Mayor Reid called the Public Hearing to order at 6:34 p.m.
PUBLIC HEARING: A docketed Public Hearing in accordance with 24 CFR 91.105 (Citizen t
Participation) of the Code of Federal Regulations for the City of Pearland's Program Year
2016, Fiscal Year 2017, Community Development Block Grant Program Annual Allocation;
providing an opportunity for citizen participation and public involvement.
STAFF REVIEW:
Grants Coordinator Joel Hardy gave an overview of the Citizen Participation of the Code
of Federal Regulation for the City of Pearland's Program Year 2016 Fiscal Year 2017,
Community Development Block Grant Program Annual Allocation.
CITIZEN COMMENTS:
President of the Pearland Neighborhood Center Board of Directors Sean Murphy stated
without the support of City Staff and Council the Neighborhood Center would not be able to
do all the good things they are doing with the Community Development Block Grant
Program.
Director of Counseling Connections Dawn Lawless thanked City Staff and Council for the
Grant funding. She stated because they have had so many state funding cuts this grant will
be covering some of the lower income insurance reimbursement costs.
COUNCIL/STAFF DISCUSSION: ,
Councilmember Carbone thanked staff for all their work regarding the Block Grant Program.
Mayor Pro -Tem Moore thanked everyone for putting in the effort and Grants Coordinator
Joel Hardy for getting all the funds allocated.
Councilmember Ordeneaux thanked Grants Coordinator Joel Hardy and staff for their hard
work. He is always happy to see federal tax money coming back to the City.
Councilmember Hill thanked Grants Coordinator Joel Hardy and staff for their hard work
and he is happy to see the different organizations that will be receiving grant funds.
Councilmember Perez stated it warms his heart to see the City is able to give back to the
different organizations in the community.

Resolution of the City Council of the City of Pearland, Texas, renewing a
unit supply contract for auto parts to Napa Auto Parts, Inc., in the estimated
amount of $60,000 for the period of July 11, 2016 through July 10, 2017.

K. Consideration and Possible Action - Resolution No. R2016-107 - A
Resolution of The City Council of the City of Pearland, Texas, authorizing
the City Manager or his designee to participate in an interlocal cooperative
pricing arrangement with the Houston -Galveston Area Council (HGAC) for
the purchase of post -disaster debris monitoring services from TetraTech,
Inc., for the period of June 1, 2016 through May 31, 2019.
Councilmember Carbone asked that Consent Agenda Items G and I be removed from the
Consent Agenda for further discussion.
Councilmember Perez asked that Consent Agenda Item H be removed from the Consent '
Agenda for further discussion.

City Manager Clay Pearson reported the estimated amount of $60,000 should be $20,000
for auto parts to XL Parts LP.

the motion to state the estimated amount of $20,000 for auto parts to XL Parts LP.

Councilmember Carbone made the motion, seconded by Mayor Pro -Tem Moore to approve
Resolution No. R2016-125 as amended.
City Manager Clay Pearson reported Council is being asked to renew a unit supply bid for
ditch cleaning services with Donmar Grading, Inc., in the estimated amount of $210,000
and not the amount of $220,000. An amended motion will need to be made to reflect the
correct amount.
Discussion ensued between Councilmember Perez and Assistant Director of Public Works
Michael Leech regarding the survey and the ditches restored back to what they were
originally attended to do.

bid for the installation of Auto Flushers and Sample Stations, in the
estimated amount of $635,770 from K. R. Allen Industrial Services.
Councilmember Carbone made the motion, seconded by Mayor Pro -Tem Moore to approve '
Resolution No. R2016-126.
City Manager Clay Pearson reported the rejection of the single bid received for the provision
and installation of potable water system automatic flushing devices came in far higher than
estimated. The staff does not find the submitted pricing to be a good value for the City.
Discussion ensued between Councilmember Carbone and Assistant Director of Public
Works Michael Leech regarding why only one bid was received.

tract of land containing 4.1919 acres of land out of Lot Forty -One (41), Section 25, H.T. & '
B. R.R .Company Survey, Abstract 245, Brazoria County, Texas, and being designated on
the Block Books of Brazoria County, Texas of Section 25 and being a part of the same land
described in Deed from C. W. Boots, at. ux. to Joe H. Reeder, by Deed dated June 22, 1959,

City Manager Clay Pearson reported that staff recommends approval of the change in
zoning from the Suburban Development (SD) district to the Office & Professional (OP)
district.

hanging in regarding this zone change.

