1988-09-26 CITY COUNCIL REGULAR MEETING MINUTES116 MINUTES OF A REGULAR MEEMM OF THE CITY COIL OF THE CITY OF PEARLAND, TEXAS, HELD ON SEPTEMBER 26, 1988, AT 7:30 P. M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS The meeting was called to order with the following present: Mayor Tom Reid Mayor Pro Tem Stella Roberts Councilmember William Wolff Councilmember James Bost Councilmember David Smith Councilmember Richard Tetens City Manager Ronald J. Wicker Assistant City Manager Donald Birkner Interim City Attorney Robert Talton Assistant City Secretary Pat Vaught Absent from the meeting: City Secretary Kay Krouse INVOCATION AND PLEDGE OF ALLEGIANCE The invocation was given by Mayor Tom Reid. City Manager Ron Wicker led the Pledge of Allegiance. APPROVAL OF MINUTES It was moved by Councilmember Roberts, seconded by Councilmember Smith, that the Minutes of the Regular Meeting of September 12, 1988, be approved as presented. Motion passed 4 to 0. Councilmember Bost abstained. It was moved by Councilmember Bost, seconded by Councilmember Wolff, that the Minutes of the Public Hearing held on September 19, 1988, be approved as submitted. Motion passed 3 to 0. Councilmembers Tetens and Roberts abstained. MAYOR'S ACTIVITY REPORT Mayor Reid issued the following proclamations: Shrine Hospital Benefit Day - October 8, 1988 was proclaimed as Shrine Hospital Benefit Day and Bill Bell accepted in behalf of the Shriners. Fire Prevention Week - The week of October 9 - 15 was proclaimed as Fire Prevention Week in Pearland. Accepting in behalf of the Pearland Volunteer Fire Department were John Munsch and Buck Stevens. Presentation to Roy Sanchez Family - Mayor Reid presented an updated proclamation listing additional organizations involved in the benefit recently held for the Sanchez family. Members of many of these organizations were present and they pre- sented Mr. Sanchez with a check and a memory book. Brazoria County Fair Week - October 1 - 8, 1988 was proclaimed as Brazoria County Fair Week and Sherry Andrus, Pearland's candidate for Fair Queen, accepted the proc- lamation. Ms. Andrus was escorted by Skip Patterson. Oiler Proud Week - September 30 through October 8, 1988 has been designated as the time to be "Oiler Proud." Billye Arcemant, representing the Chamber of Commerce, encouraged all citizens, as well as our students, to be "Oiler Proud" and support, along with the merchants and the school district, the anti-drug program in our City. Old Settlers' Cemetery Historical Marker Commemoration Day - Mayor Reid introduced Vic Coppinger, W. W. Martin and Lloyd Yost, all longtime residents of Pearland and 117 members of the Historical Society. Mayor Reid then read the proclamation which gave a history of the Old Settlers' Cemetery and related how the Society had applied for and received a Texas State Historical Marker. Vic Coppinger, President of the Historical Society, invited all to the dedication of the historical marker commemorating the Old Settlers' Cemetery to be held at 10:30 A. M. on October 1 at the corner of Halik Road and State Highway 35. MSETING RECONVENED AT 8:15 P. M. Councilmember Roberts commented on the recently formed Pearland Drug/Attitude Program Steering Committee and its achievements. The Committee has conducted an in-service training seminar for PISD teachers, issued self-esteem building and anti-drug state- ments during football programs, and given out decals and bumper stickers donated by Pearland merchants. In addition, the Steering Committee has conducted a drug/atti- tude program balloon lift-off at the first home high school football game, distributed program mission statements and tips for parents at sporting events and PTA meetings, composed articles for local newspapers on activities and plans and is in the process of evaluating drug -abuse programs that might be incorporated in PISD education. Councilmember Roberts commended the many people who make up this Steering Committee for their efforts now and for their future plans. Councilmember Wolff had several areas of concern. An individual on Harkey Road, south of Fite Road, would like gravel applied to the road. In discussion between Council and Staff, the location could not be pinpointed and Mayor Reid suggested this be looked into. Mr. Wolff commented on the hearing held by Bernard Johnson, Inca last week on land use assumptions and questioned whether the City Staff could determine a dollar figure on the amount the City would receive in capital recovery fees from the new high school site. City Manager Wicker said it could be calcu- lated. Councilmember Wolff voiced concerns from the school bus drivers who feel the signal lights at Orange and State Highway 35 and at Old Alvin Road and FM 518 aren't allowing the traffic to flow smoothly during morning school times. Councilmember r- Wolff further requested the consolidation of City Hall into two floors and that the feasibility of renting the third floor be looked into. City Manager Ron Wicker stated we are working on a two -floor plan we can live with and once we have that we will be ready to come back to Council and discuss leasing the third floor. Mayor Reid said this would then be put on a future agenda. Councilmember Wolff suggested the City look into the possibility of deriving revenue from buildings equipped with fire sprinkler systems. Don Birker, Assistant City Manager, is to contact the State Fire Marshal's office to see if there are any cities presently charging for this service. Mayor Reid agreed that this innovative idea could be workshopped. Lastly, Councilmember Wolff announced the birth of his grandson last week and received the congratulations of the Council. NEW BUSINESS ADJUSTMENT OF THE 1987488 BUDGET OF $50,000 FROM WATER AND SE.MM FUND TO THE ORAL FUND TO COVER RESIGNATION OR 'I'F'RM WMON OF E14P OYEES AS OF SEPMMEER 30, 1988 City Manager Ron Wicker explained this adjustment was necessary to pay accrued benefits, i.e., sick leave, vacation time, and final salary to those employees we have had to lay off plus three employees who have resigned. This amounts to a little over $50,000 but we have some funds we can use. Councilmember Wolff recalled that in the preparation of the budget there was an anticipated zero balance as of October 1 in the Water and Sewer Fund and questioned where this money would come from. City Manager Ron Wicker stated we have had extremely good water sales in the last months due to the unusually dry weather and the funds were available according to the US Finance Director. It was moved by Councilmember Bost, seconded by Councilmember Tetens, that adjustment of the 1987-88 Budget be authorized to transfer $50,000 from the Water and Sewer Fund to the General Fund to cover the resignation and/or termination of employees as of September 30, 1988. Motion passed 5 to 0. EMM) ABSENM OF COUNCIIMEMBER JAMES BOST FROM REGULAR MEETM OF SEPTEMBER 12, 1988 It was moved by Councilmember Tetens, seconded by Councilmember Smith, that the absence of Councilmember Bost from the regular meeting of September 12, 1988, be excused. Motion passed 4 to 0. Councilmember Bost abstained. MEETING RECESSED TO EXECUTIVE SESSION AT 8:32 P. M. UNDER TEXAS REVISED CIVIL STATUTES, ARTICLE 6252-17, SECTION 2 Mayor Reid read, from the posted agenda, the topic to be discussed in Executive Session. MEETING HEMff= TO OPEN SESSSION AT 8:52 P. M. - NO ACTION TAKEN Mayor Reid read the following item which was discussed in Executive Session and signed a certification to that effect: UNDER SUBSECTION (e) LEGAL - Council discussed with legal counsel letter received from Bill Gonzales' attorney.
