2015-07-20 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTES' MINUTES OF THE JOINT PUBLIC HEARING FOR THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION, CITY OF PEARLAND, TEXAS, HELD ON July 20, 2015, AT 6:30 P.M., IN THE COUNCIL CHAMBERS - CITY HALL - 3519 LIBERTY DRIVE CALL TO ORDER Mayor Tom Reid called to order the series of public hearings at 6:35 p.m, for the City Council and P&Z Chairperson Henry Fuertes for the Planning and Zoning Commission. The following were present: Mayor Tom Reid Mayor Pro Tem Keith Ordeneaux Council Member Tony Carbone Council Member Derrick Reed Council Member Gary Moore Council Member Greg Hill Chairperson Henry Fuentes Vice Chairperson Daniel Tunstall P&Z Commissioner Thomas Duncan P&Z Commissioner Mary Starr P&Z Commissioner Ginger McFadden Also present were City Manager Clay Pearson, City Attorney Darrin Coker, City Planner Frankie Legaux, Senior Planner Ian Clowes, Director of Community Development Lata Krishnarao, City Engineer Sue Polka, Assistant City Engineer Richard Mancilla, Deputy ' City Manager Jon Branson, Assistant City Manager Trent Epperson, President of Pearland Economic Development Corporation Matt Buchanan and Office Assistant Jennifer Tatum. Senior Planner Ian Clowes presented the public hearing process and order of the agenda. Mayor Tom Reid opened the public hearing for Amendments to the Unified Development Code at 6:38 p.m. PURPOSE OF HEARING Amendments to the Unified Development Code (UDC) A request of the City of Pearland Community Development Department; for approval of a Unified Development Code (UDC) amendment to require thatAll Automobile related uses, and Pawn Shops, Payday Loans, and Gold Exchanges, require approval of a Conditional Use Permit in the General Business (GB), General Commercial (GC), Neighborhood Services (NS), and Office Professional (OP) Zoning Districts and amendments to requirements regarding underground utilities. Legal Description: N/A General Location: N/A Page 1 of 3 — 07/20/2015 APPLICATION INFORMATION AND CASE SUMMARY ' Senior Planner Ian Clowes read the staff report and went over some of the items that would be amended. Mr. Clowes stated that staff recommended approval. City Attorney Darrin Coker went over underground utilities. There was no one present to speak for or against the proposed request. Council Member Greg Hill thanked staff and stated the amendments were a good idea. Council Member Keith Ordeneaux stated he did not think this was a good idea. Council Member Tony Carbone stated he would like to see this limited to Pearland Parkway and that he agreed with underground utilities. Council Member Derrick Reed stated he like the idea and that it gave the Planning & Zoning Commission a chance to look at what was going on. Council Member Gary Moore stated that he agreed with Mr. Carbone in that we are changing too much and that it's not the right thing to do. Mr. Moore also stated he didn't see another option and wasn't sure where he stood with this issue. Mayor Tom Reid stated that changes were needed and he didn't want to see Pearland Parkway and Broadway become over cluttered. P&Z Chairperson Henry Fuertes stated you mainly see gas stations on corners, not in the middle of shopping strips. Director of Community Development Lata Krishnarao stated we were not just addressing gas stations. Ms. Krishnarao stated the Conditional Use ' Permit (CUP) was only for commercial uses. Ms. Krishnarao stated there would still be parcels that permit by right and that we were dealing with parcels that are vested as well. Ms. Krishnarao stated that this would give the Council and Commission a choice when a proposal came to the city. P&Z Vice Chairperson Daniel Tunstall stated he was in agreeance with the amendments. There was much discussion concerning the Exxon gas station on Broadway and Dixie Farm Rd pertaining to signage and code enforcement issues. Mayor Tom Reid adjourned the public hearing process for Amendments to the Unified Development Code (UDC) at 7:12 p.m. Mayor Tom Reid opened the public hearing for Amendments to the Thoroughfare Plan at 7:14 p.m. PURPOSE OF HEARING THOROUGHFARE PLAN AMENDMENT A request of the City of Pearland to amend the Thoroughfare Plan APPLICATION INFORMATION AND CASE SUMMARY ' Senior Planner Ian Clowes read the staff report and went over the proposed amendments Page 2 of 3 — 07/20/2015 to the Thoroughfare Plan. Mr. Clowes stated that staff recommended approval. Mr. Sean Murphy, 2907 Queen Victoria 77581, stated he as a resident of Banbury Crossing didn't want to see the extension of Westminister to Pearland Parkway. Mr. Murphy stated this would provide opportunity for more traffic, crime, and for people to use this road as a cut through. Mr. Murphy stated he would like Westminister to stay as it is. A letter was distributed to City Council and the P&Z Commission from a resident of Banbury Crossing as well. Council Member Gary Moore inquired if a study had been done on Westminister. Assistant City Engineer Richard Mancilla stated this was part of a PD that was approved last year and that they are addressing concerns with the PD. Council Member Tony Carbone inquired if the PD that was approved showed Westminister going to Pearland Parkway. Senior Planner Ian Clowes stated yes. Council Member Keith Ordeneaux inquired IF THE Barry Rose connection was being eliminated. Mr. Clowes stated yes. Mr. Mancilla stated it was being changed from a 90 degree angle to Barry Rose to go to Pearland Parkway instead. Council Member Greg Hill stated a letter was received from a resident concerning a right in right out on Westminister. Mr. Hill inquired if this was comparable to HEB. Mr. Mancilla stated that traffic issues were being worked on and that this could be added to the PD. ' P&Z Vice Chairperson Daniel Tunstall stated he did not remember a cut though to Pearland Parkway being on the PD. Mr. Mancilla stated the PD shows a right in right out and that a median was in place.
