IN THE COUNCIL CHAMBERS, CITY HALL CALL TO ORDER ZBA Chairperson Dale Pillow called to order the public hearing at 6:00 p.m. The following were present: Chairperson Dale Pillow Board Member Don Glenn Board Member Jerry Acosta Alternate Board Member John Gehring Alternate Board Member Gary Shrum Also in attendance were: Associate Planner Vince Hustead, Deputy City Attorney Lawrence Provins, City Planner Frankie Legaux, Senior Planner Ian Clowes and Office Supervisor Judy Brown. NEW BUSINESS ZBA APPLICATION NO. 2015-07 Chairperson Dale Pillow opened the public hearing for ZBA Application No. 2015-07 at 6:01 p.m. CALL PUBLIC HEARING TO ORDER Chairperson Dale Pillow read the purpose of the hearing. PURPOSE OF HEARING: A request of Cesar Dominguez, applicant; on behalf of Pearland Independent School District; for approval of a Variance permitted in Section 2.2.5.2, of the Unified Development Code, Ordinance No. 2000-T, from the articulation requirement of at least three feet (3') in depth for every twenty-five feet (25') (not cumulatively) in vertical or horizontal length for properties zoned M-2 Heavy Industrial located in Corridor Overlay Districts on a property zoned M-2 Heavy Industrial District on the following described property: Legal Description: Being 39.3122 Acres on the north part of 97.6916 acres being out of the L.W. Murdock Subdivision in the F.B. Drake or A.C.H. & B. Railroad Company Survey Abstract Number 507 City of Pearland, Brazoria County„ Texas. General Location: West side of State Highway 35 across from Pearland High School., Pearland, TX 77581 Associate Planner Vince Hustead read the staff report stating the applicant was Page 1 of 2 ZBA minutes 08-06-2015 seeking a variance from the required 3 feet in depth for every 25 feet in vertical or horizontal length for properties zoned M-2 Heavy Industrial in the Corridor Overlay District. Applicant on behalf of PTSD, Cesar Dominguez was present. There was no one present to speak for or against the proposed request. ZBA member Jerry Acosta inquired about 50% and if it was within the ZBA's discretion. Alternate member Gary Shrum inquired how PISD was involved. Associate Planner Vince Hustead stated PISD was the current owner and was selling it to Shale Inland. ADJOURNMENT OF PUBLIC HEARING Chairperson Dale Pillow adjourned the public hearing for ZBA Application No. 2015-07 at 6:10 p.m. ZBA member Don Glenn made the motion to approve ZBA Application No. 2015-07 and ZBA member Jerry Acosta seconded the motion. The vote was 5-0. ZBA Application No. 2015-07 was approved.
