2014-09-04 ZONING BOARD OF ADJUSTMENT REGULAR MEETING MINUTESMINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF PEARLAND, TEXAS HELD ON THURSDAY, SEPTEMBER 4, 2014, AT 6:00 P.M. IN THE COUNCIL CHAMBERS, CITY HALL CALL TO ORDER ZBA Chairperson Dale Pillow called to order the public hearing at 6:00 p.m. The following were present: Chairperson Dale Pillow Vice -Chairperson Mark Lewis Board Member Nita Griffin Board Member Don Glenn Alternate Board Member Derrell Isenberg Alternate Board Member Jessica Anderson Alternate Member Derrell Isenberg left the meeting before it was opened. Also in attendance were: Senior Planner Ian Clowes, Deputy City Attorney Nghiem Doan, Director of Community Development Lata Krishnarao, and Office Assistant Jennifer Tatum. APPROVAL OF MINUTES ZBA Board Member Don Glenn made the motion to approve the Minutes of the June 5, 2014 and August 7, 2014, ZBA regular meetings, and Vice -Chairperson Mark Lewis seconded the motion. NEW BUSINESS ZBA APPLICATION NO. 2014-12 Chairperson Dale Pillow opened the public hearing for ZBA Application No. 2014-12 at 6:01 p.m. Chairperson Dale Pillow read the purpose of the hearing. PURPOSE OF HEARING: A request of Pastor Frank Seamus, applicant; on behalf of Freedom Fellowship, owner; for a Special Exception permitted in Section 2.7.3.7 (a), of the Unified Development Code, Ordinance No. 2000-T, to allow for the reduction of the minimum thirty (30) foot landscaping setback requirement of the zoning district located on the following described property: Page 1 of 3 Minutes of ZBA 09-04-2014 Being a 2.49 acre tract of land out of 78 of the Zychlinski Subdivision of the R.B. Lyle Survey, Abstract No. 542, Pearland, Brazoria County, Texas, and being out of a tract conveyed to Leslie Appelt, Trustee, Recorded in Volume 1372, Page 616 of the Brazoria County Deed Records. (1201 Main St., Pearland, TX 77581) Specific Location: The subject property is located at 1201 Main Street. STAFF REPORT Senior Planner Ian Clowes read the staff report stating staff recommended approval with the following two conditions: 1. An increase in the total amount of ornamental tree required on site from 30 to 40 caliper inches in order to mitigate for the 30 foot buffer. 2. At the time of future redevelopment, the property owner will be required to comply with the 30 foot landscape buffer or whichever buffer is required at the time. APPLICANT PRESENTATION Mr. Frank Seamus stated that the church needed this Special Exception in order to grow and expand the church and that this Special Exception would allow for more parking. Mr. Frank Seamus also stated that the church was looking to break ground on the new facility in about a year and a half. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST There was no one wishing to speak for or against the proposed request. STAFF / BOARD / APPLICANT DISCUSSION Chairperson Dale Pillow inquired about additional landscaping and if this has been outlined with the applicant. Senior Planner Ian Clowes stated that this information was in the staff report and had been discussed with the applicant prior to the meeting. ADJOURNMENT OF PUBLIC HEARING Chairperson Dale Pillow adjourned the public hearing for ZBA Application No. 2014-12 at 6:11 p.m. CONSIDERATION AND POSSIBLE ACTION Vice Chairperson Mark Lewis made the motion to approve with the following two conditions, and Alternate Member Jessica Anderson seconded. 1. An increase of the total amount of ornamental tree required on site from 30 to 40 caliper inches in order to mitigate for the 30 foot buffer. 2. At the time of future redevelopment, the property owner will be required to comply with the 30 foot landscape buffer or whichever buffer is required at the time.
