which being attached hereto and made a part hereof for all purposes as Exhibit "C," said call and notice being in strict conformity with provisions of Section 1.2.2.2 of Ordinance No. 2000T; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, and having been fully advertised in the premises, finds that in the case of the application of Bruce V. Kirby, applicant and owner, for approval of a Conditional Use Permit to allow an accessory dwelling unit on a 1.5-acre tract of land; presented which, in the judgment of the City Council, would justify the approval of said application; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: S ection I. The following described property located within the corporate City Limits of the City of Pearland, Texas, and presently being located within the Suburban Residential-15 (SR-15) District, is hereby granted a Conditional Use Permit (CUP) for an accessory dwelling unit, subject to all requirements of the Suburban Residetial-15 (SR- 15) District, in accordance with all conditions and requirements of the Unified Development Code and the following conditions approved by the City Council and incorporated for all purposes, such property being more particularly described as: Legal Description Being 1.5 acres out of Lot 43 of the Subdivision of the G. C. S mith Survey, Section 22 Abstract 548, according to the Plat recorded in Volume 2, Page 51 of the Deed Records of Brazoria County, Texas General Location: 3610 Curtiss, Pearland, TX. S ection II. The City Council of the City of Pearland finds and determines that the recitations in the preamble hereof are true and that all necessary prerequisites of law have been accomplished and that no valid protest of the proposed change has been made. The City Council further finds and determines that there has been compliance with the mandates of law in the posting and presentation of this matter to the Planning and Zoning Commission and to City Council for consideration and decision. S ection III. The City Council of the City of Pearland finds and determines that the Resolution adopted herein promotes the health, safety, and general welfare of the public and is a proper valid exercise of the City's police powers. S ection IV. If any section, subsection, sentence, clause, phrase, or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. S ection V. All rights and remedies, which have accrued in the favor of the City under this Ordinance and its amendments thereto, shall be and are preserved for the benefit of the City. S ection VI. I was informed by specialists within the City Planning Department that in order to build an additional structure with a kitchen I would need to submit an application for a Conditional Use Permit for your review. Proposed Uses / Specific Operations of the Use: The additional structure will serve as living quarters for a disabled family member, and possibly any required caretakers. The structure will be a residential dwelling that has specific modifications to suit the needs of a disabled person. Square Footage of Building/Lot Sizes: I anticipate that this structure will be approximately 35 feet wide by 35 feet deep. However, this is subject to change as needed related to any structural changes that may be required to accommodate accessibility (e.g. doorways/hallways that are ADA compliant). Unique characteristics of the property: This structure will be built where another structure previously stood. This area of my land already has the infrastructure required for an additional structure, including connections for water and septic needs. The only request made to the city would be for an electrical connection. Other relevant information: I have discussed this proposition with the City Planning Department, and they confirmed that they would approve this request, given the minimal effort requested of the city.
