2020-08-24 CITY COUNCIL REGULAR MEETING MINUTES MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON MONDAY, AUGUST 24, 2020, VIA TELEPHONE/VIDEO CONFERENCE, AT 6:30 P.M., IN THE CITY HALL COUNCIL CHAMBERS, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. CALL TO ORDER. Mayor Reid called the meeting to order at 6:31 p.m. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG. Councilmember Carbone gave the Invocation, and Mayor Pro-Tern Little led the Pledges of Allegiance. ROLL CALL AND CERTIFICATION OF QUORUM: Mayor - Tom Reid Mayor Pro-Tern J. CITIZEN COMMENTS: Jimmy Davis, 5004 Colmesneil Street, spoke on behalf of the Pearland Water Billing Discussion Group. He stated their concerns for utility billing and water usage. Erika Guerra, 2607 Kaman Lane, spoke in opposition of a two (2) percent Cost of Living Adjustment and stated her concerns regarding the City's Budget. Jeff Hunkele, 3912 Oakwood Drive North, spoke in opposition of a two (2) percent Cost of Living Adjustment and utility billing issues. PUBLIC HEARING: None CONSENT AGENDA: • A. Consideration and Possible Action - Resolution No. R2020-150 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the purchase of one (1) Ford Transit 350 Accessible Van, (Knapp Activity Center), from Silsbee Ford, utilizing Community Development Block Grant funds in the amount of$52,556.00. 1 City Council Regular Meeting Minutes-August 24,2020 B. Consideration and Possible Action - Resolution No. R2020-147 - A Resolution of the City Council of the City of Pearland,Texas, awarding a unit supply bid for the purchase of automotive tires, from The Goodyear Tire and Rubber Company, through a member governmental purchasing agreement with the Texas Buyboard, in the estimated amount of$125,000.00, for the period of October 1, 2020 through September 30, 2021. C. Consideration and Possible Action - Resolution No. R2020-151 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the purchase of one (1) F-250 truck and response accessories (Rapid Response Vehicle), from Chastang Ford, in the amount of$93,816.00. D. Consideration and Possible Action - Resolution No. R2020-148 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the purchase of Parks & Recreation Management Software, from Perfect Mind, Inc., in the estimated amount of $56,383.06 for FY21, $66,997.11 for FY22, and $68,464.96 for FY23. E. Consideration and Possible Action - Excuse the Absence of Councilmember Gary Moore from the Regular Council Meeting on August 10, 2020. F. Consideration and Possible Action -Second and Final Reading of Ordinance 2000T-32 - An Ordinance of the City Council of the City of Pearland, Texas, amending selected provisions of the Unified Development Code regarding the following section; 1. Removing references to the "Director of Parks" within Division 2 of Chapter 4 and replace with "City Manager or their designee", 2. Removing references to the "Director of Engineering" and replace with the "City Engineer" and remove references to the "Director of Planning" and replace with the "Director of Community Development" throughout the UDC, 3. Clarifying the language to define the characteristics between a dwelling unit and an accessory residential structure within Chapter 5, 4. Clarifying banner signs regulations by removing the banner permit fee from Section 4.2.5.5(c)(3), 5. Removing and adding language to allow banners attached to lighting fixtures in parking areas of sites used as public educational facilities or campuses. G. Consideration and Possible Action - Resolution No. R2020-154 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to enter into election services agreements with Brazoria County, Fort Bend County, and Harris County for the November 3, 2020 General Election and Special Election. Councilmember Orlando made the motion, seconded by Mayor Pro-Tem Little, to adopt Consent Agenda Items A through G, with the exception of Items B and C. Consideration and Possible Action — First Reading of Ordinance No. 1594 - An Ordinance of the City Council of the City of Pearland, Texas, authorizing the issuance of City of Pearland, Texas, permanent improvement refunding bonds in one or more series; setting certain parameters for the bonds; authorizing refunding of certain outstanding obligations; authorizing a pricing officer to approve the amount, the interest rate, price, and terms thereof and certain other procedures and provisions relating thereto. Councilmember Carbone made the motion seconded by Councilmember Moore, to approve the First Reading of Ordinance No.1594. AYES: Orlando, Carbone, Little, Hernandez, Moore, Perez, Owens. NAYS: None. The motion carried. 