classification of certain property, 30,403 square feet of land, located in

D. Consideration and Possible Action - Resolution No. R2017-132 - A
Resolution of the City Council of the City of Pearland, Texas, awarding
a bid to WatchGuard for the purchase of fifty (50) additional Vista Body
Cameras in the estimated amount of $87,515.00.
E. Consideration and Possible Action - Resolution No. R2017-131 - A
Resolution of the City Council of the City of Pearland, Texas, renewing
a contract with the University of Texas Health Science Center at
Houston for the services of Richard Bradley, M.D. to be the EMS Medical
Director, in the estimated amount of $58,547.00 for the period of August
1, 2017 to July 31, 2018.
F. Consideration and Possible Action - Resolution No. R2017-129 - A
Resolution of the City Council of the City of Pearland, Texas, renewing
a unit supply bid for the purchase of Fire Department medical supplies
to Bound Tree Medical, LLC., in the estimated amount of $65,000 for the
period of July 11, 2017 through July 10, 2018.
G. Consideration and Possible Action - Resolution No. R2017-130 - A '

a unit price service contract for HVAC/Refrigeration repair and
maintenance services for the Recreation Center and Natatorium to the
Lee Thompson Company, in the estimated annual expenditure amount
of $120,000.00, from July 11, 2017 through July 10, 2018.
Consideration and Possible Action - Resolution No. R2017-95 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to enter into Letter Financing
Agreements with the Lower Kirby Pearland Management District
and a Reimbursement Agreement with the Pearland Economic
Development Corporation associated with Lower Kirby Park
Improvements. and the SH 288 Waterline projects.
J. Consideration and Possible Action - Resolution No. R2017-103 - A
Resolution of the City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to enter into a Development
' Agreement with America Modern Green Development (Houston) for
the construction of on-site public infrastructure and amenities associated
with the Ivy District Planned Development (generally located at the
intersection of South Spectrum Boulevard and SH 288 frontage road).
K. Consideration and Possible Action - Resolution No. R2017-138 - A
Resolution of the City Council of the City of Pearland, Texas, approving
a change order with Texas Sterling Construction Company in the
amount of $134,304.57 associated with the Bailey Road Reconstruction
Project (Veterans Drive to FM 1128).
Councilmember Carbone asked that Consent Agenda Item D be removed from the
Consent Agenda for further discussion.
Councilmember Perez asked that Consent Agenda Items H and K be removed from the
Consent Agenda for further discussion.
Councilmember Carbone made the motion, seconded by Councilmember Moore, to adopt
Consent Agenda Items A through K with the exception of Items D, H and K as presented
on the Consent Agenda.

D. Consideration and Possible Action - Resolution No. R2017-132 - A
Resolution of the City Council of the City of Pearland, Texas, awarding
a bid to WatchGuard for the purchase of filly, (50) additional Vista Body
Cameras in the estimated amount of $87,515.00.
Councilmember Carbone made the motion, seconded by Councilmember Moore to
approve Resolution No. R2017-132.
City Manager Clay Pearson reported in 2016, the Police Department purchased body
cameras to be worn by officers while on duty. In the short time the equipment has been
available for use, the benefits of the technology have already been realized.
Discussion ensued between Councilmember Carbone and Police Chief Johnny Spires '
regarding the cost of the warranty, cost of the Body Cameras, and the warranty that
comes with the Body Cameras.
Councilmember Carbone made the motion, seconded by Councilmember Moore to
postpone Resolution No. R2017-132 to a future agenda.

H. Consideration and Possible Action - Resolution No. R2017-118 - A
Resolution of the City Council of the City of Pearland, Texas, renewing
a unit price service contract for HVAC/Refrigeration repair and
maintenance services for the Recreation Center and Natatorium to the '
Lee Thompson Company, in the estimated annual expenditure amount
of $120,000.00, from July 11, 2017 through July 10, 2018.

City Manager Clay Pearson reported it is necessary for the City to retain the services of
an outside contractor to perform maintenance and repairs on existing HVAC/refrigeration
systems and equipment, including periodic system replacements at the Recreation
Center and Natatorium Facility as required.
Discussion ensued between Councilmember Perez and Director of Public Works Eric
Wilson regarding separate HVAC/refrigeration maintenance contracts for the City
facilities, standardization process and a rollover cycle for existing facilities.

