THE H.T. & B.R.R. COMPANY SURVEY, ABSTRACT 542, BEING PART
OF THE SOUTH ONE-HALF OF LOT 58 OF THE W. ZYCHLINSKI
SUBDIVISION, SECTION TWO AS RECORDED IN VOLUME 29, PAGE 43
OF THE BRAZORIA COUNTY DEED RECORDS, AND IS PART OF THE
REMAINDER OF A 9.6659 ACRE TRACT DESCRIBED IN A DEED TO

OWNERS, PROVIDING FOR AN AMENDMENT OF THE LAND USE
DISTRICT MAP; CONTAINING A SAVINGS CLAUSE, A SEVERABILITY
CLAUSE, AN EFFECTIVE DATE AND OTHER PROVISIONS RELATED
TO THE SUBJECT.
WHEREAS, Office West Realty Company, applicant for Pearland Storage
Facility, L.C., owners, filed on April 18, 2005, an application for amendment pursuant to
Section 28 of Ordinance No. 509, the Land Use and Urban Development Ordinance of
the City, for approval of a change in the land use as provided for in said Section 28,
said property being legally described in the original applications for amendment
attached hereto and made a part hereof for all purposes as Exhibit "A"; and
WHEREAS, on the 16th day of May, 2005, a Joint Public Hearing was held
before the Planning and Zoning Commission and the City Council of the City of
Pearland, Texas, notice being given by publication in the official newspaper of the City,
the affidavit of publication being attached thereto and made a part hereof for all

purposes, as Exhibit "B", said call and notice being in strict conformity with provisions
of Section 28.3 and 28.4 of Ordinance No. 509; and
WHEREAS, on the 20th day of June, 2005, the Planning and Zoning Commission
of the City submitted its report and recommendation to the City Council regarding the
proposed amendment application by Office West Realty Company, applicant for
Pearland Storage Facility, L.C., owners, whereby the Commission recommended
approval of a Specific Use Permit for Storage and Mini -Warehouse in the Commercial
District (C (S)); and
WHEREAS, upon receipt of the report from the Planning and Zoning
Commission, the City Council considered this application and the recommendation of
the Planning and Zoning Commission at a regular meeting on June 27, 2005; and
WHEREAS, the City Council having fully heard the testimony and argument of
all interested parties, and having been fully advised in the premises, finds that in the
case of the application of Office West Realty Company, applicant for Pearland Storage
Facility, L.C., owners, presented which, in the judgment of the City Council, would
justify the approval of said application; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
I.
The following described property located within the corporate City limits of the
City of Pearland, Texas, and presently classified as Commercial District (C), is hereby
zoned for a Specific Use Permit for Storage and Mini -Warehouse in the Commercial
District (C (S)), and such property being more particularly described as:

of the south one-half of Lot 58 of the W. Zychlinski Subdivision, Section Two as
recorded in Volume 29, Page 43 of the Brazoria County Deed Records, and is
part of the remainder of a 9.6659 acre tract described in a deed to Pearland
Storage Facility, L.C., as recorded in Clerk's File Number 93-020900 of the
Brazoria County Official Records, City of Pearland, Brazoria County, Texas
(Generally Located on the East Side of State Highway 35 (Main Street), and on
the North Side of Future McHard Road)
II.
The City Council of the City of Pearland finds and determines that the recitations
in the preamble hereof are true and that all necessary prerequisites of law have been
accomplished and that no valid protest of the proposed change has been made. The
City Council further finds and determines that there has been compliance with the
mandates of law in the posting and presentation of this matter to the Planning and
Zoning Commission and to the City Council for consideration and decision.
III.
The City Council of the City of Pearland finds and determines that the
amendment adopted herein promotes the health, safety, and general welfare of the
public and is a proper valid exercise of the City's police powers.
IV.
If any section, subsection, sentence, clause, phrase, or portion of this Ordinance
is for any reason held invalid or unconstitutional by any court of competent jurisdiction,
such portion shall be deemed a separate, distinct, and independent provision and such
holding shall not affect the validity of the remaining portions thereof.
V.

All rights and remedies, which have accrued in the favor of the City under this
Ordinance and its amendments thereto, shall be and are preserved for the benefit of
the City.
VI.
The City Secretary is hereby directed to cause to be prepared an amendment to
the official Land Use District Map of the City, pursuant to the provisions of Section 2 of
Ordinance No. 509 and consistent with the approval herein granted for the
reclassification of the herein above described property.
VII.
This Ordinance shall become effective after its passage and approval on second
and final reading.

