A Resolution of The City Council of the City of Pearland, Texas, authorizing
the City Manager, or his designee, to accept the FY 2020 Emergency
Management Performance Grant (EMPG) from the Texas Division of
Emergency Management (TDEM) in the amount of $36,400.57 in federal
pass-through Funds from the Federal Emergency Management Agency
(FEMA).
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That the City Council hereby authorizes the City Manager, or his
designee, to accept the FY 2020 EMPG from the TDEM in the amount of $36,400.57 in federal
pass-through Funds from FEMA.

This Class Description does not constitute an employment agreement between the City and all
employee and the statements herein are intended to describe the general nature and level of work
being performed by individuals assigned to this position. They are not intended to be an exhaustive list
of all responsibilities, duties, knowledge, skills and abilities required of personnel so classified in this
position. The position description is subject to change by the City as the needs of the city and
requirements of the position change.
General Description
The purpose of this class within the organization is to assist with planning community
outreach programs, assist Emergency Management Coordinator in working with federal,
state, local officials, City staff and community groups in developing and exercising the
emergency operations plan, and preparing the emergency operations plan so that it
meets local, state, and federal requirements.
This class works independently, under limited supervision, reporting major activities
through periodic meetings.
Duties and Responsibilities
The functions listed below are those that represent the majority of the time spent
working in this class. Management may assign additional functions related to the
type of work of the class as necessary,
Essential Functions:
Prepares Emergency Management Performance Grant (EMPG) applications to obtain
federal grant funding. Administers all aspects of compliance with grant requirements
including preparation of semiannual EMPG progress reports, quarterly financial and
training reports to satisfy with state and federal requirements.

It is the intent of the City to establish a policy regulating travel, meetings, enterialriment, personal car mileage,
and/or otherexpenses Incurred by City employees who are authorized to officially represent the City at various
conferences, meetings, conventions, seminars, and other functions.
This policy provides uniform guidelines and procedures for submission and processing of expendlhtre requests
and ensures proper accounting for approved allowable expenses, including travel advances, per diem meals and
incidentals, City credit card charges, and cash expenditures made for the purposes herein defined on behalf of
the City.
Faflureto comply with all of the provisions of this policy may result in disciplinary action up to and including
termination of employment.
A. Responsibilities
1, The Department DiirectorsOvIslon Managers are responsible for communicating and administering the
provisions of this policy to employees and approving expenses as legitimate business items. Non-exempt
employees are compensated In accordance with prevailing Wane and Hour Law.
2. The Director of Finance is responsible for the overall administration of expenditures regarding this policy.
Department Directors/Division Managers are responsible for monitoring the travel and meeting expenses of their
employees.
3. The Director of Finance and the Department Directors/Division Managers, as well as any employee, shall have
the responsibility to report any abuse and/or misuse of travel funds to appropriate management.
B. Expenses
1. expenses shall ransist of the actual costs which a reasonable and prudent person Inrurs related to travel and
meeting attendance, excluding perdiems. All expenses must be directly related to City business.
2. Employees are expected to be conservative in their expenditures as if they were paying such costs.
3. The expenses will be rejected if required documentation is not provided. Original, detailed receipts must be
turned in on all reimbursable expenditures, with the exception of tips and per diem meals and incidentals.
Documentation is a service -provided name or logo -printed receipt, where available. Expenses incurred not in
accordance with this policy are the responsibility of the employee.
4, Allowable Giving Expenses -- Actual living expenses, within the specified limits, may he claimed by aR City
employees when they aro representing the City on official business that requires an overnight stay away from
Pearland, riving expenses Include such items as hotel rooms, tips, parking, ground transportation, and Itemized
telephone calls, as outlined:
a. Hotels/Motels. The City VIII pay actual expenses for hotels, motels, or other lodging for the actual number of

c. Internet Service. Where not provided free, the City will pay reasonable Internet service costs where the
Internet is used for City business.
d. Parking. Employees may claim actual parking expenses.
o. Ground Transportation. Employees may claim reasonable, actual ground transportation expenses, Including
shuttle services and taxis,
f. Tlps/Gratuities. Tips and gratuities are allowed and are considered reasonable whon paid at the rate of 15% of
meal cost and $1.00 per piece of luggage, except when traveling under per diem.
g. The City will not pay or reimburse registration fees, meals and travel expenses of spouses or significant others
who accompany employees to conferences or other business related events.
h. The City will not pay or reimburse registration fees, meals and travel expenses, or cancellation foes or
penalties assessed for personal reasons, unless emergency in nature.
5. Meals -- When representing the City on official business that requires an overnight stay away from Poariand,
the Department Director/Division Manager will determine how meals wilt be paid. The options are as follows: July