Pearland, Texas, amending the 2015 Comprehensive Plan to include the SH 35
Redevelopment Plan and act as a guide for regulating land use within the incorporated limits
of Pearland; containing a savings clause, a severability clause and a repealer clause; and
providing an effective date.
Councilmember Hill made the motion, seconded by Councilmember Carbone, to approve
Ordinance No1517-1 on its First Reading.
Mayor Reid read into the record the Planning & Zoning Commission's recommendation to
forward to Council for approval of the proposed amendment to the 2015 Comprehensive
Plan to include the SH 35 Redevelopment Plan.
Pearland Economic Development Corporation President Matt Buchanan stated this is a city- ,
initiated request to amend the 2015 Comprehensive plan to incorporate the SH 35 Corridor
Redevelopment Strategy. One of the main strategies outlined in the Pearland 20/20
Community Strategic Plan is to optimize the development potential of Pearland's principal
commercial corridors that are the primary areas of our community's economic activity.
Councilmember Perez stated SH 35 has a lot of zones along that corridor and he hopes this
will be the start of many steps to improve that corridor to be a more attractive development
area.

Development Corporation President Matt Buchanan regarding the funding.

to facilitate the changes identified herein; providing a savings clause, a severability clause,
a repealer clause, and an effective date.

' Budget Officer Tara Kilpatrick gave an overview of the 2015-2016 Annual Budget Ordinance
and amendment of Ordinance No. 1518-3.
Councilmember Carbone asked in the future if slides are going to be presented at the
Council meeting could they also be included in the agenda request which would help when
questions are asked. Also in the future when there is an amendment to the budget he would
like to see the original adopted budget to be able to compare.

City Manager Clay Pearson regarding sales tax and the increase for Parks and Recreation.

$605,279.28 for the period of June 27, 2016 through June 26, 2017.

of Pearland, Texas, awarding a bid for Fire Department Dispatch Services to Cypress Creek
EMS, in the estimated amount of $223,400 for the period of December 16, 2016 through
December 15, 2017.
Councilmember Ordeneaux made the motion, seconded by Councilmember Hill, to approve
Resolution No. R2016-120.
City Manager Clay Pearson reported Council is being asked to award a bid for Fire '
Department Dispatch Services to Cypress Creek EMS in the estimated amount of $223,400
for the period of December 16, 2016 through December 15, 2017.
Fire Chief Vance Riley gave an overview of why it was time to re-evaluate the current vendor
and look at what other opportunities are available.
Discussion ensued between Council, Fire Chief Vance Riley and Communication Manager
Nicki Smith with Cypress Creek EMS regarding GIS maps and technology to locate the
emergency caller.
Councilmember Perez stated he does not believe it is always good to go with the lowest
bid, but go with the best quality of the bid.

Smith with Cypress Creek EMS regarding the increase of call volume.

Council Action - Resolution No. R2016-114 - A Resolution of the City Council of the City
of Pearland, adopting and implementing a Sustainable Practices Policy for City facilities
' replacing prior adopted LEED Certification mandates.
Councilmember Hill made the motion, seconded by Mayor- Pro -Tem Moore, to approve
Resolution No. R2016-114.
City Manager Clay Pearson reported the purpose of this agenda request is to replace two
City Policies pertaining to Leadership in Energy & Environmental Design (LEED)
certification to reflect current City Council direction on such matters.
Councilmember Perez stated personally he does not think the City needs to pursue any
type of LEED certification. He does agree the City needs to have an energy efficient,
sustainable design and use recycled material when possible.
Mayor Pro -Tem Moore stated he will not support the LEED certification.
Discussion ensued between Councilmember Hill and Assistant City Manager Trent
Epperson regarding the Keep Pearland Beautiful Nature Center will not be going through
the LEED process, but it will be energy efficient and use sustainable practices.
Councilmember Ordeneaux stated he fully supports removing the LEED process.