SUBJECT: Specific Use Permit No. 144 — Proposed Storage and Mini -
Warehouse on East Side of SH 35 and North of Future
McHard Road
This item was heard at the Joint Public Hearing on May 16, 2005 and
subsequently discussed by the Planning and Zoning Commission at their meeting
following the Joint Public Hearing.
At the P & Z meeting staff was requested to examine the requirements of the
McHard Overlay District with respect to this proposal. Following is a brief
explanation of the requirements of the McHard Overlay District. Also attached is
the section of the Land Use and Urban Development Ordinance that describes the
requirements of the Corridor Overlay District.
1. The applicant has proposed that the subject property is going to be
combined with the adjoining lot (with an existing self storage facility) that
has frontage on SH 35 and McHard Road. The proposed addition would be
subject to the requirements of the Overlay District, since the requirements
apply to the depth of the lot up to a maximum of 300 feet on either side of
the street ROW. Existing non -conforming situations can remain unless the
Specific Use Permit (SUP) specifically requires modifications or
compliance is required' by other sections of the Land Use and Urban
Development Ordinance (Ordinance). The existing non -conformities on
this site would include, but not limited to, existing material and location of
fences, building facades, location of parking, etc.
2. Building Facade Requirements:
a. Exterior walls visible from future McHard Road and SH 35 needs to
be covered by mason.
b. A minimum of 25% ofryan exterior wall facing McHard Road needs to
be transparent.

Impact Analysis would be required at the time of platting that would
address the driveway issues also.
4. Landscaping Requirements: Entire site (lot with existing buildings and
the lot with proposed buildings) need to comply with the landscaping
requirements.
a. Street trees will be required along the portion of the entire site that
abuts McHard Road and SH 35 ROW.
b. All other requirements of the Corridor District (page 104) and general
Landscaping Requirements will apply to the entire site.
5. Screening:
a. All screening walls need to be 30' from ROW line.
c. All mechanical and utility equipment, vehicle loading and unloading
areas, refuse containers etc. will need to be screened as per
requirements under screening.
d. All new fences and walls visible from McHard or SH 35 needs to be
constructed of masonry or other materials approved by the City
Manager or his designee and setback at least 30 feet from ROW
line. Fences need to conform to the other requirements of the
Corridor District as specified.
Existing fences (that do not conform in terms of material or setback) can
remain as non -conforming, unless the SUP specifies otherwise. The
SUP can also stipulate the material of fences if a deviation from the
Ordinance is preferred.
6. Sidewalks, Pedestrian Walkway, Signage and Utilities:
Need to meet the requirements of Corridor Overlay.
7. Parking: Adequate parking would need to be provided for the entire site.
Parking areas need to be buffered from a public street by a 3ft high
masonry wall, landscaped earth berm or shrubbery. All parking areas
need to be at least 30 feet from street ROW line.
Existing parking that does not meet the setback requirement would need
to conform if required by SUP. All other parking requirements such as
size, aisles, screening etc. need to comply with the Ordinance.
8. Outside Storage: The Commercial zone permits outside storage. The
Corridor District requires that open storage needs to be setback at least 30
feet from street ROW line. SUP approval can include conditions regarding
screening or prohibition of outdoor storage.
9. Building Articulation: Required as per the Corridor District.
10.The SUP can include a condition regarding temporary Certificates of
Occupancy.
It is staff recommendation that the Planning and Zoning Commission list their
conditions as part of Specific Use Permit, irrespective of the Overlay District
requirements.
Attached is Section 25.2 that discusses the Development Standards Required
under an SUP. As stated — "_ _ _may impose such development standards and
safeguards as the conditions and location indicate important to the welfare and
protection of adjacent property from excessive noise, vibration, dust, dirt, smoke,
fumes, gas, odor, explosion, glare, offensive view or other undesirable and
hazardous conditions."
Therefore the SUP can include any conditions that fall under the above mentioned
purpose statement.

SUMMARY: The applicant is requesting approval of a Specific Use Permit to allow storage
and mini -warehouse on a lot that is zoned Commercial District (C). The Land Use and
Urban Development Ordinance requires approval of a Specific Use Permit for any storage

and mini -warehouse facilities in the Commercial District (C), as well as other districts. The
subject property is currently undeveloped.
The area to the west of the subject property is an existing mini -storage facility. The
existing mini -storage facility and the subject property are under the same ownership. The
applicant is proposing an expansion to the existing mini -storage facility, but the Specific
Use Permit would apply only to the subject property, and not the existing mini -storage
property. The existing mini -storage property is currently a non -conforming use as it does
not have an approved Specific Use Permit. The existing facility was constructed when a
mini -storage facility was a permitted use within the Commercial District. Since then, the,
ordinance has been amended to require all mini -storage -facilities to have an approved
Specific Use Permit in certain districts.