a. Credit Cards: If the employee Is Issued a City credit card and will be using it to pay for meals while on
overnight travel, the employee will be allowed to charge the Internal Revenue Sarvlce IRS published per diem
(vrww.gsa.govlperdiem) per meal for the Houston area, including tip,
(1) Employees will be reimbursed actual costs, but not to exceed per diem rates. Detailed, itemized receipts are
required for all meals.
(2) Where meals are provided at conferences and Included in the registration fee, reimbursements will not be
allowed.
(3) City employees may find it necessary to pay for the meals of business associates, including follow City
employees, from time to time. If this is necessary, the business purpose of the meal should he stated on the
request for paymeniheimbursement, along with the individuals for whom the meal was purchased.
(4) Traveling Day Reimbursement - Reimbursement for meals on travel days to and from Pearland, for overnight
stays, will be handled as follows:
a) Travel from Pearland. Employee will receive reimbursement for all meals if departure is at 7:00 a.m. or earlier;
reimbursement for lunch and dinner if departure is between 7:00 a.m. and 1:00 p.m.; and reimbursement for
dinner only if departure Is after 1:00 p.m.
b) Returning to Pearland. Employee will receive reimbursement for all meals if return is after 7:00 p.m.;
reimbursement for lunch and breakfast if returning after 1:00 p.m.; and reimbursement for breakfast only if
returning pnorto 1:00 p.m.
c) Travel to some cities with an unusually high cost of living, such as New York City, San Francisco, etc, may be
required. During these times, the supervisor may permit reimbursement of meal expenses above and beyond the
limits set in this policy. In no case should reimbursement exceed the guidelines set by the IRS for allowable meal
expenses for those cities and the employee remains obligated to be prudent and reasonable In the employee's
meal expenses. Texas and its surrounding states are not included in this provision. Receipts must be submitted.
K Per Diem: Wit be based on the IRS allowable rate per day for the city to which tha amployes will travel, If the
department chooses this option.
(1) If traveling outside of Texas, the current IRS per diem rale for the City must be attached to the check request
submitted to Finance prior to receiving payment. This Information can be found on IRS Publication 41542, the
IRS web site or the GSA.gov web site.

(4) In order to pro -rate lire per diem to account for partial travel days (see Travel Day Reimbursement under the
credit card option), the following formula will be utilized:
Breakfast— 20%
Lunch — 30%
Dinner.-- 60%
(5) The per diem request should be prepared on a Travel Advance/ Expense Report with all pertinent
information, approved by the Department DirectodDivision Manager and submitted at the earliest practical time,
but preferably no later than seven (7) full working days prior to departure. The Finance Department will Issue the
traveling employee a check for the amount of the per dietn meals.
(6) In Instances where a per diem advance was niado and the trip was not taken, the employee shall return the
funds to the Finance Department for credit to the proper fund.
6. Other Living Expenses — The cost of alcoholic beverages, laundry/dry cleaning, in -room movies, personal
to fitness center fees, personal entertainment, and spouse or other family expenses are specifically excluded
from reimbursement.
7. Transportation Expenses
Employees will utilize the most economical form of transportation available. When submitting reports, employees
will submit the completed comparlson of the available modes of transportation for review.
a, Other Transportation. When requesting air transportation, the employee shall request the least expensive flight
status. The employee may choose to travel first-class, but the City will pay only for coach class.
Accommodations must be booked in a timely mariner to ensure coach Nass is available.
b_ Vehicle Transportation. The employee may use their personal funds, keeping receipts for reimbursement; the
employee may seek an advance; or the employee may use the City credit card. An employee may also use a
personal car for City travel. Actual mileage is calculated in miles from the work site or residence, depending on
where leaving from, to the destination. Any other mileage is considered as part of the normal commute to work.
The City will reimburse the lesser of (1) actual mileage to and from the destination multiplied by the current rate
per mile as determined by the IRB; or (2) the round trip cost of the most reasonable altemative conveyance, e.g.
airfare, that would be spent for each employee traveling to the destination In the vehicle. Employees receiving
cAr allowances are reimbursed at a reduced rate for mileage In excess of 200 miles, Thu rate is 30% of the IRS
allowable rate.
c. Rental Cars. Employees shall sign and accept the liabilityloolllsion Insurance agreement on the contract.
Failure to accept this additional insuranre will constitute agreement by the employee to be responsible to the
service provider, third parties, or the City (at the City's discretion) In accidents for which the employee is
determined to have acted negligently.
d. City Vehicles. City vehicles may be used at the discretion of the Department Director/Division Manager when
coals are not in excess of the costs of airfare and site transportation combined or when air transport is not
available or is Impractical. Dlrart expenses, such as gasoline and oil, associated with the use of a City vehicle
will be reimbursed with receipts.
C. Expense Reports
1. A Travel AdvancelExpense Report will be required for any cash advance, per diem or credit card purchases
for all allowable living expenses as stated In this policy.
2. When it becomes necessary that an employee travel in the interest of the City, the Department
Director/Division Manager may request a travel advance. This request may be made on the Travel
AdvancolExpense Report and should contain the name of the prospective traveler, purpose of the trip, date(s),

