Mayor Tom Reid opened a series of public hearings at 7:43 p.m.

PURPOSE OF HEARING
ZONE CHANGE APPLICATION NUMBER ZONE 19-00027
A request by Duane Bingham, applicant, on behalf of Presidio Equities, LLC., owner, for
amendments to the Rice Drier Commerce Park Planned Development (PD) to allow a Farm
Supply Store and Outdoor Storage within the PD, on approximately 22.86 acres of land; to
wit:
Legal Description: Being all of Lots 1,2, 3 and a Detention Reserve of the Rice Drier
Commerce Park Addition, an addition in the City of Pearland, Brazoria County as described
in the Final Plat recorded in County Clerk's File No. 2019027535 in the Plat Records of
Brazoria County, Texas.
General Location: West of Main Street, between Halik Road and Orange Street, Pearland,
Texas.
APPLICATION INFORMATION AND CASE SUMMARY
Planner Bireima presented the staff report with exhibits and informed that zero calls or
comment forms were received for this request. Staff did recommend approval for the
request with the following condition to be considered should the City Council choose to
approve the proposed Plan Development Amendments:

1. All outdoor storage shall be confined inside the designated area and to be screened
by the proposed screening wall as depicted in the attached Exhibits.
2. The proposed building shall be developed in substantial conformance to the attached
exterior elevations as provided by the Applicant.

Applicant Matt Blaunt, 15110 N. Dallas Parkway #370, Dallas TX, gave a brief presentation.

support of the Tractor Supply.
COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION
Councilmember Perez supported the request. Councilmember Owens asked how many
other locations were in Texas, Developer Dwayne Bingham, 806 Ave. U, Marble Falls TX
78654, informed he did not know the exact count of stores.
Commissioner Tunstall asked if there would be any sale of livestock, Mr. Bingham informed
there would be chick days, but no other animals would be sold.
PURPOSE OF HEARING
Commissioner Tunstall read into the record the purpose of the Hearing
ZONE CHANGE APPLICATION NUMBER ZONE 19-00029
A request by Alan Mueller, applicant, on behalf of DMP Acquisition Fund, LLC., owner, for
approval of a zone change from Single Family Residential -4 District (R-4) to Light Industrial
District (M-1), on approximately 3.08 acres of land; to wit:
Legal Description: Being a 3.08 -acre tract of land situated in the George C. Smith Survey,
Abstract Number 551 and being a portion of a called 8.430 -acre tract of land conveyed to
DMP Acquisition Fund, LLC by the Deed recorded under the Brazoria County Clerk's File
Number (B.C.C.F. No.) 2017023566 of the Official Public Records of Real Property of
Brazoria County, Texas
General Location: East of 4155 S. Main Street, Pearland, Texas.
APPLICATION INFORMATION AND CASE SUMMARY
City Planner Buaku presented the staff report with exhibits and informed that zero calls or
comment forms were received for the request and staff had evaluated the request based
on the criteria above and recommended approval of the proposed zone change for the
following reasons:

1. 1.The proposed M-1 zoning is supported by the underlying Light Industrial land use
classification of the subject property on the future land use map.
2. 2.The proposed zone change implements the policies of the underlying land use
designation of Light Industrial
3. 3.The proposed M-1 zoning is not isolated. The subject property abuts existing M-1
zoned property to the west and to the south and will create a contiguous zoning
district with adjacent properties.
Applicant Alan Mueller, 4201 Broadway, Pearland TX 77581 gave a brief presentation and
was available for comments and questions.

Commissioner Tunstall read into the record the purpose of the Hearing
ZONE CHANGE APPLICATION NUMBER ZONE 19-00028
A request by Jon Arledge, applicant, on behalf of V & B Cornerstone LLC, owner, for
approval of a zoning change from Single-family Residential -3 (R-3) District to General
Commercial (GC) District, on approximately 0.63 acres of land; to wit:
Legal Description: Being a tract of land containing 0.63 acres, more or less, out of Lots 3
and 4, L.W. Murdock Subdivision, A C. H. & B Survey, Abstract No. 507, Brazoria County,
Texas, according to the map thereof in Volume 29, Page 174 of the Deed Records of
Brazoria County, Texas.
General Location: 3429 Main Street, Pearland, Texas.
APPLICATION INFORMATION AND CASE SUMMARY
City Planner Bireima presented the Staff Report with exhibits and stated that zero calls or
comment forms were received for this request. Staff gave an overview of the factors used
to evaluating the proposed rezoning:
1. 1.The proposed GC zoning is consistent with the underlying Business Commercial
classification of the subject property on the Future Land Use Map.
2. The proposed retail development is appropriate in the immediate area of the land to
be reclassified.
3. The proposed zone classification is consistent with the existing or proposed plans
for public utilities to the area.
4. The proposed zone change will not adversely affect the public health, safety,
morals, or general welfare

5.Any potential negative visual impact created by the proposed GC zoning can be
mitigated by UDC regulations for non-residential development across from residential use,
and development within the Corridor Overlay District. Based on the factors above, staff
recommends approval of the request.

(PD), including zero -foot side setbacks, on approximately 52.48 acres of land; to wit:
Legal Description: Being Lots A, B, C, D and Reserve A, Block 1 of the Center at Pearland
Parkway Addition, an addition in the City of Pearland, Brazoria County as described in the
Amending Plat recorded in County Clerk's File No. 2014046177 in the Plat Records of

Parkway Phase II Addition, an addition in the City of Pearland, Brazoria County as

APPLICATION INFORMATION AND CASE SUMMARY
City Planner Bireima presented the staff report with exhibits and informed that zero calls or
comment forms were received for this request and The Development Review Committee
(DRC) has reviewed the proposed amendments and the Committee had no objections. The
elimination of the interior side setbacks will be confined to this existing pad site only and
does not affect the other established setbacks within the Planned Development. The
proposed changes don't affect the existing fire lanes or circulation within the shopping
center. Cross -access is already being provided through the existing lots by the recorded
plats. The proposed amendments are consistent with the Future Land Use Plan and the

vision of the Planned Development and meet the criteria of approval above; therefore, staff
recommended approval of the proposed Plan Development amendments.
