CALL TO ORDER
ZBA Chairperson Dale Pillow called to order the public hearing at 6:00 p.m.
The following were present:

Also in attendance were: Planner Lauren Fehr, Deputy City Attorney Nghiem Doan,
City Planner Johnna Matthews and Office Supervisor Judy Brown.
APPROVAL OF MINUTES
Vice -Chairperson Mark Lewis made the motion to approve the minutes of the April 3,
2014 ZBA Regular meeting, and Board Member Jerry Acosta seconded the motion.
The vote was 5-0. The minutes of April 3, 2014 ZBA Regular meeting were approved.

Chairperson Dale Pillow opened the public hearing for ZBA Application No. 2014-06 at
6:01 p.m.
Chairperson Dale Pillow read the purpose of the hearing.
PURPOSE OF HEARING
A request by Pat Munoz — Servpro Friend swood/Pearland, agent, on behalf of Glenda
Vitale, owner, for approval a Special Exception permitted in Section 2.7.3.7 (b) (4), of
the Unified Development Code, Ordinance No. 2000-T, to allow the reconstruction of a
nonconforming building which has been damaged to the extent of more than fifty
percent (50%) of its replacement cost, on the following described property:
1.119 acres out of the Colony Park Commercial Subdivision recorded in Vol. 16, Pg.
295 of the B.C.M.R of Brazoria County, Texas. (5627 Broadway Street, Pearland, TX
77581)
Specific Location: The subject property is located at 5627 Broadway Street.

STAFF REPORT
Planner Lauren Fehr read the staff report stating the applicant is seeking a special
exception to allow for the reconstruction of a nonconforming building which was
damaged by a fire to the extent of more than fifty percent (50%) of its replacement
cost. The existing building foundation does not meet the required 25 -foot front
setback and the required landscape buffer for the Corridor Overlay District. The
applicant, in addition, intends to demolish the existing gravel and asphalt parking lot
and replace it with a new parking lot. The property will need to be platted.
APPLICANT PRESENTATION
Mr. Pat Munoz of ServPro Friend swood/Pearland, 2537 Roy Road, Pearland Texas
77581 spoke on behalf of the applicant stating they will meet the criteria to rebuild and
replace the parking lot.
PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST
There was no one present to speak for or against the proposed request.

There was no discussion among the Staff / Board / Applicant.
ADJOURNMENT OF PUBLIC HEARING
Chairperson Dale Pillow adjourned the public hearing for ZBA Application No. 2014-06
at 6:10 p.m.
Board Member Jerry Acosta made the motion to approve, and Board Member Don
Glenn seconded.
The vote was 5-0. ZBA Application No. 2014-06 was approved.

Chairperson Dale Pillow adjourned the public hearing at 6:12 p.m.
