2015-03-16 PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTESMINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, MONDAY, MARCH 16, 2015, AT 6:30 P.M., HELD IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND,TEXAS CALL TO ORDER P&Z Chairperson Henry Fuertes opened the meeting for the P&Z Regular Meeting at 7:51 p.m. In attendance were: P&Z Chairperson Henry Fuertes P&Z Member Elizabeth McLane P&Z Member Derrick Reed P&Z Member Mary Starr P&Z Member Thomas Duncan Also in attendance were City Planner Johnna Matthews, Senior Planner Ian Clowes, Director of Community Development Lata Krishnarao, Deputy City Manager John Branson, Interim City Engineer Richard Mancilla, and Community Development Office Supervisor Judy Brown. CONSENT AGENDA Chairperson Henry Fuertes made a motion to approve Items A — D of the consent agenda, removing items E & F for Consideration, per staff request. The vote for Consent Agenda Items A — D was 5-0 for approval MATTERS REMOVED FROM CONSENT AGENDA CONSIDERATION AND POSSIBLE ACTION — FINAL PLAT OF PROVINCE VILLAGE RESIDENTIAL TRACT B A request by Rene Rodriguez of LJA Engineering, applicant; on behalf of Chris Lynch, Gehan Homes, owner; for approval of a Final Plat of Province Village Residential Tract B; a 54 lot single-family residential subdivision and 6 reserves, on approximately 13.353 acres of land on the following described property, to wit Legal Description: A subdivision of 13.353 acres of land situated in the Thomas J. Green Survey, Abstract -198 Brazoria County, Texas. General Location: South side of Province Village Drive and approximately 900 feet east of Peadand Parkway. P&Z Commissioner Mary Starr made the motion to approve, and P&Z Commissioner Elizabeth McLane seconded. City Planner Johnna Matthews stated staff requested that condition be added to the approval requiring all amenities be finalized before recordation of the plat. Mr. Alan Mueller was present and stated the Planned Development has a clause stipulating that all amenities be complete prior to the first issuance of a CO of a home. Discussion ensued among Commission/Staff with regards to Planned Development stipulation. Commissioner Mary Starr stated it seemed it was already addressed in the PD. Director of Community Development stated this was a typical subdivision regulation that stands by itself. The Commission was okay with moving forward without stated condition. The vote was 5-0. The Final Plat of Province Village Residential Tract B was approved. CONSIDERATION AND POSSIBLE ACTION — FINAL PLAT OF PROVINCE VILLAGE RESIDENTIAL TRACT C A request by Rene Rodriguez of LJA Engineering, applicant; on behalf of Chris Lynch, Gehan Homes, owner, for approval of a Final Plat of Province Village Residential Tract C; a 21 lot single-family residential subdivision with 5 reserves, on approximately 7.109 acres of land on the following described property, to wit Legal Description: A subdivision of 7.109 acres of land situated in Thomas J. Green Survey, Abstract -198, Brazoria County, Texas. General Location: North side of Province Village Drive and approximately 250 feet east of Pearland Parkway. P&Z Commissioner Mary Starr made the motion to approve, and P&Z Commissioner Elizabeth McLane seconded. City Planner Johnna Matthews requested that the condition be added to the approval requiring all amenities be finalized before recordation of the plat. The vote was 5-0. The Final Plat of Province Village Residential Tract C was approved. NEW BUSINESS CONSIDERATION AND POSSIBLE ACTION — CONDITIONAL USE PERMIT NO. 2014- 11 A request of William G. Crowell, applicant/owner for approval of a Conditional Use Permit to allow for the construction of a Residential Antenna Support Structure within the Single Family Residential - 3 (R-3) zoning district on approximately 0.1446 acres of land, to wit: Legal Description: Being Lot 17, Block 3 of the Hazeldale Estates Plat, Recorded in Vol. 17, Pg. 243 of the Brazoria County Public Record, out of a tract of land containing 18.327 acres of land in the Perry Austin League Abstract III, Brazoria County, Texas. General Location: 2716 Shauntel Street, Peariand, TX Senior Planner Ian Clowes recapped the staff report stating the Conditional Use Permit was for a residential antenna support structure. Staffs recommendation was to deny the CUP. Mr. Clowes also added that radio frequency should not be taken into account per the requirements of the UDC. Chairperson Henry Fuertes weighed the pros and cons but stated he was not in favor. Commissioner Derrick Reed agreed with staff stating he was afraid a fifty (50) foot tower would include forty (40) feet of antenna for a total of ninety (90) feet. The vote was 0-5. Conditional Use Permit No. 2015-01 was denied. CONSIDERATION AND POSSIBLE ACTION — CONDITIONAL USE PERMIT NO. 2015- 01 A request of Ben Searway, applicant; on behalf of SW40, LLC, owner; for approval of a Conditional Use Permit (CUP) for an exemption to the facade requirements for an existing structure located in the Garden/O'Day — Mixed Use (G/O-MU) district on approximately .568 acres of land, to wit: Legal Description: Being lot Six (6) and the North 12.5 feet of lot Seven (7) in block Six (6), of Hickory Creek Place, a subdivision in Brazoria County, Texas according to the map or plat thereof, recorded in Volume 11, Page 1 of the Plat Records of Brazoria County. General Location: 2125 Garden Road, Peadand, TX Senior Planner Ian Clowes recapped the