2020-07-13 CITY COUNCIL REGULAR MEETING MINUTES MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON JULY 13, 2020, AT 6:30 P.M., VIA TELEPHONENIDEO CONFERENCE IN THE PEARLAND CITY HALL COUNCIL CHAMBERS, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. CALL TO ORDER: Mayor Reid called the meeting to order at 6:33 p.m. INVOCATION AND THE PLEDGE OF ALLEGIANCE: Councilmember Perez gave the Invocation and Boy Scout Troop 446 led the Pledge of Allegiance to the to the United States of America Flag and Texas Flag. CITIZEN COMMENTS: Jimmy Davis, 5004 Colmesneil Street, Pearland, Texas 77584, stated his concerns regarding water billing. Jeff Hunkele, 3912 Oakwood Drive, Pearland, Texas 77581, stated his concerns regarding the Fiscal Year 2019-2020 Budget Amendment No. 2, the issuance of the City's certificates of obligation, Series 2020B, the Pearland Convention and Visitors Bureau Grant program for the reinvestment of certain hotel occupancy tax revenues back to hotels located in the City. Greg Nelson, 1617 Pine Crest Drive, Pearland, Texas 77581, stated his concerns regarding Fiscal Year 2019-2020 Budget Amendment No. 2. Thomas Long, 2511 Feather Green Trail, Fresno, Texas 77545, spoke regarding banner service. A Resolution of the City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to participate in a cooperative pricing arrangement with TIPS for the purchase of four (4) vehicles from Silsbee Fleet Group in the amount of$109,921.00. Consideration and Possible Action - Resolution No. R2020-124 - A Resolution of the City Council of the City of Pearland, Texas, awarding a vehicle repair bid to International Paint and Body of Pearland, in the estimated amount of $50,000.00 for the period of July 20th, 2020 to July 19th, 2021 with two additional one-year renewal options. Consideration and Possible Action - Resolution No. R2020-130 - A Resolution of the City Council of the City of Pearland, Texas, establishing a limited purpose Convention and Visitor's Bureau ("CVB") Grant Program, pursuant to Chapter 380 of the Texas Local Government Code, for the reinvestment of certain hotel occupancy tax revenues back to hotels located in the City. Councilmember Perez made the motion, seconded by Councilmember Moore to adopt Resolution No. R2020-130. AYES: Orlando, Carbone, Little, Hernandez, Moore, Perez, and Owens. NAYS: None. Consideration and Possible Action - Resolution No. R2020-129 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the power of eminent domain to acquire fee simple title to certain property for the SH 288 Northbound Frontage Road Project; being a 0.1969-acre (8,576 square foot) parcel of land out of the H. T. & B.R.R. Co, Survey, Abstract Number 300, Brazoria County, Texas, and being out of the residue of a called 10.454-acre tract dated January 17, 2008, recorded under Brazoria County Clerk's File No. 2008002917, of the Official Public Records of Brazoria County, Texas, for the construction and maintenance of road and drainage improvements on certain real property described herein; authorizing the city attorney, or his designee, and other city officials to take such actions as are necessary to acquire said property, located within the city, by donation, purchase, or by the exercise of the power of eminent domain. Consideration and Possible Action - Resolution No. R2020-105 - A Resolution of the City Council of the City of Pearland, Texas, awarding a design build contract for the Supervisory Control and Data Acquisition (SCADA) Project (Phase I Services), to CDM Smith, in the amount of$319,750.00. Councilmember Carbone made the motion, seconded by Councilmember Moore to adopt Resolution No. R2020-105. AYES: Orlando, Carbone, Little, Hernandez, Moore, Perez, and Owens. NAYS: None. The motion carried. Resolution No. R2020-105 is adopted. Consideration and Possible Action - First Reading of Ordinance No. 1543-1-An Ordinance of the City of Pearland, Texas, amending Article II, "Right-of-Way Management," of Chapter 26, "Rights-of-way," of the City Code of Ordinances; amending the associated Design Manual in accordance with Chapter 284 of the Texas Local Government Code; and updating the Interactive Right-of-Way Management Map; providing a savings clause; making other provisions related to the subject; and declaring an emergency. Consideration and Possible Action - Resolution No. R2020-133 - A Resolution of the City Council of the City of Pearland, Texas, awarding a competitive sealed proposal for Phase IV of the SH 288 Corridor Master Improvement Plan Project, to Millis Development and Construction, LLC., in the amount of$14,192,050.84. Councilmember Hernandez made the motion, seconded by Councilmember Moore to adopt Resolution No. R2020-133. Councilmember Perez made the motion, seconded by Councilmember Carbone to postpone this item to the July 27, 2020 City Council meeting. AYES: Orlando, Carbone, Little, Hernandez, Moore, and Perez.