2. Consideration and Possible Action - Resolution No. R2020-152 - A Resolution of the City Council of the City of Pearland, Texas, authorizing a professional services agreement with Cannon Cochran Management Services Inc., (CCMSI) for administration of the City's Workers' Compensation Program, in the amount of $35,000.00; and authorizing the purchase of Workers Compensation Excess Insurance Coverage from Midwest Employers, in the amount of $140,285.00, for the period of October 1, 2020 through September 30, 2021. Mayor Pro-Tern Little made the motion, seconded by Councilmember Moore, to approve Resolution No. R2020-152. AYES: Orlando, Carbone, Little, Hernandez, Moore, Perez, Owens. NAYS: None. The motion carried. Resolution No. R2020-152 is adopted. 3. Consideration and Possible Action - Resolution No. R2020-153 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the power of eminent domain to acquire a water utility easement to certain property for the Surface Water Plant Project; being a 0.4158 acre (18,114 square feet) parcel of land situated in the 3 City Council Regular Meeting Minutes-August 24,2020 H.T.&B.R.R. CO Survey, Section 81,Abstract 300, in Brazoria County, Texas, and being out of Lot 5, Block 1 of Kirby Crossing Section Two, Replat No. 1, as recorded under Plat Number 2017028035 of the Brazoria County Map Records (B.C.M.R.), also being out of Tract 1, as described in special warranty deed to COLE AH PEARLAND TX, LLC, and recorded under Brazoria County Clerk's File (B.C.C.F.) No 2018051077, of the Official Public Records of Brazoria County, Texas, for the construction and maintenance of water utility improvements on certain real property described herein; authorizing the city attorney, or his designee, and other city officials to take such actions as are necessary to acquire said property, located within the city, by donation, purchase, or by the exercise of the power of eminent domain. Councilmember Hernandez read the caption into the record per state law. Councilmember Hernandez made the motion,seconded by Councilmember Perez,to approve Resolution No. R2020-153. City Attorney Darrin Coker stated approval of this item would authorize the city attorney, or his designee, and other city officials to take such actions as are necessary to acquire said property, located within the city, by donation, purchase, or by the exercise of the power of eminent domain. Consideration and Possible Action - Resolution No. R2020-140 - A Resolution of the City Council of the City of Pearland, Texas, awarding a professional services contract in the amount of $264,000.00 to MPACT Strategic Consulting, LLC., for the administration of an emergency rental assistance program to qualifying economically impacted by the COVID-19/Coronavirus Pandemic. Councilmember Moore made the motion, seconded by Councilmember Hernandez, to approve Resolution No. R2020-140. AYES: Orlando, Carbone, Little, Hernandez, Moore, Perez, Owens. NAYS: None. The motion carried. Resolution No. Resolution No. R2020-140 is adopted. 5. Presentation: Utility Billing Status Report. Interim Finance Director John McCarter provided an overview of the Utility Billing Update and ways to continuously and proactively improve the processes. Water Billing and Collections Manager Nancy Massey provided an update on the ongoing projects for the 32/30 Plan. Director of Engineering & Capital Projects Robert Upton provided an overview of the ongoing Advance Meter Infrastructure Project. No action was taken. 6. Consideration and Possible Action - Resolution No. R2020-149 - A Resolution of the City Council of the City of Pearland, Texas, authorizing a consultant services 4 City Council Regular Meeting Minutes-August 24,2020 agreement for Utility Billing Process/System review and assessment services, to Raftelis Financial Consultants, Inc., in the amount of$98,000.00. Councilmember Perez made the motion, seconded by Councilmember Hernandez,to approve Resolution No. R2020-149. AYES: Orlando, Carbone, Hernandez, Moore, Perez, Owens. NAYS: None. The motion carried. Resolution No. R2020-149 is adopted. 7. Fiscal Year 2021 Budget Discussion #3. Interim Finance Director John McCarter provided an overview of the proposed Fiscal Year 2021 Budget Discussion Number 3. Council gave consensus to reduce the Council Professional Development budget by half, and to reduce the Staff's Professional Development by ten percent and place the savings into the General Fund. Council provided a consensus to change the reconnection processing fee of$30 for the first reconnection, and $50 for the second reconnection to a flat $30.00 reconnection fee. 8. MAYOR/COUNCIL ISSUES FOR CITY COUNCIL DISCUSSION: None 9. EXECUTIVE SESSION UNDER TEXAS GOVERNMENT CODE Executive Session -551.071 - Consultation with Attorney- Regarding confidential legal matters and advice. Executive Section 551.074 - Personnel Matters - Regarding appointments and/or changes to membership of the Boards and Commissions.