3. The Department Director's/Division Manager's request for travel advances require prior approval by the City
Manager's office. Others require prior approval of their Dopartment Director/Division Manager. If approved, the
request wilt be sent directlyto the Finance Department no later than seven (7) clays prior to departure.
D. Filing Expense Reports - Complete Travel AdvanceiExpense Report promptly. Upon return from travel, the
ernployee shall promptly complete a Travel Advance/Expense Report for approval by the Department
DirectoriDivision Managaror designee and shall submit the completed Travel AdvancelExpense Report to the
Finance Depariment within ten (10)working days. Employees shall include all prepaid expenses (registration,
airfare, etc.) related to travel on the Travel Advance/Expense Report. Submit to Department Directon'Divtslon
Manager for approval. The director/division manager or designee sha'.i review, sign, and submit the Travel
Advance/Expense Report to the Finance Department. When payment or documentation is not received within the
required time allowances, the Finance Department will discontinue any advances to that employee. The
Department DirectorlDIvision Manager is also responsible for ensuring that all Travel Advance/Expense Reports
are completed in accordance with this policy. Executive level employees shall submit their Travel
Advance/Expense Reports directly to the City Manager's Office, The City Manager's Office shall forward Travel
AdvancolExpense Reports to the Finance Department after review and approval.
1. Return of Unused Funds - The Finance Department shall ensure that the returned monies are credited to the
same division and line item account from which they were originally drawn. Returned funds are due to the Gity by
the due date of the Travel Advance/E=xpense Report.
2. Finance Department Review - The Finance Department shall review the items submitted and determine their
mathematical accuracy and the allowable expenses under this policy. When a review verifies the accuracy of the
Travel AdvancelExpense Report and a reimbursement is due the employee, the Finance Department will issue a
check or direct deposit to the employee based on the approved report.
E. Paid Time
1. Attendance at lectures, meetings, training programs and sfmllar activities need NOT be counted as working
fte only if four (4) criteria are met, namely
a. it is outside normal hours;
b. It is voluntary;
c. It is not Job related; and
d. there Is no other work that is concurrently performed.
2. Travel that keeps an employee away from home overnight is travel away from home, Travel away from home
is clearly work time when It cuts across the employee's workday. The time Is not only hours worked on regular
working days during normal working hours but also during corresponding hours on non -working days. Time that
is NOT considered work time is that lime spent In travel away from home outside of regular working hours as a
passenger on an airplane, train, boat, bus or automoblle.

