Mayor Reid called the meeting to order 6:30 p.m. with the following present:

A request by Jim McSherry, representing GPD Group, applicant, on behalf of Pasadena
Independent School District, owner, for approval of a Conditional Use Permit (CUP) to allow an
Intermediate School on 26 acres of land located within the Single-family Residential -1 District (R-
1).
Legal Description: Atract of land containing 26.006 acres, more or less, located within the Thomas
Green Survey, Abstract No. 290, in the City of Peariand, Harris County, being ail of Lots 93 and
94, and the remainder of Lots 108, 109, 110 and 111 of the Allison -Richey Gulf Coast Home
Company, Section "G", a subdivision recorded in Volume 4, Page 48, in the Harris County Maps
Records, Harris County, Texas.

APPLICATION INFORMATION AND CASE SUMMARY
STAFF REPORT:
Planner Mohamed Biremia reported on the requested Conditional Use Permit (CUP) to allow an
Intermediate School on 26 acres of land located within the Single-family Residential -1 District (R-
1).
APPLICANT PRESENTATION:

Applicant Jim McSherry addressed Council regarding the proposed Conditional Use Permit and
the intent to comply with the conditions for the site plan the City has set forth.
PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST:
David Smith, 2314 Champion Drive, addressed Council and spoke in regards to his concerns of
the proposed Conditional Use Permit (CUP)for an Intermediate School.
Elizabeth Drake, 2216 Kingston Canyon Trail, addressed Council and spoke in opposition of the
approval of the proposed CUP due to line of sight issues.
Elizabeth Alexander— Machalicek, 2401 Huisache Court, addressed Council and spoke in place
of her parents who provided a letter with their concerns.
Lance Botkin, 3701 Pine Forest Place, addressed Council on behalf of his parents and stated
their concerns.
Charles Coe, 2316 Champion Drive, addressed Council and stated his opposition of the proposed
Conditional Use Permit based on his concern for drainage.
Torn Huddleston, 2604 Antrim Street, addressed Council and spoke in opposition of the proposed
CUP due to the look it will have for the neighborhood.
Cristina Scott, 2909 Green Tee Dr, addressed Council and spoke in opposition of the Proposed
CUP due to the perceived effect on traffic.
PLANNING COMMISSION/COUNCILISTAFF DISCUSSION
Conversation ensued between Commissioner Starr and Applicant Jim McSherry regarding the
two detention ponds on the site plan, their location and safety measures to keep people out of
those areas.
Commissioner Wicker stated his concern was traffic circulation in the proposed area for the
Conditional Use Permit but that is addressed in the site plan.
Commissioner Cade stated her concern is the Emergency gates on the proposed plan due to the
amount of time it would take Emergency Personnel to get through.
Commissioner Tunstall stated he is concerned for the amount of traffic it will create in the
neighborhood.
CITY COUNCIL:
Councilmember Hernandez stated his concerns are the same as the ones already presented,
including the amount of traffic the school would cause.
Pasadena Independent School District Project Manager Shauna Gagnon stated the need to build
the school, what site plan research has been done and how other issues have been addressed.
She also stated if the Permit is not approved, the act of Eminent Domain would come into effect.
Deputy City Attorney Lawrence Provins stated Pasadena Independent School District can
exercise Eminent Domain and tonight the City has to set up conditions for the placement of the
proposed school.

Councilmember Reed stated Pasadena Independent School District owns the land and the vote

tonight is on to work together with each entity for the placement of the school.
Conversation ensued between Councilmember Perez and Pasadena Independent School District
Project Manager Shauna Gagnon regarding lighting plans, traffic control and parking.
Councilmember Owens stated his concerns for the drainage in that area and what added
development will do for the existing problem.
Councilmember Hernandez asked if underground drainage is an option on this site plan.
Pasadena Independent School District Project Manager Shauna Gagnon stated that can be
considered in the meeting with the City's Engineers.
Director of Engineering and Capital Projects Robert Upton stated staff will continue to comply with
the City guidelines for development. He further stated underground detention is still not widely
used and regulations for that are not established.
STAFF WRAP UP:
Planning Manager Martin Griggs spoke about misconceptions regarding this project and corrected
any misunderstandings.

