2020-03-02 CITY COUNCIL REGULAR MEETING MINUTESMINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON MONDAY, MARCH 2, 2020, AT 6:30 P.M., IN THE CITY HALL COUNCIL CHAMBERS, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. CALL TO ORDER Mayor Reid called the meeting to order at 6:34 P.M. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG The Invocation was given by Councilmember Gary Moore, and the Pledges of Allegiance was led by Councilmember Luke Orlando. CITIZEN COMMENTS: Felicia Harris-Hoss, 3112 Sumac, stated her concerns regarding the budget and the water rate increases for Fiscal Year 2019-2020 and Fiscal Year 2020-2021. PUBLIC HEARING: NONE CONSENT AGENDA A. Consideration and Possible Action - Resolution No. R2020-46 - A Resolution of the City Council of the City of Pearland, Texas, terminating prior Advanced Funding Agreements, and authorizing a new Advanced Funding Agreement with the Texas Department of Transportation ("TxDOT"), for the Smith Ranch Road Widening Project (Hughes Ranch Road to north of Broadway/FM 518), in the amount of $5,173,341.00. Councilmember Orlando made the motion, seconded by Councilmember Moore, to approve Resolution No. R2020-46. AYES: Orlando, Carbone, Little, Moore, Owens. NAYS: None. Mayor Pro -Tem Little recognized those wishing to speak. Denise Hewitt, 3404 Blue Spruce Trail, spoke regarding her concerns relating to water billing and requested an investigation be conducted by an independent auditor. Arnae Fulton-Draughon, 3107 Centennial Village Drive, spoke regarding her experience as the Pearland Utility Manager during the water billing conversion to a 28 -day water billing cycle. Jeff Hunkele, 3912 Oakwood Drive, stated his concerns relating to water billing. Deputy City Manager Branson gave an overview of the presentation given at the February 17, 2020 and February 24, 2020 City Council meetings. Deputy City Manager Branson gave an overview of Plan Option B: 32/30 Plan, Option B: 34/30 Plan, Option C: Bill Full Amount Due Plan, and Option C: Hybrid Option. Mayor Pro -Tem Little recognized others wishing to speak. Felicia Harris-Hoss, 3112 Sumac, stated her concerns regarding the accuracy of information, relating to water billing, provided to Council by Staff. Ms. Hoss requested an independent investigation be conducted. Jimmy Davis, 5004 Colmesneil Street, stated his concerns regarding water billing and requested an independent investigation be conducted. Council directed Staff to proceed with Option B: 32/30 Plan; prepare responses to the concerns presented by the residents; and train Utility Billing staff to properly respond to residents wishing to settle their balance. This item will be scheduled for the March 16, 2020 City Council Special meeting for Council's consideration of Option B: 32/30 Plan. 2. Consideration and Possible Action -First Reading of Ordinance 1358-19 -An Ordinance of the City Council of the City of Pearland, Texas, amending non -development usage and service fees; containing a savings clause, a severability clause, a repealer clause, providing for publication and an effective date. Councilmember Carbone made the motion to approve the First Reading of Ordinance No. 1358- 19 to include the directive given to Staff to proceed with Option B; 32/30 Plan; prepare Utility Billing staff to respond to residents wishing to settle their balance; provide responses to the concerns presented by residents; and provide an update at the March 16, 2020, City Council Special Meeting, seconded by Councilmember Moore. The motion carried. 2000M, the zoning map of the City of Pearland, Texas, for the purpose of changing the classification of certain property, Being all of Lots 1, 2, 3 and a Detention Reserve of the Rice Drier Commerce Park Addition, an addition in the City of Pearland, Brazoria County as described in the Final Plat recorded in County Clerk's File No. 2019027535 in the Plat Records of Brazoria County, Texas. (West of Main Street, between Halik Road and Orange Street). Zone Change Application No. ZONE 19-00027, a request by request by Duane Bingham, applicant, on behalf of Presidio Equities, LLC., owner, for amendments to the Rice Drier Commerce Park Planned Development (PD) to allow a Farm Supply Store and Outdoor Storage within the PD, on approximately 22.86 acres of land; providing for an amendment of the zoning district map; containing a savings clause, a severability clause, and an effective date and other provisions related to the subject. Mayor Pro -Tem Little made the motion, seconded by Councilmember Moore, to approve the First Reading of Ordinance No. 2000M-198. AYES: Orlando, Carbone, Little, Moore, Owens. NAYS: None. Consideration and Possible Action - First Reading of Ordinance 2000M-201 - An Ordinance of the City Council of the City of Pearland, Texas, amending Ordinance No. 2000M, the zoning map of the City of Pearland, Texas, for the purpose of changing the classification of certain property, Being Lots A, B, C, D and Reserve A, Block 1 of the Center at Pearland Parkway Addition, an addition in the City of Pearland, Brazoria County as described in the Amending Plat recorded in County Clerk's File No. 2014046177 in the Plat Records of Brazoria County, Texas; being Lot A and Reserve A, Block 1 of the Center at Pearland Parkway Phase II Addition, an addition in the City of Pearland, Brazoria County as described in the Minor Plat recorded in County Clerk's File No. 2016011948 in the Plat Records of Brazoria County, Texas; and also being Lots 1, 2, 3 and Reserve A, Block 1 of the Center at Pearland Parkway Phase III Addition, an addition in the City of Pearland, Brazoria County as described in the Final Plat recorded in County Clerk's File No. 2018047201 in the Plat Records of Brazoria County, Texas. Zone Change Application No. ZONE 19-00030, a request by Jeff Boutte, Windrose Land Services, applicant, on behalf of SR Pearland II, LLC., owner; for approval of a amendments to the Center at Pearland Parkway Planned Development, including zero -foot side setbacks, on approximately 52.48 acres of land; providing for an amendment of the zoning district map; containing a savings clause, a severability clause, and an effective date and other provisions related to the subject. (3429 Main Street). Zone Change Application No. ZONE 19-00028, a request by Jon Arledge, applicant, on behalf of V & B Cornerstone LLC, owner; for approval of a zoning change from Single-family Residential -3 (R-3) District to General Commercial (GC) District, on approximately 0.63 acres of land; providing for an amendment of the zoning district map; containing a savings clause, a severability clause, and an effective date and other provisions related to the subject. Consideration and Possible Action - First Reading of Ordinance 2000M-200 - An Ordinance of the City Council of the City of Pearland, Texas, amending Ordinance No. 2000M, the zoning map of the City of Pearland, Texas, for the purpose of changing the classification of certain property, Being a 3.08 -acre tract of land situated in the George C. Smith Survey, Abstract Number 551 and being a portion of a called 8.430 -acre tract of land conveyed to DMP Acquisition Fund, LLC by the Deed recorded under the Brazoria County Clerk's File Number (B.C.C.F. No.) 2017023566 of the Official Public Records of Real Property of Brazoria County, Texas (East of 4155 S. Main Street). Zone Change Application No. ZONE 19-00029, a request by Alan Mueller, applicant, on behalf of DMP Acquisition Fund, LLC., owner; for approval of a zoning change from Single- family Residential -4 (R-4) District to Light Industrial (M-1) District, on approximately 3.08 acres of land; providing for an amendment of the zoning district map; containing a savings clause, a severability clause, and an effective date and other provisions related to the subject.
