2019-03-18 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTESMINUTES OF THE JOINT PUBLIC HEARING FOR THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION, CITY OF PEARLAND, TEXAS, HELD ON MONDAY MARCH 18, 2019 AT 6:30 P.M., COUNCIL CHAMBERS, PEARLAND CITY HALL, 3519 LIBERTY DR. CALL TO ORDER Mayor Tom Reid opened a series of public hearings at 6:30 p.m. The following were present: Council Member Tony Carbone Council Member Gary Moore Council Member David Little Council Member Trent Perez Council Member Adrian Hernandez P&Z Chairperson Daniel Tunstall P&Z Vice -Chairperson Thomas Duncan P&Z Commissioner Derrell Isenberg P&Z Commissioner Mary Starr P&Z Commissioner Layni Cade P&Z Commissioner Ronald Wicker Also present were Community Development Director John McDonald, Planning Manager Martin Griggs, Planner Vince Hustead, Planner Mohamed Bireima, Associate Director of Engineering, Raj Shrestha, Assistant Director of Traffic Ryan McKinnis, and Office Assistant Alma Gonzales Mayor Tom Reid opened the public hearing at 6:30 p.m. Planning Manager Martin Griggs presented the order of agenda and format of the meeting. Mr. Griggs informed that Zone Change Application No. Zone 19-00001 was pulled from this agenda by the applicant to be re -scheduled at a later date. P&Z Chairperson Daniel Tunstall read into the record Zone Change Application No. Zone 19-00003 PURPOSE OF HEARING Zone Change Application No. Zone 19-00003 A request by Presidio Equities, LLC, applicant and owner, for approval of an amendment to the Rice Drier Commerce Park Planned Development District regulations regarding the minimum building size, on approximately 22.86 acres of land, to wit: Legal Description: Being a 22.86 acre tract of land out of a portion of Lots 28, 33, and 39 of W. Zychlinski's Subdivision, recorded in Volume 29, Page 41, of the Brazoria County Deed Records, located in the H.T. & B. R.R. Co. Survey, Abstracts 232 and 542, Brazoria County, Texas. Councilmember Woody Owens asked staff if this change would affect all the buildings on the property or just the one building. Planning Manager Martin Griggs confirmed it would only be the one building. Marty C. the architect for the applicant explained they would be using low cut off lightening with zero light poles in the back. Councilmember Derrick Reed made a comment that the request would be a great addition to the area. No other comments from Council. JOINT SPECIAL MEETING NO. 1 Conditional Use Permit Application No. CUP 19-00002 A request of Raymond Zhuo, applicant, on behalf of Houston Chinese Church; owner, for approval of a Conditional Use Permit (CUP) to allow for a Church campus to be located in Single— Family Residential -1 (R-1) zoning district; on approximately 5 acres of land. Legal Description: Lot A of the Houston Chinese Church Pearland Campus, an addition in the City of Pearland according to the plat recorded in File No. 2015050394 in the Official Records of Brazoria County, Texas. General Location: 2515 Miller Ranch Road, Pearland, TX. APPLICATION INFORMATION AND CASE SUMMARY STAFF REPORT: Planner Mohamed Bireima reported on the Conditional Use Permit (CUP) to allow for a Church campus to be located in Single—Family Residential -1 (R-1) zoning district; on approximately 5 acres of land. Page 1 of 3 APPLICANT PRESENTATION: Applicant Raymond Zhuo addressed Council and stated the Church has been approved for a Conditional Use Permit (CUP) prior and after completing the improvements the City requested the Permit has to be reapplied for. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST: None. PLANNING COMMISSION/COUNCIL/STAFF DISCUSSION PLANNING AND ZONING COMMISSION: None CITY COUNCIL: Councilmember Carbone stated since there was no opposition the prior time and approval was given, he will be in support of the Conditional Use Permit. Mayor Pro -Tem Perez asked staff if the conditions on this CUP are the same as in the previous requests. Planning Manager Martin Griggs stated there are no changes to the previous request with the exception of the site plan change presented. Councilmember Owens stated he has been in support of the Church since the beginning and remains in support. STAFF WRAP UP: None. CITY COUNCIL NEW BUSINESS Council Action - Resolution No. R2019-CUP19-00002 -A Resolution of the City Council of the City of Pearland, Texas, approving a Conditional Use Permit (CUP) to allow for a Church, Temple, or Place of Worship in the Single -Family Residential -1 (R-1) zoning district, Lot A of the Houston Chinese Church Pearland Campus, an addition in the City of Pearland according to the plat recorded in File No. 2015050394 in the Official Records of Brazoria County, Texas. (Located at 2515 Miller Ranch Road, Pearland, TX.) Conditional Use Permit Application No CUP 19-00002, within the Single -Family Residneital-1 (R-1) zoning district, at the request of Raymond Zhuo, applicant, on behalf of Houston Chinese Church, owner, containing a savings clause, a severability clause, and an effective date and other provisions related to the subject. Councilmember Hernandez made the motion, seconded by Councilmember Moore to approve Resolution No. R2019-CUP19-00002.
