2020-05-04 CITY COUNCIL REGULAR MEETING MINUTES MINUTES OF A CITY COUNCIL REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON MAY 4, 2020, BY TELEPHONENIDEO CONFERENCE AT 6:30 P.M., IN THE COUNCIL CHAMBERS, PEARLAND CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. CALL TO ORDER Mayor Reid called the meeting to order at 6:30 p.m. INVOCATION AND PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG Councilmember Tony Carbone gave the Invocation and Councilmember Gary Moore led the Pledges of Allegiance. ROLL CALL AND CERTIFICATION OF QUORUM: Mayor Tom Reid Mayor Pro-Tem J. David Little Councilmember Luke Orlando Councilmember Tony Carbone Councilmember Gary Moore Councilmember Adrian Hernandez Councilmember Trent Perez Councilmember Woody Owens City Manager Clay Pearson City Attorney Darrin Coker City Secretary Crystal Roan Others in attendance: Deputy City Manager Jon Branson, Assistant City Manager Trent Epperson, and Communications Director Joshua Lee. CITIZEN COMMENTS: Jimmy Davis, 5004 Colmesneil Street, stated his concerns regarding utility billing and the increase to the utility rate. Maria Dicicco, 3202 Wild Turkey Lane, stated her concerns regarding utility billing. Ms. Dicicco stated she feels an independent investigation should be conducted. Denise Hewitt, 3404 Blue Spruce Trail, spoke regarding utility billing. Ms. Hewitt requested City Council conduct a workshop to allow citizen input. Jeff Hunkele, 3912 Oakwood Drive, stated his concerns regarding utility billing and the Olson & Olson investigative report. PUBLIC HEARING: NONE CONSENT AGENDA: A. Consideration and Possible Action - Resolution No. R2020-71 - A Resolution of the City Council of the City of Pearland, Texas, awarding a Unit Supply Contract for traffic signal heads and components to Traffic Parts, Inc., in the estimated amount of $120,000.00, beginning May 1, 2020 through April 30, 2021. Consideration and Possible Action - Resolution No. R2020-80 - A Resolution of the City Council of the City of Pearland, Texas, ratifying expenditures in the amount of $29,434.33 with International Paint and Body of Pearland, for vehicle collision and repair services, increasing the contract total to $118,902. Councilmember Orlando made the motion, seconded by Councilmember Moore, to approve Consent Agenda Item A. AYES: Orlando, Carbone, Little, Hernandez, Moore, Perez, Owens. NAYS: None. The motion carried. Resolution No. R2020-71 is adopted. MATTERS REMOVED FROM CONSENT AGENDA: B. Consideration and Possible Action - Resolution No. R2020-80 - A Resolution of the City Council of the City of Pearland, Texas, ratifying expenditures in the amount of $29,434.33 with International Paint and Body of Pearland, for vehicle collision and repair services, increasing the contract total to $118,902. Councilmember Orlando made the motion, seconded by Councilmember Little, to approve R2020-80. AYES: Little, Orlando, Carbone, Hernandez, Moore, Perez. NAYS: Owens. The motion carried. Resolution No. R2020-80 is adopted. NEW BUSINESS: 1. Consideration and Possible Action — First Reading of Ordinance No. 1589 - An Ordinance of the City Council of the City of Pearland, Texas, authorizing issuance of City of Pearland, Texas, water and sewer system revenue bonds, series 2020A; prescribing the terms thereof; providing for the payment thereof; awarding the sale thereof; making other provisions regarding such bonds and matters incident thereto. Councilmember Carbone made the motion, seconded by Councilmember Perez,to approve the First Reading of Ordinance No. 1589. AYES: Orlando, Carbone, Little, Hernandez, Moore, Perez, Owens. NAYS: None. The motion carried. 2. Consideration and Possible Action - Resolution No. R2020.85 - A Resolution of the City Council of the City of Pearland,Texas,awarding a construction services contract for the Rice Drier Road Reconstruction Project, to MAR-CON Services, in the amount of$967,777.80. Mayor Pro-Tern Little made a motion, seconded by Councilmember Hernandez to approve Resolution No. R2020-85. AYES: Orlando, Carbone, Little, Hernandez, Moore, Perez, Owens. Consideration and Possible Action - Resolution No. R2020-84 - A Resolution of the City Council of the City of Pearland, Texas, awarding a construction services contract for the Southdown Ground Storage Water Tank Replacement Project, to W. W. Payton Corporation, in the amount of$1,690,000.00. Councilmember Hernandez made the motion, seconded by Councilmember Perez, to approve Resolution No. R2020-84. Councilmember Perez made a motion, seconded by Councilmember Moore, to amend the motion to remove the logo in the amount of$18,000 from the project. AYES: Orlando, Carbone, Little, Hernandez, Moore, Perez, Owens. NAYS: None. The motion carried. Resolution R2020-84 is amended. Mayor Reid called for the vote on the original motion as amended. AYES: Orlando, Carbone, Little, Hernandez, Moore, Perez, Owens. NAYS: None. The motion carried. Resolution No. R2020-84 is adopted as amended to remove the logo in the amount of$18,000 from the project. 4. Consideration and Possible Action - Resolution No. R2020-83 - A Resolution of the City Council of the City of Pearland,Texas,awarding a construction services contract for the Cullen Regional Lift Station Odor Control and Rehabilitation Project, to R& B Group, Inc., in the amount of$768,600.00. Mayor Pro Tem Little made the motion, seconded by Councilmember Orlando, to approve Resolution No. R2020-83. AYES: Orlando, Carbone, Little, Hernandez, Moore, Perez, Owens. NAYS: None. The motion carried. Resolution No. R2020-83 is adopted. MAYOR/COUNCIL ISSUES FOR CITY COUNCIL DISCUSSION: NONE EXECUTIVE SESSION UNDER TEXAS GOVERNMENT CODE 551.071 - Consultation with Attorney- Regarding confidential legal matters associated with potential amendments to Chapter 2 of the City Code. Councilmember Owens made motion, seconded by Councilmember Moore, to rescind the motion. AYES: Orlando, Carbone, Little, Hernandez, Moore, Perez, Owens. NAYS: None. The motion carried.