K. Consideration and Possible Action - Resolution No. R2017-138 - A
Resolution of the City Council of the City of Pearland, Texas, approving
a change order with Texas Sterling Construction Company in the
amount of $134,304.57 associated with the Bailey Road Reconstruction
Project (Veterans Drive to FM 1128).
Councilmember Carbone made the motion, seconded by Councilmember Moore to
approve Resolution No. R2017-138.
City Manager Clay Pearson reported this change order encompasses modifications to the
junction boxes at Veterans Drive south of Bailey and increased material costs to change
backflow preventers and hot box enclosures for the irrigation system due to conditions
and locations in the field.
Discussion ensued between Councilmember Perez and City Engineer Robert Upton
regarding manholes and junction boxes.

Second and Final Reading of Ordinance No. CUP 17-00007 — An Ordinance of the
City Council of the City of Pearland, Texas, approving a Conditional Use Permit (CUP)
to allow for an Auto Wash (Self -Service) in the Planned Development (PD) zoning
district, Being a 1.4012 acre (61,036 square feet) parcel of land situated in the T.C.R.R.
CO. Survey, Abstract 675, in Brazoria County Texas, and being all of Lot "D" of Shadow
Creek Ranch Commercial Site No. 18B, as recorded under File Number 2007035195 of
Brazoria County Public Records (B.C.P.R.). (Located at 11213 & 11233 Shadow Creek
Parkway, TX.) Conditional Use Permit Application No CUP 17-00007, within the Planned

Councilmember Moore made the motion, seconded by Mayor Pro -Tem Reed to approve
Ordinance No. CUP 17-00007 on its Second and Final Reading.
Mayor Reid read into the record the Planning & Zoning Commission's recommendation
to forward to Council to deny the Conditional Use Permit Application No CUP 17-00007. ,
City Planner Jimontanae McBride gave an overview of the requested Conditional Use
Permit (CUP) to allow for an Auto Wash.
Councilmember Moore stated his concerns regarding the congestion of traffic in that
location and putting so much on a small lot. He further stated he agrees with the Planning
& Zoning Commission and will not be in favor of this item.
Mayor Pro -Tem Reed stated he went to the location and it is no bigger than the Council
Chambers. He further stated his vote will be no.
Councilmember Perez stated he does not see that this is that bad of development. It is not
near a neighborhood or anyplace that will cause damage.
Councilmember Carbone stated when the Unified Development Code (UDC) was
amended it was because the exit blowers of auto washes were creating a nuisance to
adjacent residents. He does not have, a problem with the use on this lot. Looking at value
on the ground, and the owner/applicant has to play by the rules and if the owner/applicant
can get two buildings, two businesses, two tax payers and almost double the value, he
struggles with how you would say no on this issue.
Councilmember Moore stated after listening to Councilmembers Perez and Carbone's '
comments he still has concerns regarding the traffic.

. Discussion ensued between Mayor Pro -Tem Reed and City Planner Jimontanae McBride
regarding the landscaping issue has been complied to.
Ziad Kaakouds, 580 Westlake Park, addressed Council stating he is the Engineer for the
applicant. He stated he is present tonight for the land use, the owner/applicant wants to
follow the rules that are in place and make this work.

Alan Mueller, 4201 Broadway, addressed Council stating he is representing the applicant. '
He further stated they will comply with the conditions. He did want to highlight especially
for those on the ad hoc committee that those conditions are relevant to any Neighborhood
Services property up against any residential neighborhood, and not especially relevant to
the purpose of this use permit. Hopefully this will get changed in the future by the ad hoc
committee. He requested Council's favorable approval on this item.

City Planner Jimontanae McBride gave an overview of Zone Change Application No.
ZONE 17-00009.
Councilmember Perez stated he is going to be in favor of the zone change because it
meets the City's Comprehensive plan. He further stated the site does not work, just
because Council approves the zone change does not mean this development is allowed
to move forward. There is a lot of work that needs to be done for this to be a quality
development.

