2015-12-14 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTESMINUTES OF THE JOINT PUBLIC HEARING FOR THE CITY COUNCIL AND THE ' PLANNING AND ZONING COMMISSION, CITY OF PEARLAND, TEXAS, HELD ON DECEMBER 14, 2015 AT 6:30 P.M., IN THE COUNCIL CHAMBERS - CITY HALL - 3519 LIBERTY DRIVE CALL TO ORDER Mayor Tom Reid opened a series of public hearings at 6:30 p.m. The following were present: Council Member Tony Carbone P&Z Acting Chairperson Daniel Tunstall Council Member Greg Hill P&Z Commissioner Ginger McFadden Council Member Keith Ordeneaux P&Z Commissioner Mary Starr Council Member Derrick Reed P&Z Commissioner Troy Pradia Council Member Gary Moore P&Z Commissioner Derrell Isenberg P&Z Commissioner David Selsky Also present were Director of Community Development Lata Krishnarao, City Planner Frankie Legaux, Senior Planner Ian Clowes, Associate Planner Vince Hustead, City ' Engineer Sue Polka, Assistant City Engineer Richard Mancilla, Deputy City Attorney Lawrence Provins, PEDC President Matt Buchanan and Office Assistant Alma Gonzales. Senior Planner Ian Clowes presented the public hearing process and order of the agenda. Mayor Tom Reid opened the public hearing for Conditional Use Application No. 2015-13 @ 7:35 p.m. PURPOSE OF HEARING P&Z Acting Chairperson Daniel Tunstall read the purpose of the hearing into the record. Conditional Use Application No. 2015-13 A request of Jimmy Aranda, applicant; on behalf of Tom Amundsen, owner; for approval of a Conditional Use Permit (CUP) to allow for a winery in the General Commercial (GC) zoning district; on approximately 4.441 acres of land, to wit: Legal Description: Being the North one-half of Lot 47 of the Subdivision of Section 85, H.T.B.B. Railroad Company Survey, Abstract No. 304, in Brazoria County, Texas; being that same tract of land as described in the deed to Thomas a, Amundsen recorded in Volume 91960, Page 139, Deed Records of Brazoria County, Texas. General Location: 2635 Miller Ranch Road, Pearland, TX. ' APPLICATION INFORMATION AND CASE SUMMARY Senior Planner Ian Clowes read a brief summary stating the property presently has four existing buildings and the future proposed buildings will be located front and south of property with masonry walls. There is an existing residential area with an existing detention facility. Staff recommended approval. Applicant Jimmy Aranda gave a brief presentation and owner Tom Admudsen also spoke. No staff wrap up. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST ' Blake Cmajdelka, resident living near the proposed facility asks if any potential odors will be released. Jimmy Aranda answered no orders would be present. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Councilman Keith Ordeneaux asked about the setbacks and Sr. Planner Ian C. replied about the buffer and the residential zone. Councilman Greg Hill commented it will be a great addition and Councilman Gary Moore also agrees and is in support. There was no discussion from the P & Z Commission.
