CONSENT AGENDA CONSIDERATION & POSSIBLE ACTION — APPROVAL OF MINUTES: Approve the Minutes of the August 4, 2014, p.m. P&Z Regular Meeting, held at 6:30 p.m. Excuse the Absence of Ginger McFadden from the August 4, 2014 P&Z Regular meeting. CONSIDERATION & POSSIBLE ACTION — PRELIMINARY PLAT OF RIVERSTONE RANCH SECTION 3 A request by Rene Rodriguez of LJA Engineering Inc., applicant, on behalf of Meritage Homes of Texas, LLC, owner, for approval of a Preliminary Plat of Riverstone Ranch at Clear Creek Section 3, a 77 lot single-family residential subdivision, to wit: Legal Description: Being a subdivision of 19.979 acres of land situated in the T.J. Green Survey, Abstract 290, City of Pearland, Harris County, Texas also being a part of lots 70, 71, 72, 73, 74, 87, 88, 89, 90, and 91 of the Allison Richey Gulf Coast Home Company Subdivision, Section "G", a subdivision of record in Volume 4, Page 48, Map Records of Harris County, Texas. P&Z Commissioner Linda Cowles made the motion to approve the Consent Agenda, P&Z Commissioner Elizabeth McLane seconded. The vote was 7-0. The Consent Agenda was approved. MATTERS REMOVED FROM CONSENT AGENDA - NONE OLD BUSINESS - NONE DISCUSSION ITEMS 1. Commissioners Activity Report - None 2. Comprehensive Plan Update — Senior Planner Ian Clowes stated staff is looking to schedule a joint workshop in October. The Comprehensive Plan update remains on schedule. 3. Postponed Agenda Items — Zone Change Application No. 2014-10Z, Lake Park PD — City Planner Johnna Matthews stated the revised documents have been received and are in review. 4. No P&Z Meeting September 1, 2014 — Labor Day Holiday 5. Next JPH/P&Z Meeting September 15, 2014 — 2" d Floor Conference Room — P&Z Commissioner Mary Starr will not be able to attend the September 15, 2014 meeting. NEW BUSINESS Minutes of P&Z Regular Meeting August 18, 2014 Page 2 of 7 CONSIDERATION AND POSSIBLE ACTION — RIVERSTONE RANCH AT CLEAR CREEK CLUSTER DEVELOPMENT PLAN AMENDMENT REQUEST A request by Geoff Freeman of BGE Kerry Gilberts and Associates applicant, on behalf of Meritage Homes of Texas, LLC, owner, for approval of an amendment to the Riverstone Ranch at Clear Creek Cluster Development Plan, to wit: Legal Description: Being a subdivision of 429.6 acres of land situated in theT.J. Green Survey, Abstract 290, City of Pearland, Harris County, Texas also being a portion of the Allison Richey Gulf Coast Home Company Subdivision, Section "G", a subdivision of record in Volume 4, Page 48, Map Records of Harris County, Texas. General Location: Southeast of Riverstone Ranch Drive, south of the City of Houston ETJ border. P&Z Commissioner Mary Starr made the motion to approve the Riverstone Ranch at Clear Creek Cluster Development Amendment, and P&Z Commissioner Linda Cowles seconded. Senior Planner Ian Clowes read the staff report explaining that the subject property was purchased by a new home developer. The developer would like to clean up portions of the cluster plan and clarify the types of amenities that will be provided. A revised Cluster Plan was submitted. P&Z Chairperson Henry Fuertes asked what the staff would be happy with. Senior Planner Ian Clowes stated that staff was in agreement with the proposed amenities, trails, and time lines that were submitted. Mr. Clowes also stated that all conditions have been met. P&Z Commissioner Linda Cowles asked if this was all of Riverstone Ranch and, if it was connected to the developed section to the North. Applicant Kerry Gilbert stated that this is a continuation of Riverstone Ranch but would have different Homeowner Associations. P&Z Vice Chairperson Daniel Tunstall inquired about the size of each lot and if they were locked into a certain size. Mr. Clowes stated that the lot size could change. The vote was 7-0. The Amendment to Riverstone Ranch at Clear Creek Cluster Development Amendment was approved. P&Z Chairperson Henry Fuertes recessed the P&Z Regular Meeting at 7:02 p.m. P&Z Chairperson Henry Fuertes reconvened the P&Z Regular Meeting at 8:58 p.m. Minutes of P&Z Regular Meeting August 18, 2014 Page 3 of 7 CONSIDERATION AND POSSIBLE ACTION — ZONE CHANGE APPLICATION NO. 2014-12Z, BAKS BREWERY PD A request of Brian Allen with Baks Brewery, applicant; on behalf of George Gartner, owner; for approval of a change in zoning from General Commercial (GC) to a non- residential Planned Development known as Baks Brewery; on approximately 2.94 acres of land, to wit: Legal Description: Being a 2.939 acre