CITY COUNCIL NEW BUSINESS
Council Action - Resolution No. R2019 - CUP19-00009 - A Resolution of the City Council of
the City of Pearland, Texas, approving a Conditional Use Permit (CUP) to allow an Intermediate
School located within the Single-family Residential-1 District(R-1), being a tract of land containing
26.006 acres, more or less, located within the Thomas Green Survey, Abstract No. 290, in the
City of Pearland, Harris County, being all of Lots 93 and 94, and the remainder of Lots 108, 109,
110 and 111 of the Allison-Richey Gulf Coast Home Company, Section "G", a subdivision
recorded in Volume 4, Page 48, in the Harris County Maps Records, Harris County, Texas.
(Located at 2100 Block of Highland Meadows Drive, Pearland, TX). Conditional Use Permit
Application No CUP19-00009, within the Single-family Residential-1 District (R-1), at the request
of Jim McSherry, representing GPD Group, applicant, on behalf of Pasadena Independent School
District, owner, containing a savings clause, a severability clause, and an effective date and other
provisions related to the subject.
Mayor Pro-Tern Little made the motion, seconded by Councilmember Moore to approve
Resolution No. R2019—CUP19-00009.
Councilmember Perez made the motion, seconded by Councilmember Moore to amend the
motion to exclude the use of field lighting, no more than 1 foot candle light intensity at the property
line, provisions for special event parking, no pedestrian access to Green Tee Subdivision and to
add additional queuing.
Mayor Reid called for the vote on the amended motion.
Voting "Aye' Councilmember Orlando, Reed, Little, Hernandez, Moore, Perez and Owens.
Voting "No" None.
Motion passed 7 to 0.

Councilmember Reed made the motion, seconded by Councilmember Orlando to postpone
approval of the Conditional Use Permit until Pasadena Independent School District meets with
residents.

Mayor Reid called for the vote on the motion to postpone.
Voting "Aye" Councilmember Orlando, Reed, Little, Hernandez, Moore, Perez and Owens.
Voting "No" None.
Motion passed 7 to 0.

Code (UDC) No. (T-30) - A request of the City of Pearland, for a proposed amendments to
the Unified Development Code
PURPOSE OF HEARING
Amendments to the Unified Development Code (UDC) No. (T-30) - A request of the City of
Pearland, for a proposed amendments to the Unified Development Code regarding the
following sections:
1. Reformatting the land uses table, definitions and off-street parking requirements of
the Land Use Matrix (Section 2.5.2.1).
2. New regulations for patio cover setbacks within the rear yards of residential lots
(Section 2.6.1.1(f), Area & Building Regulations).
3. Removal of the parking lot prohibition within the front yard of the Old Townsite District
(Section 2.4.3.4 OT, Old Townsite District)
4. New regulations for L.E.D lighting on signage and storefronts (Section 2.4.5.1
Corridors Overlay District; Section 2.6.2.1 Applicability & Requirements; and Section
4.2.5.1 General Standards & Requirements).
5. Removal of dumpster screening and sidewalk requirements upon expansion of
parking pavement and separation of landscape requirements for street trees and
parking lot trees based on type of expansion (Section 4.1.3.2 Improvements &
Related Triggers).

COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION
Councilmembers Perez and Hernandez were happy with the proposed amendments and
were in support. Councilmember Little asked for clarification on the landscape
requirements for parking on the pavement, Planning Manager Mr. Griggs explained the
changes.
P&Z Chairperson Tunstall questioned if the language for the LED amendment was strong
enough, Mr. Griggs informed he would look into the language further.
