IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. Mayor Reid called the meeting to order 6:30 p.m. with the following present: Mayor Tom Reid P&Z Commissioner Daniel Tunstall Mayor Pro -Tem J. JOINT SPECIAL MEETING NO. 1 A request by Bingji Liu, applicant, on behalf of Pearland Town Center LP, owner, for approval of a Conditional Use Permit (CUP) to allow a massage establishment in a leased space within the Pearland Town Center Planned Development, to wit: Legal Description: Lot 23, Bock 1 of the Pearland Town Center, a subdivision in the City of Pearland, Brazoria County, Texas, as recorded in the County Clerk's File No. 2007008914 in the Official Public Records of Brazoria County, Texas. General Location: 11200 Broadway Suite 370, Pearland, TX. APPLICATION INFORMATION AND CASE SUMMARY STAFF REPORT: Florence Buaku, City Planner II, gave a brief overview of the Conditional Use Permit to allow a massage establishment. APPLICANT PRESENTATION: Translator Fred Chu, 14134 Sandfield Drive, Houston, Texas for Applicant Bingji Liu, provided a brief presentation of the proposed Conditional Use Permit and was available to answer any questions. Citizen Comments: There were none. CITY COUNCIL: Council discussion regarding the City's enforcement mechanism to ensure code compliance. STAFF WRAP UP: None CITY COUNCIL NEW BUSINESS Consideration and Possible Action - Resolution- R2019- CUP19-00028 - A Resolution of the City Council of the City of Pearland, Texas, approving a Conditional Use Permit (CUP) to allow a massage establishment in the Pearland Town Center Planned Unit Development district. Being all of Lot 23, Bock 1 of the Pearland Town Center, a subdivision in the City of Pearland, Brazoria County, Texas, as recorded in the County Clerk's File No. 2007008914 in the Official Public Records of Brazoria County, Texas. (11200 Broadway Suite 370, Pearland, TX). Conditional Use Permit Application No CUP19-00028, within the Pearland Town Center Planned Unit Development (PUD) district., at the request of Bingji Liu, applicant, on behalf of Pearland Town Center LP, owner, containing a savings clause, a severability clause, and an effective date and other provisions related to the subject. Councilmember Hernandez made a motion, seconded by Councilmember Moore, to approve Resolution No. R2019-CUP19-00028. Councilmember Hernandez made a motion, seconded by Councilmember Moore, to amend the motion to add an additional condition that all doors must be able to be opened from the interior of the room at all times. Mayor Reid called for the vote on the amended motion. AYES: Orlando, Carbone, Little, Hernandez, Moore, Perez, Owens. NAYS: None. The Motion Carried.