staff report stating he feels the landscaping and paving will add beautification to the site. Commissioner Mary Starr made the motion, and Commissioner Thomas Duncan seconded. There was no discussion. The vote was 5-0. Conditional Use Permit No. 2015-01 was approved. CONSIDERATION AND POSSIBLE ACTION — CONDITIONAL USE PERMIT NO. 2015- 02 A request of BGE Kerry R. Gilbert and Associates, applicant; on behalf of Glass 518 Joint Venture, owner, for approval of a Conditional Use Permit (CUP) to allow for a Mini- Warehouse/Self Storage Facility located within the General Business (GB) zoning district on approximately 4.5496 acres of land, to wit: Legal Description: Being all of Lot 1 of Pearland Senior Village, as recorded in Doc. #2010012628 of the Brazoria County Plat Records in the H.T. & B.R.R. Co. Survey, Abstract No. 242 in Brazoria County, Texas. General Location Southwest comer of Broadway Street and Brownstone Place, Pearland, TX Commissioner Elizabeth McLane made the motion to approve, and Commissioner Derrick Reed seconded. Senior Planner Ian Clowes recapped the staff report stating staff asked for additional buffering and landscaping and the applicant complied, including a wrought iron fence. Mr. Clowes did ask that the conditions be added from the staff report, as follows: 1. As part of the conditions for approval, staff requested that the applicant to apply higher landscaping standards to Brownstone Place (a public access easement) in regards to landscaping. This was intended to minimize the visual impact of the development along Brownstone Place. The applicant has complied with this request, providing a building setback along Brownstone Place of 25 feet as opposed to the required 10 feet, and by providing landscaping along Brownstone Place that is equal to the requirements of the COD. Staff requests that the applicant add a landscape calculation table to the site plan in order to enable staff to ensure all landscaping requirements are met. 2. Staff requests that the applicant add additional landscaping, consisting of a continuous hedge or berm, to the southern boundary of the property to screen buildings from adjacent uses. 3. All proposed fencing in all yards and buffers will be wrought iron and will be shown on the provided site plan. Also, add a note on the site plan that there will be no metal buildings. Commissioner Thomas Duncan stated he was glad the driveway was not on Broadway. Commissioner Derrick Reed commended Ms. Kathryn Edwards for coming back in with a new project. Commissioner Elizabeth McLane amended her motion to include staffs conditions, and Commissioner Derrick Reed seconded. The vote was 5-0. Conditional Use Permit No. 2015-02 was approved with the following conditions: 1. As part of the conditions for approval, staff requested that the applicant to apply higher landscaping standards to Brownstone Place (a public access easement) in regards to landscaping. CONSIDERATION AND POSSIBLE ACTION — CONDITIONAL USE PERMIT NO. 2015- 03 A request of Greg Gow (FCI) as Agent for Verizon Wireless, applicant; on behalf of Ace Manor Property Development 1, owner; for approval of a Conditional Use Permit (CUP) to allow for the construction of a Wireless Telecommunication Tower located within the General Commercial (GC) zoning district on approximately 2.046 acres of land, to wit: Legal Description: Being 2.046 acres out of Lot 58 of the W. Zychlinski Subdivision, Vol. 29, Pg. 43 of the Brazoria County Deed Records, within the H.T. & B.R.R. Co. Survey, Abstract 542 City of Pearland, Brazoria County, Texas. General Location: 1515 North Main Street, Peariand, TX Commissioner Thomas Duncan made the motion to approve, and Commissioner Mary Star seconded. Senior Planner Ian Clowes recapped the staff report stating this would be a cell tower in a general commercial area surrounded by commercial and industrial. Staff recommended approval. Commissioner Elizabeth McLane stated she would like to see landscaping even if City Council does not. Chairperson Henry Fuertes commented that this was near a gateway to the city and agreed with staff. Commissioner Derrick Reed asked the applicant if they had any problem adding additional landscaping. Mr. Greg Gow stated there was limited space due to the setbacks, pipeline and street widening. Senior Planner Ian Clowes recommended the following conditions be added. 1. Staff recommends that additional landscaping be added along the access easement and around the proposed enclosure in order to meet the requirements of the UDC. 2. Staff recommends that the full length of the access easement be paved in order to meet the specifications of the UDC. 3. Site plan for the entire site is not being approved with this CUP. Only the portion referencing the proposed addition of landscaping, paving of the access easement, and location of the proposed enclosure, will be approved with this CUP. All other UDC requirements need to be met. Future approvals by the Zoning Board of Adjustments (ZBA) may be required if the UDC requirements are not able to be met, including the required landscape buffer along Main St. Commissioner Thomas Duncan amended his motion to include staffs conditions, and Commissioner Mary Star seconded. She spoke of what was projected in 1999 and where we are now. 3. National APA Conference—April 18-21, 2015 in Seattle — Commissioner's McLane and Duncan to attend. 4. Auto Repair at Dixie Farm and Broadway — postponed until April 6, 2015. 5.
