2021-01-25 CITY COUNCIL REGULAR MEETING MINUTESCity Council Regular Meeting - Jan 25, 2021 MINUTES OF A CITY COUNCIL REGULAR MEETING OF THE CITY OF PEARLAND, TEXAS, HELD ON JANUARY 25, 2021 AT 6:30 P.M., IN-PERSON AND VIA TELEPHONE/VIDEOCONFERENCE IN THE PEARLAND CITY HALL COUNCIL CHAMBERS, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. Prior to the City Council meeting, Mayor J. Kevin Cole presented special recognitions to Mayor Emeritus Tom Reid and Gary Moore for their years of service with the City of Pearland on City Council. CALL TO ORDER Mayor J. Kevin Cole called the meeting to order at 6:35 p.m. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG Mayor Emeritus Reid gave the Invocation and Councilmember Trent Perez led the Pledge of Allegiance to the United States of America Flag and Texas Flag. ROLL CALL AND CERTIFICATION OF QUORUM Others present: Deputy City Manager Trent Epperson, Assistant City Manager Ron Fraser, Director of Communications Joshua Lee, Chief Information Officer Daniel McGhinnis, Interim Director of Finance John McCarter, Director of Community Development John McDonald and Deputy City Secretary Renee Kross. CITIZEN COMMENTS Carol Artz Bucek, 6117 Broadway St., Pearland, Texas 77581, representing the Pearland Chamber of Commerce, spoke regarding her retirement from the Pearland Chamber of Commerce. Mayor Cole thanked Carol Artz Bucek for her great work with the Pearland Chamber of Commerce. Jimmy Davis, 5004 Colmesneil St., Pearland, Texas 77584, spoke regarding the Olsen & Olsen report and the City budget. He also stated his concerns regarding the City’s water utility rate. Mayor J. Consideration and Possible Action - Approval of Minutes City Council Joint Special Meeting Minutes - January 11, 2021 City Council Regular Meeting Minutes - January 11, 2021 B. Consideration and Possible Action - Resolution No. R2021-6 - A Resolution of the City Council of the City of Pearland, Texas, ratifying expenditures with Sprint Waste Services, LP, for dewatered bio-solids transportation and disposal services, the current contract amount is for $350,000.00 with an additional amount of $140,240.00 for a new total contract amount of $490,240.00. C. Consideration and Possible Action - Resolution No. R2021- 20 - A Resolution of the City Council of the City of Pearland, Texas, providing that a General Municipal Election be held on May 1, 2021, for the purpose of electing two (2) Councilmembers, providing for joint elections on May 1, 2021, with other entities contracting with Brazoria County, for such joint elections, providing the form of the ballot for such election, designating the polling places, directing and giving notice of such election, providing for repeal; providing for severability; and containing other provisions relating to the subject. D. Consideration and Possible Action - Resolution No. R2021-17 - A Resolution of the City Council of the City of Pearland, Texas, authorizing a construction materials testing contract with Geoscience Engineering & Testing, Inc., in the estimated amount of $124,595.00, for the Intersection Improvement Project (Windward Bay at Broadway; Pearland Parkway at Oak Ridge; and Dixie Farm Road near Long Oak). E. Consideration and Possible Action – Resolution No. 2021-16 - A Resolution of the City Council of the City of Pearland, Texas, renewing a unit-price service contract for preventative maintenance and repairs on standby generators to LJ Power Generators, in the estimated amount of $95,000.00, for the period of January 30, 2021 through January 29, 2022. F. Consideration and Possible Action - Resolution No. R2021-19 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to enter into an agreement with the Texas Department of Housing and Community Affairs (TDHCA) for rental assistance grant funding in the amount of $150,750.00. Councilmember Orlando made the motion, seconded by Councilmember Little, to adopt Consent Agenda Items A through F, with the exception of Consent Agenda Item B. AYES: Orlando, Carbone, Kamkar, Hernandez, Little, Perez, Owens. NAYS: None. The motion carried. MATTERS REMOVED FROM CONSENT AGENDA B. The motion carried. Resolution No. R2021-6 is adopted. NEW BUSINESS 1. Presentation: Utility Billing Process & Management Review. Michelle Ferguson and Seth Garrison, representing Raftelis Financial Consultants, presented the Utility Billing Process and Management Review. 2. Discussion and Input on modifying the Joint Public Hearing/Special Meeting format for Planning and Zoning issues to one where public hearings are held separately, first before the Planning and Zoning Commission, and then City Council. City Council consensus was to move forward to modify the Joint Public Hearing/Special Meeting format for Planning and Zoning issues to one where public hearings are held separately, first before the Planning and Zoning Commission, and then City Council. 3. Consideration and Possible Action - Resolution No. R2021-18 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to enter into a First Amended Development Agreement with Massey Oaks Development, LP, (“Developer”) reciting the amended responsibilities of the City and Developer associated with the development of a residential community (Massey Oaks). Councilmember Little made the motion, seconded by Mayor Pro-Tem Hernandez, to adopt Resolution No. R2021-18. Peter Ghishan, 241 Ridge St, Suite 330, Reno, NV 89501, representing Massey Oaks Development, LP., expressed his thanks to City staff for their support of the project. Alan Mueller, 4201 Broadway, Pearland, TX 77581, spoke regarding the project. He expressed his gratitude for the collaboration with City staff. AYES: Orlando, Carbone, Kamkar, Hernandez, Little, Perez, Owens. NAYS: None. The motion carried. Resolution No. R2021-18 is adopted. 4. Consideration and Possible Action - Resolution No. R2021-1 - A Resolution of the City Council of the City of Pearland, Texas, authorizing an amended contract with Ardurra Group, LLC, in the additional amount of $3,612,000.00 (total contract City Council Regular Meeting - Jan 25, 2021 amount of $7,387,000.00) for design services associated with the John Hargrove Environmental Complex (JHEC) Water Reclamation Facility Expansion Project. Councilmember Perez made the motion, seconded by Councilmember Little, to adopt Resolution No. R2021-1. AYES: Orlando, Carbone, Hernandez, Little, Perez, Owens. NAYS: Kamkar. The motion carried. Resolution No. R2021-1 is adopted. 5. Consideration and Possible Action - Resolution No. R2021-10 - A Resolution of the City Council of the City of Pearland, Texas, awarding a bid for construction services associated with the Intersection Improvement Project (Windward Bay at Broadway; Pearland Parkway at Oak Ridge; and Dixie Farm Road near Long Oak), in the estimated amount of $4,115,299.92, to Teamwork Construction. Councilmember Owens made the motion, seconded by Councilmember Perez, to adopt Resolution No. R2021-10. AYES: Orlando, Carbone, Karmkar, Hernandez, Little, Perez, Owens. NAYS: None. The motion carried. Resolution No. R2021-10 is adopted. 6. Consideration and Possible Action - Resolution No. R2021- 4 - A Resolution of the City Council of the City of Pearland, Texas, awarding a unit price bid for the purchase of water and wastewater treatment chemicals, supplies and analysis services with Napco Chemical Company, in the estimated amount of $447,000.00, for the period of January 26, 2021 through January 25, 2022. Councilmember Orlando made the motion, seconded by Councilmember Perez, to adopt Resolution No. R2021-4. AYES: Orlando, Carbone, Kamkar, Hernandez, Little, Perez, Owens. NAYS: None. The motion carried. Resolution No. R2021-4 is adopted. MAYOR/COUNCIL ISSUES FOR CITY COUNCIL DISCUSSION There was none. OTHER BUSINESS There was none.
