2019-12-09 CITY COUNCIL REGULAR MEETING MINUTES1 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON MONDAY, DECEMBER 9, 2019 AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. CITIZEN COMMENTS: Lisa Lake, 2009 Westminster, Pearland, addressed Council stating her concerns regarding Animal Services and State Law requirements for euthanizing animals. Carol Artz-Bucek, President of the Chamber of Commerce, 6117 Broadway, Pearland, wished all a Happy Holiday Season and invited everyone to the Chamber's Annual Christmas Open House. PUBLIC HEARING: 2nd Public Hearing - Voluntary Annexation - Approximately 18 acres of land, generally located east of County Road 48 (Kingsley Drive), north of County Road 59 (Magnolia Parkway), and just south of Floral Park Lane in Southern Trails Subdivision. Pearland Regular Meeting Agenda December 9, 2019 STAFF REVIEW Joel Hardy Grants/Special Projects Administrator provided an overview of the second Public Hearing for a Voluntary Annexation. CITIZEN COMMENTS: None COUNCIL/STAFF DISCUSSION Discussion ensued between Councilmember Perez and Assistant City Manager Trent Epperson regarding utility services in the area and requirements for extension of water and sewer. Discussion ensued between Councilmember Moore and City Manager Pearson regarding Police and Fire dispatch coverage. ADJOURNED at 6:49 p.m. CONSENT AGENDA: A. Consideration and Possible Action — Second and Final Reading of Ordinance No. 1586 - An Ordinance of the City Council of the City of Pearland, Texas, prescribing the type of notice to be given of the time and place of the January 6, 2020 joint public hearing of the City Council and the Planning and Zoning Commission for amendments to the Southern Trails and Stonebridge Planned Developments. B. Consideration and Possible Action — Second and Final Reading of Ordinance No. 1585 - An Ordinance of the City Council of the City of Pearland, Texas, amending the Project Plan and Reinvestment Zone Financing Plan for Reinvestment Zone Number Two (Amendment No. 5), City of Pearland, Texas to facilitate the construction of City facilities and infrastructure improvements ("Improvements"); authorizing the City Secretary to distribute such plans; containing findings and provisions related to the foregoing subjects; and providing for severability. C. Consideration and Possible Action - Resolution No. R2019-305 - A Resolution of the City Council of the City of Pearland, Texas, renewing and amending a unit supply contract for fire apparatus & preventative maintenance and repairs with Siddons-Martin Emergency Group, in the estimated amount of $300,000.00, for the period beginning December 18, 2019 and ending December 17, 2020. D. Consideration and Possible Action - Resolution No. R2019-303 - A Resolution of The City Council of the City of Pearland, Texas, approving an amended application submitted by CenterPoint Energy Resources Corp. d/b/a CenterPoint Energy Entex ("CenterPoint"), on or about October 11, 2019, for authority to issue a refund to customers; directing CenterPoint to issue a refund; directing CenterPoint to reimburse the City's rate case expenses; finding that the meeting complies with the Open Meetings Act; and making other findings and provisions related to the subject. Consideration and Possible Action - Resolution No. R2019-302 - A Resolution of The City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to participate in an interlocal cooperative pricing arrangement with the Texas BuyBoard for heavy equipment services (repair, rental and parts) with Associated Supply Company Inc. (ASCO), in the estimated amount of $160,000.00., for the period of December 20, 2019 through December 19, 2020. F. Consideration and Possible Action - Resolution No. R2019-300 - A Resolution of The City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to participate in an interlocal cooperative pricing arrangement with the Houston -Galveston Area Council (HGAC) for the purchase of Fire Department Radio Equipment, from Motorola Solutions, Inc., in the estimated amount of $72,395.71. G. Consideration and Possible Action - Resolution No. R2019-301 - A Resolution of the City Council of the City of Pearland, Texas renewing a unit supply contract for the supply of traffic signs and related materials with Municipal Signs, Inc., in the estimated amount of $112,500.00, for the period of December 17, 2019 through December 16, 2020. H. Consideration and Possible Action - Resolution No. R2019-304 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to enter into an Interlocal Agreement with the City of League City for Pearland's contribution of $25,000.00 toward League City's Flood Mitigation Study for Lower Clear Creek. Councilmember Orlando made the motion, seconded by Councilmember Moore, to adopt Consent Agenda Items A through H with exception of Items B, F, G, and H, as presented on the Consent Agenda. AYES: Orlando, Carbone, Little, Hernandez, Moore, Perez, Owens. NAYS: None The motion carried. MATTERS REMOVED FROM CONSENT AGENDA: B. NEW BUSINESS: Consideration and Possible Action - First Reading of Ordinance 2000M-194 - An Ordinance of the City Council of the City of Pearland, Texas, amending Ordinance No. 2000M, the zoning map of the City of Pearland, Texas, for the purpose of changing the classification of certain property, Tract Being all of Lots 1-A & 1-13, Block 1 of the Fite at F.M. 1128 Addition, a subdivision in the City of Pearland, Pearland Regular Meeting Agenda December 9, 2019 Brazoria County, Texas, according to the plat recorded in File No. 2008035185 of the Official Public Records of Brazoria County, Texas.