CHILD, AGENT FOR CHARLES WIGHT, OWNER, FOR A SPECIFIC USE PERMIT IN A GENERAL BUSINESS DISTRICT FOR ULTRALIGHT AIRPLANE SALES, STORAGE, RENTAL AND REPAIR: PARTS, SALES AND SERVICE AND ULTRALIGHT AIRCRAFT INSTRUCTION AND OPERATION AT THE FOLLOWING DESCRIBED PROPERTY, TO -WIT: .Abstract 239, Lots 6A1 and 6A2 of a 2.14 acre tract of land out of the H.T. & B.R.R. Survey. (2601 S. Main) 1. John O'Sullivan, Attorney. Mr. O'Sullivan stated he was representing Carl Child, owner of Gulf Coast Air Sports. He informed that Mr. Child has conducted a business in Pearland for over five years. When the new Zoning Ordinance came into effect, Mr. Child's business was "grandfathered." But now that he has relocated his business, he has been instructed by the City that a Specific Use permit is required. Larry Loessin, 3406 Nottingham. Mr. Loessin presented to the Council and the Commission a petition containing 20 signatures. This petition stated that these people were against the granting of the Specific Use permit because the ultralights fly over their homes creating unsafe conditions and a noise factor that will not allow normal conversation in their own back yards. 150 2. Calvin Collier, 3402 Nottingham. Mr. Collier stated he agreed with the petition because it is very annoying to sit in your back yard and try to carry on conversations while the ultralights are flying overhead. 3. Dan Mathews, 3409 Nottingham. Mr. Mathews stated he was against the ultralights flying over his house. 4. Doris Collier, 3402 Nottingham. Mrs. Collier stated that the new high school will be directly in the path of the tak6off and landing of the ultralights. 1N c u " X04• •'04• C - City Manager Ron Wicker advised Council and the Commission of the series of events that occured when Mr. Child relocated his business around the end of March, 1988 and the period of time in which the Permit Department has been working with Mr. Child in order for him to conform to the Land Use Ordinance. When questioned by members of the Council and the Commission, Mr. Child responded that the landing strip used by the ultralights is still "grandfathered" and they use about 40 feet to take off and land. They operate only during the daytime hours, seven days a week. They instruct the people to fly safely and not over houses. They operate under 103 of the Federal Air Regulations. City Manager Ron Wicker informed that this particular zone change request covers the lots that the building occupies, not the runway. Mr. Wicker stated that the runway may be subject to a legal interpretation on whether it is non -conforming use. The City will require, Mr. Wicker said, a signed agreement from the owner that the runway can be used by the ultralights.
