2013-09-16 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTESMINUTES OF THE JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON SEPTEMBER 16, 2013, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS Mayor Tom Reid and P&Z Vice -Chairperson Matthew Hanks called the series of public hearings to order at 6:31 p.m. with the following present: Mayor Tom Reid Mayor Pro Tem Greg Hill Council Member Tony Carbone Council Member Susan Sherrouse Council Member Scott Sherman Council Member Keith Ordineaux P&Z Vice -Chairperson Matthew Hanks P&Z Commissioner Ginger McFadden P&Z Commissioner Mary Starr P&Z Commissioner Daniel Tunstall P&Z Commissioner Linda Cowles P&Z Commissioner Elizabeth McLane Also in attendance: City Attorney Darrin Coker, Assistant City Manager Mike Hodge, Assistant City Manager Jon Branson, City Manager Bill Eisen, City Planner Harold Ellis, Director of Community Development Lata Krishnarao and Community Development Office Coordinator Judy Brown. City Planner Harold Ellis explained the Joint Public Hearing and agenda process for the attending public, and explained that the Planning & Zoning Commission meeting would immediately follow the Joint Public Hearing. Mayor Tom Reid opened the Public Hearing for Zone Change Application No. 2013-14Z at 6:34 p.m. NEW BUSINESS ZONE CHANGE APPLICATION NO. 2013-14Z A request of Jawad Hussain, applicant and owner, for approval of a zone change from the Neighborhood Service (NS) zone to the General Business (GB) zone for 0.63 acres on the following described property, to wit: Legal Description: 0.3727 acres of land, being a part of Reserve "A", in the Replat of Corrigan Addition, Section One, according to the plat as recorded in Volume 11, Page 97-98, Plat Records, Brazoria County, Texas, situated in the H. T. & B Railroad Company Survey, Abstract 240, Brazoria County, Texas; and 0.2548 acres of land, out of Reserve "B", in the Replat of Corrigan Addition, Section One, according to the plat as recorded in Volume 11, Page 97-98, Plat Records, Brazoria County, Texas, situated in the H. T. & B Railroad Company Survey, Abstract 240, Brazoria County, Texas JPH Minutes of September 16, 2013 Page 1 of 3 General Location: 5306 Broadway, Pearland, TX P&Z Vice -Chairperson Matthew Hanks read the purpose of the meeting into the record. City Planner Harold Ellis read the staff report stating staff recommended approval of the zone change. Mr. Ellis stated staff received one public comment in opposition of the zone change. Mr. Jawad Hussain, 5306 Broadway, Pearland, TX spoke briefly as owner and applicant of the property. There was no one present to speak for or against the zone change. Mayor Pro Tem Greg Hill inquired if Frankie Santora would be the applicant moving into the open space, and if the trash around the building would be an issue, based on the public comment form in opposition. Mr. Hussain stated Ms. Santora would be the applicant moving in with her resale shop and the trash issue was taken care of. Mayor Tom Reid adjourned the public hearing for Zone Change Application No. 2013- 14Z at 6:41 p.m. Mayor Tom Reid opened the public hearing for Zone Change Application No, 2013-15Z at 6:42 p.m. ZONE CHANGE APPLICATION NO. 2013-15Z A request of Kerry Gilbert & Associates, applicant, on behalf of Parkside 59/288, Ltd., owner, for approval of a zone change from the Planned Development (PD) zone to the Planned Development (PD) zone for 38.909 acres on the following described property, to wit: Legal Description: 38.909 acres of land in the H. T. & B. R. R. Company Survey, Section 81, Abstract No. 300, Brazoria County, Texas, being a portion of lots 38, 39, 40, 49, and 50 of the Allison Richey Gulf Coast Home Company's part of Suburban Gardens, a subdivision of record, Volume 2, Page 98, of the Plat Records of said Brazoria County (B.C.P.R.), more particularly being the residue of that certain called 30.583 acre tract (described as Part One), and the residue of that certain called 9.990 acre tract (described as Part Two) conveyed from Compass Bank to Parkside 59/288 Ltd, by an instrument of record under Document Number 2011012491, of the Official Public Records of said Brazoria County (B.C.O.P.R.) Staff did receive three phone calls inquiring about the zone change. Mr. Dan Moody, Parkside 59/288 Ltd., 3003 W. Alabama St., Houston, TX spoke briefly. There was no one present to speak for or against the zone change. P&Z Vice -Chairperson Matthew Hanks asked for clarification on additional power lines not being allowed to connect overhead. Mr. Ellis clarified that all connections to the line in question must be below ground.
