PURPOSE OF HEARING — TO GATHER PUBLIC COMMENT AND TESTIMONY REGARDING THE ABANDONMENT OF CERTAIN ROAD RIGHTS-OF-WAY LOCATED IN THE LA PALOMA SUBDIVISION AND ALONG AUBRELL ROAD. STAFF REVIEW TO GATHER PUBLIC COMMENT AND TESTIMONY REGARDING THE ABANDONMENT OF CERTAIN ROAD RIGHTS-OF-WAY LOCATED IN THE LA PALOMA SUBDIVISION AND ALONG AUBRELL ROAD. Mr. Darrin Coker, City Attorney. Darrin Coker City Attorney reported this public hearing involves 2 proposed rights-of-way abandonments. The first abandonment involves the streets in La Paloma subdivision located along Yost Road. The residents of this 17 lot subdivision petitioned the City to abandon the streets so the neighborhood could become a private/gated community. The council conducted a workshop regarding this concept several months ago, and since that Page 1 of 2 — 6/24/2013 time the residents have executed all of the documents required to accomplish the abandonment (agreement between the property owners and the Home Owners Association, and a release/indemnity agreement for the City). The City will retain a public utility easement over the rights-of-way after it is abandoned which will allow for the maintenance and construction of the City's utility infrastructure. The second abandonment involves a small segment of Aubrell Drive located near the intersection of Becky Lane and Songbird Drive. Pierre Nys, the developer for Audubon Place petitioned the City for abandonment of this 0.3 acre portion of the road because he owns all of the properties surrounding the roadway which would allow him to relocate the gate for the rear entrance to Audubon Place. The gate is currently located at Songbird Drive and Aubrell Drive. The abandonment would allow the gate to be relocated to Aubrell Drive and Becky Lane. The City will also retain a public utility over abandoned rights-of-way for the future maintenance and construction of the City's utility infrastructure located in the Aubrell Drive rights-of-way. City Staff does not have any objections to the requests. CITIZEN COMMENTS: None. COUNCIL/STAFF DISCUSSION: None.