Section 418.101 of the Texas Government Code states: "The presiding officer of the governing body of each
political subdivision will notify the Division of Emergency Management of the mariner in which the political

2020 Emergency Management Performance Grant (EMPG)
Purpose
The FY 2020 priority for this program is to advance "Whole Community" security and emergency
management. Grant funds will be used to support local comprehensive emergency management
programs to encourage improvement of mitigation, preparedness, response, and recovery capabilities
for all hazards. Funding may be used to support activities that contribute to the capability to manage
consequences from acts of terrorism. Funds provided may also be used to accomplish initiatives
described in the Federal Program Guidelines, including local implementation of the National Incident
Management System (NIMS), incorporation of appropriate references to the National Response
Framework (NRF) into local plans, homeland security assessment and strategy integration, and
assessment of local emergency management programs

Grant Acceptance
Notice of Subrecipient Grant Award remains an offer until the signed copy of the Acceptance of
Subrecipient Grant Award is received by the Texas Division of Emergency Management (TDEM) in
accordance with the instructions provided in the transmittal letter.
Task Requirements
The approved FY 2020 Statement of Work and Progress Report template outlines eight tasks that the
grantee must perform during the grant period. The following additional tasks are also required of
Subrecipients:
a. Implement (NIMS) at the local level.
b. Incorporate pertinent information concerning National Response Framework into the
local or inter -jurisdictional emergency management plan and its annexes.
c. Subrecipients must have a tracking system of record to organize and coordinate
resources in response to incidents.
d. During the performance period of this grant, Subrecipient must maintain an emergency
management, as prescribed by the TDEM. This may be accomplished by jurisdictions
maintaining their own emergency management plan or participating in an inter -
jurisdictional emergency management program that meets the required standards. If
TDEM identifies deficiencies in the Sub -recipient's plan, Sub -recipient's will correct
deficiencies within sixty (60) days of receiving notice of such deficiencies from TDEM.
e. Sub -recipient's must maintain an updated inventory of equipment purchased through
this grant program in accordance 2 C.F.R. 200 Requirements, Reports, Records,
Retention, and Enforcement, Equipment and the Department of Homeland Security
(DHS),
The Subrecipient agrees that any equipment purchased with funds through this grant
program shall be prominently marked as follows: "Purchased with funds provided by the
U.S. Department of Homeland Security." Exceptions to this requirement are limited to
items where placing of the marking is not possible due to the nature of the equipment.
Grant Funding
The amount of this grant may be less than the amount requested in your Application for Federal
Assistance due to limits on federal funding for the EMPG program. However, EMPG grant recipients
should report eligible expenses in quarterly financial reports. Any excess match reported, will be
used for TDEM match purposes and becomes 100% federalized, therefore cannot be used for any
other grant match purposes within your jurisdiction.
Financial and Administrative Requirements
In Accordance with 2 C.F.R. Part 200 Subpart F—Audit Requirements, Subrecipient agrees to comply
with the applicable financial and administrative requirements set forth in the Office of Justice
Programs (OJP) Financial Guide.
a. All emergency management program costs for which the Subrecipient seeks reimbursement must
be eligible in accordance with 2 CFR Part 200 as it applies ,to awards of Federal financial
assistance to all "non-federal entities"
b. Subrecipient will comply with the organizational audit requirements of super circular 2A
CFR 200 Audits of States, Local Governments, and Non -Profit Organizations.
When implementing Federal Emergency Management Agency (FEMA) National
Preparedness Directorate funded activities; the Subrecipient must comply with all
federal civil rights laws, to include Title VI of the Civil Rights Act, as amended. The
Subrecipient is required to take reasonable steps to ensure persons of limited English
proficiency have meaningful access to language assistance services regarding the
development of proposals and budgets and conducting FEMA funded activities.
d. Subrecipient will assist the awarding agency (if necessary) in assuring compliance with
the National Historic Preservation Act of 1966 Section 106 (16 U.S.C. § 470), Ex. Order
11593 (idpntifirrntinn and nrntedinn of histmir nrnnerfiPs). the Archeolooical0and
Historical Preservation Act of 1974 (16 U.S.C. § 469 a-1 et seq.), and the National
Environmental Policy Act of 1969 (42 U.S.C. § 4321). (Federal Assurance).
e. Subrecipient agrees to make no request for reimbursement for goods or services
procured by the Subrecipient either prior to the start of the period of performance stated
in this award document or after the end of the period of performance.
Notwithstanding any other provisions of this document, the parties understand and
agree that the obligations of TDEM under this Agreement are contingent upon the
availability of adequate funds to meet TDEM's liabilities. TDEM shall not be liable to the
Subrecipient for costs under this agreement that exceed the amount specified in the
Notice of Subrecipient Grant Award.
Single Audit Act Requirements: For sub -recipients expending $750,000 or more in
federal annually, the Applicant will cause to be performed the required financials and
compliance audits in accordance with the Single Audit Act Amendments of 1996 and
Title 2 of the Code of Federal Regulations, Part 200, Subpart F Audit Requirements.
Reporting Requirements
Subrecipient agrees to comply with all reporting requirements and shall provide such information as
required by TDEM. Reporting requirements can be found in the 2020 Local Emergency Management
Performance Grant (EMPG) Guide. Sub -recipients may be required to submit additional information
and data requested by TDEM and after the end of the period of performance in order to close out the
grant. A copy of the 2020 Local Emergency Management Performance Grant (EMPG) Guide can

