2017-07-06 CITY COUNCIL SPECIAL MEETING MINUTESMINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF ' PEARLAND, TEXAS, HELD ON MONDAY, JULY 6, 2017, AT 11:30 A.M. IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. Mayor Reid called the meeting to order at 11:36 a.m. with the following present: Mayor Mayor Pro -Tem Councilmember Councilmember Councilmember Councilmember Councilmember City Manager City Attorney City Secretary Tom Reid Derrick Reed Tony Carbone Keith Ordeneaux J. Others in attendance: Jon Branson Deputy City Manager; Trent Epperson Assistant City Manager. New Business: ' Council adjourned into Executive Session under Texas Government Code at 11:36 a.m. to discuss the following. Executive Session under Texas Government Code 1. Section 551.071 — Consultation with City Attorney — Regarding potential litigation associated with third party violations of state and federal environmental laws that negatively impact the public safety, health and welfare of the City. New Business Continued: Council returned from Executive Session at 12:34 p.m. Council Action — Resolution No. 112017-135 —A Resolution of the City Council of the City Of Pearland, Texas, authorizing the City of Pearland to exercise its enforcement power authorized by Subchapter H of the Texas Water Code; authorizing the City Manager or his designee to execute any documents necessary to implement this resolution; and declaring an effective date. ' Councilmember Carbone made the motion, seconded by Mayor Pro -Tem Reed to approve the Resolution No. R2017-135. Page 1 of 3 — 07/06/2017 Voting "Aye" Councilmembers Carbone, Reed, Ordeneaux, Little, Perez, and Owens. Voting "No" None. ' Motion Passed 6 to 0, with Councilmember Moore absent. Council Action Direction to the City Attorney — Regarding potential litigation associated with third party violations of state and federal environmental laws that negatively impact the public safety, health and welfare of the City. Mayor Pro -Tem Reed made the motion, seconded by Councilmember Ordeneaux to authorize the City Attorney and Special Counsel, Baker-Wotring, LLP. and Scott, Ray & Sullivan, PLLC., to file a lawsuit against Blue Ridge Landfill, TX, LP, a Delaware limited partnership, Allied Waste Landfill Holdings, Inc., Allied Waste North America, Inc., Republic Waste, Inc. and their corporate affiliates, parents, and subsidiaries, to address environmental concerns that are affecting the health and welfare of its citizens. Voting "Aye' Councilmembers Reed, Ordeneaux, Little, Perez, Owens, and Carbone. Voting "No" None. Motion Passed 6 to 0, with Councilmember Moore absent. Council Action — Resolution No. R2017-136 —A Resolution of the City Council of the City ' of Pearland, Texas, making the written findings required by Texas Government Code Section 103 (d); granting authority to the City Manager to execute an attorney contract. Councilmember Ordeneaux made the motion, seconded by Councilmember Perez to approve Resolution No. R2017-136. Voting "Aye' Councilmembers Ordeneaux, Little, Perez, Owens, Carbone, and Reed. Voting "No" None. Motion Passed 6 to 0, with Councilmember Moore absent. Council Action — Resolution No. R2017-137 —A Resolution of the City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to enter into a legal services contract with Scott, Ray & Sullivan, PLLC and Baker Wotring, LLP. Councilmember Little made the motion, seconded by Councilmember Perez to approve Resolution No. R2017-137.