Mini -Storage Facility
CONFORMANCE TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE: The
subject property is currently zoned Commercial District (C), and the existing lot meets the
minimum lot size and lot width of the Commercial District. The applicant will be responsible
for compliance with all other regulations within the Commercial District and the Land Use
and Urban Development Ordinance, should the specific use permit be approved.
PLATTING STATUS: It appears that the subject property is not platted. A plat may need
to be submitted and approved, prior to the issuance of a building permit.
Since the subject property is under the same ownership as the existing mini -storage facility
that fronts onto State Highway 35, the applicant will be responsible for submitting a plat
that includes the entire ownership and SH 35 frontage, in order for the subject property to
comply with the Subdivision Ordinance that requires all Tots to have access to a public
right-of-way.
CONFORMANCE TO THE COMPREHENSIVE PLAN: The Comprehensive Plan (2004
update adopted on July 26, 2004) recommends "Light Industrial" uses for the subject
property and for the properties to the north, south, and west. The Comprehensive Plan

further indicates that the appropriate zoning districts for "Light Industrial" is the Light
Industrial District M-1. The existing Commercial zoning district for the property currently
conflicts with the recommendations of the Comprehensive Plan, as the Commercial zoning
has been in place for several years.
CONFORMANCE TO THE THOROUGHFARE PLAN: The subject property currently has
no frontage on a public right-of-way, but is under the same ownership as the existing mini -
storage property directly to the west. When the subject property is platted, it would need to
be combined with the adjacent property that has frontage on State Highway 35. The
existing mini -storage under the same ownership has frontage on State Highway 35 (Main
Street), a major thoroughfare with an ultimate right-of-way of 120 feet. If adequate right-of-
way for Main Street does not exist, the applicant will be responsible for the dedication of
any necessary right-of-way during the review of a plat.
The subject property is within close proximity to McHard Road, a majorthoroughare with an
ultimate right-of-way of 120 feet. The subject property does not have frontage on McHard
Road.
AVAILABILITY OF UTILITIES: An 8 inch water main currently exists within Main Street. A
16 inch water line will be located within McHard Road. A 4 inch force main sanitary sewer
currently runs north/south through the existing mini -storage property. A 6 inch gravity main
sanitary sewer currently runs north/south through the existing mini -storage property, and
along the south side of McHard Road.
Utility service will be reviewed as part of the application for a building permit.
IMPACT ON EXISTING AND FUTURE DEVELOPMENT: The requested specific use
permit should not cause any negative impacts on the surrounding properties within the
subject area. The surrounding properties are all, zoned as Commercial District. The
proposed Specific Use Permit would allow for the construction of a mini -storage facility, an
expansion of the existing facility located to the west.
If the proposed Specific Use Permit is approved, the applicant may be responsible for the
submittal of a traffic impact analysis (TIA) in order to determine the impact of the proposed
development on adjacent roadways and adjacent properties, as well as the locations of
driveways.
The attached preliminary site plan and elevation drawings are submitted for informational
purposes only and are conceptual in nature, and have not yet been reviewed for
compliance with all applicable ordinances. A complete review will be conducted when the
applicant applies for a building permit.

PUBLIC COMMENTS: Public notice/comment forms were mailed to property owners
within 200 feet of the subject property under consideration. A legal notice of public hearing
was published in the local newspaper, and a Zoning. Sign was placed on the subject
property.
STAFF RECOMMENDATION: Staff recommends approval of the Specific Use Permit, as
proposed by the applicant, for the following reasons:
1. The proposed specific use permit should not negatively impact any surrounding
commercially zoned properties.
2. The subject property is surrounded on all sides by existing Commercial Districts (C).
3. The existing mini -storage facility to the west is under the same ownership as the
subject property, and the proposed Specific Use Permit would allow for the existing
facility to expand.
4. The Light Industrial District (M-1) recommended by the Comprehensive Plan would
allow self storage by approval of a Specific Use Permit also, and therefore conforms
to the Comprehensive Plan.

All rights and remedies, which have accrued in the favor of the City under this
Ordinance and its amendments thereto, shall be and are preserved for the benefit of
the City.
VI.
The City Secretary is hereby directed to cause to be prepared an amendment to
the official Land Use District Map of the City, pursuant to the provisions of Section 2 of
Ordinance No. 509 and consistent with the approval herein granted for the
reclassification of the herein above described property.
VII.
This Ordinance shall become effective after its passage and approval on second
and final reading.