Councilmember Carbone stated he agrees with Councilmember Perez that his concern is
the site plan. He is going to rely on Staff to assist so this development is not negatively
impacted.
Councilmember Moore stated he also has concerns with the site plan and the
neighborhood next to that property. He agrees with the zone change, but there is a lot of
work to be done.

City Planner Jimontanae McBride gave an overview of approving the Conditional Use
Permit (CUP) to allow for a Liquor/Package store in the General Commercial (GC) zoning
district.
Councilmember Owens stated there are several liquor/package stores in Pearland which
is enough so he will be voting against this.

First Reading of Ordinance No 1540 — An Ordinance extending the city limits of the City
of Pearland, Texas, to include certain land area within certain limits and boundaries and
annexing to the City of Pearland the area within such limits and boundaries a 212 acre
property entitled Massey Ranch located within City of Pearland's Extraterritorial
Jurisdiction (ETJ). Massey Ranch is generally located approximately 2900 feet east of
FM1128 at the southwest comer of the intersection of McKeever (CR 100) and Harkey
Roads, approving a service plan for all of the area within such limits and boundaries;
containing other provisions related to the subject, and providing a savings and severability
clause.
Councilmember Carbone made the motion, seconded by Councilmember Moore to
approve Ordinance No. 1540 on its First Reading.

Council Action — Resolution No. R2012-168-1 — A Resolution of the City Council of the '
City of Pearland, Texas, amending R2012-168 as it applies to Section 2, Membership
Criteria for the Convention and Visitors Bureau Advisory Board.
Councilmember Moore made the motion, seconded by Councilmember Ordeneaux to
approve Resolution No. R2012-168-1.
City Manager Clay Pearson stated this is a recommendation to amend and update the
membership criteria for the Convention and Visitors Bureau Advisory Board,
Councilmember Moore stated he is glad to see this change.
Councilmember Ordeneaux stated he serves as a non-voting member on the board so he
is going to abstain from voting.
Voting "Aye" Councilmembers Moore, Little, Perez, Owens, and Carbone.
Voting "No" None.
Motion Passed 5 to 0, with Councilmember Ordeneaux abstaining and Mayor Pro -Tem
Reed absent from Council Chambers.
Council Action — Resolution No. R2017-134 — A Resolution of the City Council of the '
City of Pearland, Texas, authorizing the purchase of additional fire bunker gear from
Dooley Tackaberry, Inc. In the estimated amount of $342,823.00.
Councilmember Ordeneaux made the motion, seconded by Councilmember Moore to
approve Resolution No. R2017-134.
City Manager Clay Pearson reported a supplemental budget request was approved at the
June 26, 2017 City Council meeting allowing the Fire Department to purchase an
additional set of firefighter bunker gear for all operational personnel to facilitate the cancer
prevention manual pages and as recommended by the Citygate study.
Councilmember Moore stated he is glad the City is able to do this.
Discussion ensued between Councilmember Little and Purchasing Officer Bob Pearce
regarding the contract with Dooley Tackaberry, Inc. meets all requirements of Local
Government Code, Chapter 252 with respect to competitive bidding by Texas
municipalities.
Discussion ensued between Councilmember Perez and Fire Chief Vance Riley regarding
this will provide a second set of bunker gear for all operational personnel, full time and
volunteers.

Council Action — Resolution No. R2017-76 — A Resolution of the City Council of the City
of Pearland, Texas, amending a unit supply contract for HVAC repair and maintenance
services at City facilities to Raven Mechanical, LP, for a total estimated expenditure
amount of $125,000.00 for the period of August 13, 2016 through August 12, 2017.
Councilmember Little made the motion, seconded by Councilmember Ordeneaux to
approve Resolution No. R2017-76.
City Manager Clay Pearson reported it is necessary for the City to retain the services of
an outside contractor to perform general maintenance and repair services for
HVAC/refrigeration equipment throughout the City on a needed basis.
Councilmember Ordeneaux stated no comment.
Voting "Aye" Councilmembers Little, Perez, Owens, Carbone, Moore, and Ordeneaux.
Voting "No" None.
Motion Passed 6 to 0, with Mayor Pro -Tem Reed absent from Council Chambers.