(2832 Manvel Road & 7221 Fite Road). Zone Change Application No. ZONE 19-00020, a request by Jennifer Pollak Evans, applicant, on behalf of Signature Companies, owner; for approval of a zoning change from General Business District (GB) to General Commercial District (GC), on approximately 6.1479 acres of land; providing for an amendment of the zoning district map; containing a savings clause, a severability clause, and an effective date and other provisions related to the subject. Councilmember Little made the motion, seconded by Councilmember Moore, to approve the first reading of Ordinance No. 2000M-194. AYES: Orlando, Carbone, Little, Hernandez, Moore, Perez, Owens. NAYS: None. The motion carried. 2. Consideration and Possible Action First Reading of Ordinance No. 1584-1 - An Ordinance of the City Council of the City of Pearland, Texas, amending Ordinance No. 1584, the 2019-2020 Annual Budget Ordinance, by; authorizing the City Manager or his designee to take all actions necessary to facilitate the changes identified herein without further approval of City Council; providing a savings clause, a severability clause, a repealer clause, and an effective date. Mayor Pro -Tem Little made the motion, seconded by Councilmember Carbone, to approve the first reading of Ordinance No. 1584-1. AYES: Orlando, Carbone, Little, Moore, Perez, Owens. NAYS: None. The motion carried. Councilmember Hernandez left the chamber. 3. Consideration and Possible Action - Resolution No. R2019-295 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to enter into three (3) Letter Finance Agreements with Reinvestment Zone No. 2, City of Pearland, Texas, associated with Fire Station No. 8, the Shadow Creek Library and the Shadow Creek Nature Trail Connection. Councilmember Moore made the motion, seconded by Councilmember Perez, to approve Resolution No. R2019-295. AYES: Orlando, Moore, Carbone, Little, Perez, Owens. NAYS: None. The motion carried. Resolution No. R2019-295 is adopted. 4. Consideration and Possible Action - Resolution No. R2019-283 - A Resolution of the City Council of the City of Pearland, Texas, amending a contract with PGAL, for architectural design services associated with the Shadow Creek Library Project, in the additional amount of $310,044.00 (total contract amount of $1,654,514.00). Councilmember Hernandez made the motion, seconded by Councilmember Moore, to approve Resolution No. R2019-283. Consideration and Possible Action - Resolution No. R2019-293 - A Resolution of the City Council of the City of Pearland, Texas, awarding a Construction Manager at Risk to SpawGlass Corp in the amount of $36,520.00 for pre -construction services, $823,313.00 for General Conditions, and authorizing the payment of 3.00% for profit and overhead based on the Guaranteed Maximum Price which shall be subject to future City Council approval. Councilmember Perez made the motion, seconded by Councilmember Moore, to approve - Resolution No. R2019-293. AYES: Orlando, Carbone, Little, Hernandez, Moore, Perez and Owens. NAYS: None. The motion carried. Resolution No. R2019-293 is adopted. 6. Consideration and Possible Action - Resolution No. R2019-296 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to enter into an Annexation Development Agreement with Dr. Venugopal Menon, for the provision of sanitary sewer service to property located in the City's Extraterritorial Jurisdiction ("ETJ") (6962 Aimee Lane). Councilmember Perez stated for the record, he has not received any money or is under any contract for this project; however, he did previously advise the applicants before they were negotiating with the City. Councilmember Perez recused himself from this discussion. Councilmember Owens made the motion, seconded by Councilmember Moore, to approve Resolution No. R2019-296. AYES: Owens, Orlando, Carbone, Little, Hernandez, Moore. NAYS: None. The motion carried. Resolution No. R2019-296 is adopted. 7. Consideration and Possible Action First Reading of Ordinance No. 1587- An Ordinance of the city council of the City of Pearland, Texas, repealing Chapter 29, TRAFFIC, of the City of Pearland Code of Ordinances in its entirety and adopting a new Chapter 29, TRAFFIC; having a savings clause, a severability clause, and a repealer clause; and providing for codification -and an effective date. Councilmember Orlando made the motion, seconded by Councilmember Moore, to approve the first reading of Ordinance No. 1587. AYES: Orlando, Carbone, Little, Hernandez, Moore, Perez, Owens. NAYS: None. The motion carried. 8. Consideration and Possible Action - Resolution No. R2019-297 - A Resolution and Order of the City Council of the City of Pearland, Texas, casting votes for candidates for the Brazoria County Appraisal District Board of Directors for the 2020-2021 term. AYES: Carbone, Little, Hernandez, Moore, Perez, Owens, Orlando. NAYS: None. The motion carried. Resolution No. R2019-297 is adopted casting votes for George Sanders. 9. Consideration and Possible Action - Resolution No. R2019-298 - A Resolution and Order of the City Council of the City of Pearland, Texas, casting votes for candidates for the Fort Bend County Appraisal District Board of Directors for the 2020-2021 term. Councilmember Carbone made a motion, seconded by Councilmember Moore, to approve Resolution No. 2019-298. AYES: Little, Hernandez, Moore, Perez, Owens, Orlando, Carbone. NAYS: None. The motion carried. Resolution No. 2019-298 is adopted casting all votes for Michael D. Rozell. 10. Consideration and Possible Action - Resolution No. R2019-299 - A Resolution and Order of the City Council of the City of Pearland, Texas, casting votes for candidates for the Harris County Appraisal District Board of Directors for the 2020- 2021 term. Councilmember Carbone made a motion, seconded by Councilmember Moore, to approve Resolution No. 2019-299. AYES: Hernandez, Moore, Perez, Owens, Orlando, Carbone, Little. NAYS: None. The motion carried. Resolution No. R2019-299 is adopted casting all votes for Mike Sullivan.