rg ant/. Sub recipient must prepare and submit Semi -Annual Progress Reports to TDEM for the
duration of the grant performance period or until all grant activities are completed and the grant is
formally closed. The first performance -reporting period is October 1 to March 31 (progress report due
April 15) and the second reporting period is April 1 to September 30 (progress report due October
15). Subrecipient may also be required to submit additional information and data as requested by
TDEM.
Review of Work and Expenditures
TDEM may review the work of the Subrecipient with respect to approved program tasks and
expenditures for which reimbursement are requested to ensure the federal awards are used for
authorized purposes in compliance with laws, regulations, and the provisions of this contract or grant
agreement and that performance goals are achieved. These reviews may include, without limitation:
comparing actual Subrecipient activities to those approved in the sub -award application and
subsequent modifications if any; ensuring that grant funds have been expended in accordance with
applicable guidelines; confirming compliance with grant assurances, and verifying information
provided on performance reports and payment requests. All financial expenditures submitted for
match purposes will be verified. Any financial excess match submitted to TDEM for the EMPG
grant program cannot be used to match any other grant funded program and is considered
100% federalized for TDEM excess match purposes
Lobbying
As required by Section 1352, Title 31 of the U.S. Code, for persons entering into a contract, grant,
loan or cooperative agreement from an agency or requests or receives from an agency a commitment
providing for the United States to insure or guarantee a loan, the Applicant certifies that:
a, No Federal appropriated funds have been paid or will be paid, by or on behalf of the
Subrecipient, to any person for influencing or attempting to influence an officer or
employee of any agency, a Member of Congress, an officer or employee of Congress,
or an employee of a Member of Congress in connection with the making of any Federal
grant, the entering into of any cooperative agreement, and the extension, continuation,
renewal, amendment, or modification of any Federal grant or cooperative agreement;
b. If any funds other than Federal appropriated funds have been paid or will be paid to any
person for influencing or attempting to influence an officer or employee of any agency, a
Member of Congress, an officer or employee of Congress, or an employee of a Member
of Congress in connection with this Federal grant or cooperative agreement, the
undersigned shall complete and submit Standard Form - LLL, "Disclosure of Lobbying
Activities," in accordance with its instructions.
c. The Subrecipient will establish safeguards to prohibit employees from using their
positions for a purpose that constitutes or presents the appearance of personal or
organizational conflict of interest or personal gain.
Debarment, Suspension, and other Responsibility Matters
As required by Executive Order 12549, and 12689 and 2 C.F.R 200.213 and codified in the 2 C.F. R.
Part 180, Debarment and Suspension, the applicant will provide protection against waste, fraud, and
abuse by debarring or suspending those persons deemed irresponsible in their dealings with the
federal government. The applicant certifies that it and its principles, sub grantees, recipients or sub
recipients:
The Subrecipient certifies that it and its principals and vendors:
a) Are not presently debarred, suspended, proposed for debarment, declared ineligible,
sentenced to a denial of Federal benefits by a State or Federal court, or voluntarily
excluded from covered transactions by any Federal department or agency; Subrecipients
can access debarment information by going to www.epls.gov.

