2020-05-11 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT SPECIAL MEETING MINUTES MINUTES OF A JOINT SPECIAL MEETING OF THE CITY COUNCIL AND THE PLANNING AND ZONING OF THE CITY OF PEARLAND, TEXAS, HELD ON MONDAY, MAY 11, 2020, AT 6:30 P.M. BY TELEPHONE/VIDEO CONFERENCE IN THE CITY HALL COUNCIL CHAMBERS, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. JOINT SPECIAL MEETING NO. 1 A request by Allan Mueller, applicant, on behalf G & G Partners LLC, owner, for approval of a Conditional Use Permit to allow an assisted living center within the Neighborhood Services (NS) District, on approximately 9.61 acres; to wit: Legal Description: Being a tract or parcel of land containing 9.6135 acres of land, (418,766 Square feet), out of lot 76, George W. Jenkins Subdivision of the lower one-fourth, (1/4), of the W.D.C. Hall survey. Abstract no. 70, according to the map or plat recorded in Volume 79, page 616, of Brazoria County, Texas. General Location: 3205 Dixie Farm Road, Pearland, Texas Pearland City Council and Planning and May 11, 2020 Zoning Commission Joint Special Meeting Minutes APPLICATION INFORMATION AND CASE SUMMARY 1. STAFF REPORT City Senior Planner Mohamed Bireima gave an overview of the requested Conditional Use Permit. 2. APPLICANT PRESENTATION Allan Mueller, 4201 Broadway, gave a brief summary of the purposed Conditional Use Permit. 3. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST Mayor Pro-Tem Little recognized Chris Puente, 3518 Pine Chase Drive. Mr. Puente spoke in opposition of this Conditional Use Permit. PLANNING COMMISSION/COUNCIL/STAFF DISCUSSION 1. PLANNING AND ZONING COMMISSION Commissioner Wicker and Commissioner Cade stated their concerns regarding the detention pond, traffic in the area, and buffering between Home Depot and the rear of the facility. 2. CITY COUNCIL Discussion ensued between Council and Staff regarding flooding and detention pond requirements and the traffic in the area, limiting the facility to west of the pipeline easement, and limiting the facility to a single story. 3. STAFF WRAP UP City Planner Martin Griggs stated per the Traffic Engineer, the Conditional Use Permit will require a traffic impact analysis to address initial traffic generation for both the Memory Care Facility and the future development.Additionally, he stated this proposed site plan would need to include shared access to both adjacent properties. Mr. Griggs also stated the specific concerns for traffic loading for all proposed developments. He stated a conditional use permit would drive the need for additional traffic control at the intersection of Walmart and the development driveway at Dixie Farm Road. CITY COUNCIL NEW BUSINESS Consideration and Possible Action - Resolution No. R2020- CUP20-00005 - A Resolution of the City Council of the City of Pearland, Texas, approving a Conditional Use Permit (CUP) to allow an assisted living center within the Neighborhood Services (NS) District, on approximately 9.61 acres, being a tract or parcel of land containing 9.6135 acres of land, (418,766 Square feet), out of lot 76, George W.Jenkins Subdivision of the lower one fourth, (1/4), of the W.D.C. Hall survey. Abstract no. 70, according to the map or plat recorded in Volume 79, page 616, of Brazoria County, Texas (Located at 3205 Dixie Farm Road, Pearland, Texas). Conditional Use Permit Application No CUP20.00005, within the Neighborhood Services District, at the request of Allan Mueller, applicant, on behalf G & G Partners LLC, owner, containing a savings clause, a severability clause, and an effective date and other provisions related to the subject. Pearland City Council and Planning and May 11,2020 Zoning Commission Joint Special Meeting Minutes Councilmember Carbone made a motion, seconded by Mayor Pro-Tern Little to approve Resolution No. R2020-CUP-00005 to include an additional stipulation to require the Memory Care Facility to relocate to the west side of the pipeline and limit the facility to one story. Councilmember Carbone made a motion, seconded by Councilmember Moore, to amend the motion to remove the language that restricts the Memory Care Facility to the west side of the pipeline. AYES: Orlando, Carbone, Little, Hernandez, Moore, Owens. NAYS: None. The motion carried. Mayor Reid call for the vote on the original motion as amended. AYES: Orlando, Carbone, Little, Hernandez, Moore, Owens. NAYS: None. The motion carried. Resolution No. R2020- CUP20-00005 is adopted as amended, to remove the language that restricts the Memory Care Facility to the west side of the pipeline.