tract out of Lots 20, 21 and 22 of the George W. Jenkins Subdivision, in Brazoria County, Texas, according to the map or plat thereof recorded in Volume 2, Page 20, of the Brazoria County, Texas Plat Records General Location: Northeast corner of Broadway Street and Shauntel Street, Pearland, TX P&Z Vice Chairperson Daniel Tunstall made the motion to approve Zone Change Application No. 2014-12Z, and P&Z Commissioner Mary Starr seconded. City Planner Johnna Matthews read the staff report stating staff recommends approval of the request to change the zoning of the site from General Commercial (GC), to a non- residential PD, allowing a base zone and overlay district of GC, with the addition of the proposed use, and the following conditions; 1. Provide details within the PD regarding the phasing of improvements, including the proposed trail system. 2. Revise the Design Standards Deviation Table regarding outdoor activities with specifics, as opposed to the current statement "Activities including, but not limited to, a covered seating area for customers". P&Z Commissioner Linda Cowles asked what a "growler fill" was. Applicant Brian Allen stated that it was a large glass container or thermos that would be filled with beer, but was to be consumed offsite. Mr. Tunstall stated that this site could be a restaurant/bar with the current zoning and that the vote was just for the brewing/manufacturing portion of the business. He also stated that more buffering was being given compared to other businesses around the area. P&Z Commissioner Ginger McFadden commented that the building as it sits was great for a brewery, and that this building was not too close to the daycare. The vote was 7-0. Zone Change Application No. 2014-12Z was approved with the following conditions: Minutes of P&Z Regular Meeting August 18, 2014 Page 4 of 7 1. CONSIDERATION AND POSSIBLE ACTION — ZONE CHANGE APPLICATION NO. 2014-13Z, PEARLAND TOWN CENTER PD AMENDMENT A request of Alysia Gordon and Teir Allender, applicants; on behalf of Michael Lebovitz, Executive Vice President of Development and Administration for Pearland Town Center, LP, owner; for approval of a change in zoning to amend the sign regulations contained within the Pearland Town Center PUD; on approximately 142.97 acres of land, to wit: Legal Description: 142.9664 acres of land out of Pearland Town Center, a subdivision of 143.6500 acres as recorded under File Number 2007008914 of the Plat Records of Brazoria County, Texas, and situated in the H.T. & B.R.R. Company Survey, Abstract 300, Section 81, Brazoria County, Texas General Location: South Side of Broadway Street, east and west of Kirby Drive, and west of Business Center Drive, Pearland, Texas P&Z Commissioner Elizabeth McLane made the motion to approve Zone Change Application No. 2014-13Z, and P&Z Commissioner Linda Cowles seconded. City Planner Johnna Matthews read the staff report stating that staff recommended approval with the following conditions: 1. The applicant proposes that all off -premise wall advertising signs are approved by the owner. City approval, other than the normal permitting will no longer be required. Staff recommends City approval once, through the permitting process for all new frames, to ensure public safety and structural integrity of the new frames. Please clearly indicate this in the PD document. 2. Staff requests that Exhibit B-2 is updated to reflect changes regarding advertising on the main tower (J) and the two (2) lower towers (Hand C). 3. Staff requests a red -line and an addendum to the master PD document for the Pearland Town Center. 4. There is a discrepancy regarding the total square footage on Exhibit B-2, with the Minutes of P&Z Regular Meeting August 18, 2014 Page 5 of 7 removal of Sign G. P&Z Commissioner Linda Cowles inquired if any of the signs would be visible from city streets. Applicant Teir Allender stated the signs would only be visable from within the Pearland Town Center Development. P&Z Vice Chairperson Daniel Tunstall asked if the city would be able to keep the signs from being lit up or electronic. City Planner Johnna Matthews stated she would have to look into it this. Deputy City Attorney Nghiem Doan stated that the applicant would have to apply for electrical permits if that was the case. The vote was 7-0. Zone Change Application No. 2014-13Z was approved with the following conditions: 1. The applicant proposes that all off -premise wall advertising signs are approved by the owner.
