MINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS, HELD ON MONDAY, MARCH 11, 2013, AT 6:30 P.M. IN
THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND,
TEXAS.
Mayor Reid called the meeting to order at 6:30 p.m. with the following present:

PURPOSE OF HEARING — PUBIC COMMENT AND TESTIMONY REGARDING
THE CREATION OF A REINVESTMENT ZONE IN ACCORDANCE WITH
SECTION 312.201 OF THE TAX CODE AND CITY OF PEARLAND'S
GUIDELINES FOR GRANTING TAXING ABATEMENTS. Mr. Darrin Coker, City
Attorney.
STAFF REVIEW OF THE CREATION OF A REINVESTMENT ZONE IN
ACCORDANCE WITH SECTION 312.201 OF THE TAX CODE AND CITY OF
PEARLAND'S GUIDELINES FOR GRANTING TAXIING ABATEMENTS.

Lawrence Provins Assistant City Attorney II reported a public hearing is required
prior to the creation of a reinvestment zone for properties located near the
intersection of North Spectrum Blvd. and Kirby Drive. A zone must be formed
before the City may enter into a Tax Abatement Agreement with any prospect
that may develop in the zone. The hearing is being held to determine whether the
proposed industrial improvements sought for the property are feasible and
practicable and whether the improvements will benefit the land within the zone.

COUNCIL/STAFF DISCUSSION:
City Manager Bill Eisen stated regarding the project there is not a firm
commitment in terms of the incentive agreement with Pearland Economic
Development Corporation. He further stated Council is being asked to create the
reinvestment zone. The actual terms and conditions of a tax abatement would be
the subject of a different agenda item that would occur at a future date. He
further stated it would be in the form of a contract between the City of Pearland
and the potential user specifying all the terms and conditions.
Councilmember Owens asked for clarification on whether the property in
discussion is located in the Management District.
City Manager Bill Eisen stated it is in the lower Kirby Management District.
