Mayor Tom Reid opened a series of public hearings at 6:35 p.m

A request of Ted Maier, applicant, on behalf of Musa Ad!, owner; for approval of a
Conditional Use Permit (CUP) to allow for an auto wash (self-service) in the General
Commercial (GC) zoning district; on approximately 1.0672 acres of land.
Legal Description: Being a parcel of land containing 1.0672 acres (46,489 square feet)
more or less out that certain 8.8726 acre tract conveyed by George E. Young to Milestone
Propertied, Inc., as recorded in deed records Volume 1541, Page 648, Official Records of
Brazoria County, Texas, said 1.0672 acres being in the W.D.C. Hall Survey, Abstract 70,
Brazoria County, Texas.

Councilmember Gary Moore made a comment that he felt it was ironic that this project was
becoming a carwash when previously the oil change use had to go through UDC changes.
Councilmember Trent Perez was supportive of the use.

Legal Description: Being Reserve G a 1.5707 acre portion of a 20.8406 acre (907,818
square feet) tract of land being all of proposed Albertson's Pearland, a subdivision of land
out of Lots 31, 32, 63, and 64 of the Allison - Richey Gulf Coast Home Company
Subdivision of Section 9, H. T. & B. Railroad Company Survey, Abstract No. 234, Brazoria
County, Texas, according to the plat recorded in Volume 2, Page 24, of the Brazoria
County Plat Records.

APPLICATION INFORMATION AND CASE SUMMARY
Senior Planner Martin Griggs presented the exhibits and reported that Staff does
recommend approval for the CUP for the following reasons: '

1. The proposed CUP is compatible with the established non-residential uses of the
area. The adjacent properties are commercial in nature and the proposed use
complements the other businesses.
' 2. The application is for an existing building that does not require any additional
upgrades or alterations. Any alterations are negligible and will not have impacts on
the site or surrounding uses.
3. The applicant has already taken steps to install enhanced landscaping to screen the
auto -wash from Broadway Street.

COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION
Councilmember Trent Perez commented that the location was perfect for the project and
was supportive of the CUP. Councilmember Greg Hill agreed with Staff on the
recommendations to have no bars and neon lights. Councilmember Keith Ordeneaux asked
the applicant if there were any other locations and Applicant informed that he had another
location in Texas City and this business was not a franchise. Councilmember Gary Moore
had no issue with the CUP and commented for the first liquor location in the city, this was a
good location. Councilmember Derrick Reed asked the Applicant what the name of the other
' location in Texas City, Applicant replied Swizzle Liquorwas the name. Councilmember Tony
Carbone asked Staff if the UDC regulated bars over/behind windows and LED/Neon
lighting. Senior Planner Martin Griggs explained the regulations. Mr. Carbone commented
that the conditions were reasonable and location works for this project.
P&Z Chairperson Daniel Tunstall agreed on Staff recommendations regarding LED lights.

Mayor Tom Reid opened the public hearing for Amendments to the Unified Development
Code (UDC) @ 6:57 p.m.
P&Z Chairperson Daniel Tunstall read into record the request for Amendments to the
Unified Development Code (UDC)
AMENDMENTS TO THE UNIFIED DEVELOPMENT CODE (UDC)
A request of the City of Pearland, for proposed amendments to the Unified Development
Code, Ordinance No. 2000T.

COUNCIUPLANNING COMMISSION/STAFF DISCUSSION
Councilmember Tony Carbone agrees to leave GC zone and extended stay hotels
permitted by right and asked for clarification of S1, S2, S3, S4 & S5 districts. Senior Planner
Martin Griggs explained the difference of the Spectrum districts. Mr. Carbone asked Staff if
definitions in UDC have to be lengthy. Director of Community Development Lata Krishnarao
explained to Council the reason for the definitions was to help Staff better describe uses to
Developers. Councilmember Derrick Reed commented on the improved hotel modifications.
Councilmember Keith Ordeneaux would like to keep GC and GB permitted to keep hotels
at the current service levels of quality. Councilmember Greg Hill agrees with keeping GC
and GB permitted. Councilmember Trent Perez not in favor due to some hotels may abutte
to residential homes and by requiring a CUP it would give Residents an opportunity to let
them know a hotel is coming next to them. Mr. Carbone asked if there were an adjancy '
requirements. Ms. Krishnarao gave an explanation and example of a buffer issue with a
previous hotel and residents.
P&Z Chairperson Daniel Tunstall supports CUP process for hotel/motel.
Mayor Tom Reid adjourned the public hearing for amendments to the Unified
Development Code, Ordinance No. 2000T. @ 7:20 p.m.