Cover and Staff Utilization Study, in the amount of $79,996, to Citygate Associates, LLC.
Councilmember Perez made the motion, seconded by Councilmember Carbone, to approve
Resolution No. R2016-128.
City Manager Clay Pearson reported Council is being asked to award a bid for the
completion of the Fire Department Standards of Cover and Staff Utilization Study in the
amount of $79,996 to Citygate Associates, LLC.
Fire Chief Vance Riley gave an overview of the Standards of Cover and Staff Utilization
Study.

Councilmember Carbone made the motion, seconded by Mayor Pro -Tem Moore, to approve
Resolution No. R2016-129.
City Manager Clay Pearson reported Council is being asked to award a bid to the Pearland
Journal for the official newspaper of record for publishing City legal notices in the estimated
amount of $15,000 for the period of July 24, 2016 to July 23, 2017.
Councilmember Ordeneaux stated he hopes legislature will see fit to allow the City to put

He further stated he would like to see the State set up a data base that all City's put the
legal notices in so vendors and corporate can access.

Council Action - Resolution No. R2016-127 -A Resolution of the City Council of the City
of Pearland, Texas, authorizing city staff to proceed with acquisition of surveying services
for proposed annexation of Areas A, B, C, and G.
Mayor Pro -Tem Moore made the motion, seconded by Councilmember Carbone, to approve
Resolution No. R2016-127.
City Manager Clay Pearson reported the 2015 Comprehensive Plan identified areas
appropriate for annexation and listed short term annexation as a Priority Action Task to be
initiated in the first year of implementation. Staff is planning to proceed in accordance with
the recommended schedule that was discussed at City Council retreat and included in the
memo sent to the City Council on May 30, 2016.
Discussion ensued between Councilmembers regarding the areas of annexation and all
agree with moving forward with the annexation. '

Discussion and Possible Action - Regarding Mowing of Right of Ways.
Assistant City Manager Trent Epperson presented an update regarding the Mowing of Right
of Ways and gave the following as possible options.
1. Enforce the existing Ordinance. Ordinance 633-4.
2. Enforce the existing Ordinance, with Brazoria County Drainage District No. 4
providing mowing at the locations four times per year or approximately every 60-90
days during the growing season.
3. Adopt a criteria -based mowing program where the City mows areas that meet the
criteria, excluding the areas to be mowed by Brazoria County Drainage District No.
4. An estimate of the costs to implement this option across the entire City is being
developed and is expected to be available.
4. Adopt a criteria -based mowing program where the City mows areas that meet the
criteria only where the property owner is not meeting the Ordinance. While initial cost
will be lower, this option has the potential to eventually match the cost of Option 3
' above. In addition, this will create an inconsistent application of resources which will
be confusing to residents as to why some properties are mowed by the City and
others are not.
Discussion ensued between Councilmembers and Assistant City Manager Trent Epperson
Regarding recutting the ditches at a lesser grade, residents putting in their own culverts,
and leans on property so the City can get reimbursed.
Councilmember Perez stated the long run culverts are not equivalent to an open ditch.
The only way to replace the conveyance of an open ditch is to allow for a deeper water
storm sewer.
Councilmembers Carbone, Perez, Ordeneaux, Hill, and Moore stated they would like to
see the City move forward with options 2 and 4.
Council Action - Resolution No. R2016-124 -A Resolution of the City Council of the City
of Pearland, Texas, renewing a unit supply bid for landscape maintenance services
(medians and right of ways) with Maldonado Nursery and Landscaping, Inc., in the
estimated amount of $295,509 for the period of July 20, 2016 through July 19, 2017.
Councilmember Ordeneaux made the motion, seconded by Mayor Pro -Tem Moore, to
' approve Resolution No. R2016-124.

Larry Marcott, 3606 Inverness Court, addressed Council stating his concerns of the cost for
mowing medians, right of ways and ditches. '