b) Have not, within a three-year period preceding this application, been convicted of or had a
civil judgment rendered against them for commission of fraud or a criminal offense in
connection with obtaining, attempting to obtain, or performing a public (Federal, State, or
local) transaction or contract under a public transaction; violation of Federal or State
antitrust statutes or commission of embezzlement, theft, forgery, bribery, falsification or
destruction of records, making false statements, or receiving stolen property;
c) Are not presently indicted for or otherwise criminally or civilly charged by a governmental
entity (Federal, State, or local) with commission of any of the offenses enumerated in
paragraph (1)(b) of this certification; and
d) Have not, within a three-year period preceding this application, had one or more public
transactions (Federal, State, or local) terminated for cause or default.
e) Where the applicant is unable to certify to any of the statements in this certification, he or
she shall attach an explanation to this application (Federal Certification).
Monitoring
a. Subrecipient will provide TDEM, State Auditor, DHS personnel or their authorized
representative, access to and the right to examine all paper or electronic records related
to financial assistance.
b. Subrecipient agrees to monitor their program to ensure that federal awards are used for
authorized purposes in compliance with laws, regulations, and the provisions of
contracts or grant agreements and that the performance goals are achieved.
TDEM may perform periodic reviews or sampling of Subrecipient performance of eligible
activities and approved projects. These reviews/sampling may include, without
limitation: performance of an onsite audit and compliance monitoring, including
inspection of all grant -related records and items, comparing actual.
Subrecipient activities to those approved in the sub -award application and subsequent
modifications if any, ensuring that advances have been disbursed in accordance with
applicable guidelines, confirming compliance with grant assurances, verifying
information provided in performance reports and reviewing payment requests, needs
and threat assessments and strategies.
c. Subrecipient understands and agrees that it cannot use any federal funds, either directly
or indirectly, in support of the enactment, repeal, modification or adoption of any law,
regulation or policy, at any level of government, without the express prior written
approval of FEMA National Preparedness Directorate.
d. The Subrecipient official certifies federal funds will be used to supplement existing funds
and will not replace (supplant) funds that have been appropriated for the same purpose.
Subrecipient may be required to supply documentation certifying that a reduction in non-
federal resources occurred for reasons other than the receipt or expected receipt of
federal funds.
e. All financial expenditures and excess match will be verified and validated by TDEM and
will become federalized funds and utilized by the Texas Division of Emergency
Management as match. Once these funds are utilized by the TDEM EMPG grant
program, your agency can no longer utilize them within for any other federal grant
match for the term of the grant performance year.
Reimbursement for Expenses
Reimbursement for expenses incurred during the second and fourth quarter of Fiscal Year 2020
will not be disbursed until TDEM receives the first and second semi-annual EMPG Progress
Reports, which are due on April 15, and October 15, respectively.
1. Choice of Law: This agreement shall be construed and governed by Texas law.
2. Changes to the Law: TDEM is a state agency whose authority and appropriations are subject to
the actions of the Texas Legislature and the United States Congress. If TDEM and/or the subject
matter of this contract become subject to a legislative or regulatory change, revocation of statutory or
regulatory authority, or lack of funds that would render the services and/or goods and/or payment to
be provided under this agreement impossible, unnecessary, void, or substantially amended, TDEM
may terminate this agreement without penalty to, or any liability whatsoever on the part of, TDEM, the
State of Texas, or the United States. This contract does not grant vendor a franchise or any other
vested property right.
3. Written Modification: No modification or amendment to this Agreement shall become valid unless
in writing and signed by both parties.
4. To the extent it applies, Subrecipient shall comply with Texas Government Code, Chapter 783, 1
Texas Administrative Code (TAC) §§ 5.141 et seq., and the Uniform Grant Management Standards,
State Uniform Administrative Requirements for Grants and Cooperative Agreements, Subpart B,
§_14.
5. To the extent it applies, Subrecipient shall comply with the General Appropriations Act, 80th
Legislature, Article IX, Part 17.
6. TDEM may suspend or terminate sub -recipient funding, in whole or in part, or other measures
may be imposed for any of the following reasons: failing to comply with the requirements or statutory
objectives of federal law, failing to make satisfactory progress toward the goals or objectives set forth
in the sub -award application, failing to follow grant agreement requirements or special conditions,
failing to submit required reports, or filing a false certification or other report or documentation.
Satisfactory progress is defined as accomplishing the following during the performance period of the
grant: requesting federal funds for purchases, training, etc. and deciding what purchases will be

accomplished with the equipment (or readied for deployment). All of the aforementioned tasks must
be accomplished in a timely manner. Special Conditions may be imposed on Subrecipient's use of

compliance personnel are resolved.
