2013-03-25 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTES1 MINUTES OF THE JOINT PUBLIC HEARING OF THE CITY OF PEARLAND, TEXAS, HELD MARCH 25, 2013, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS CALL TO ORDER Mayor Tom Reid and P&Z Chairperson Henry Fuertes called the public hearing to order at 6:43 p.m. with the following present: Mayor Tom Reid Mayor Pro Tem Susan Sherrouse Council Member Woody Owens Council Member Keith Ordeneaux Council Member Greg Hill Council Member Scott Sherman P&Z Chairperson Henry Fuertes P&Z Vice Chairperson Linda Cowles P&Z Commissioner Mary Starr P&Z Commissioner Neil West P&Z Commissioner Matthew Hanks P&Z Commissioner Ginger McFadden P&Z Commissioner Daniel Tunstall Also in attendance: City Attorney Darrin Coker, Assistant City Manager Mike Hodge, Assistant City Manager Jon Branson, City Manager Bill Eisen, City Planner Harold Ellis, Planner II Ian Clowes, Community Development Director Lata Krishnarao, and Community Development Office Coordinator Judy Brown. City Planner Harold Ellis explained the Joint Public Hearing and agenda process for the attending public, and explained that the Planning & Zoning Commission meeting would immediately follow the Joint Public Hearing. Mayor Tom Reid opened the Public Hearing for Conditional Use Permit No. 2013-01 at 6:45 p.m. NEW BUSINESS CONDITIONAL USE PERMIT NO. 2013-01 A request of Mike Chance, applicant for Crown Warehouse Service, Inc., owner, for approval of a Conditional Use Permit to allow a Plumbing Shop (No Outside Storage) in the PD -GB zone, on the following described property: Legal Description: Approximately 3.0 Acre Tract of land out of a 10 Acre Tract, a residue of D. H, Stripling12.000 Acre Tract recorded Volume 868, Page 239 of the Brazoria County Deed Records. All being part of the South 99 Acres of the H.T. & B. R. R. Co. Survey, Sec. 7, A-219 as recorded in Volume 595, Page 63 of the Deed of Records of Brazoria County, Texas (Generally located at 6301 Broadway Street, Pearland Texas). General Location: 6301 Broadway St, Pearland, TX JPH Minutes March 25, 2013 Page 1 of 2 P&Z Chairperson Henry Fuertes read the purpose of the hearing into the record. Planner II Ian Clowes read the staff report stating staff recommends approval of the CUP. Staff received one phone call but it pertained more to a code enforcement issue with the site being overgrown. Mr. Mike Chance of 3117 Autumn Court, Pearland, Texas spoke stating the tenant is Texas Master Plumber and they are seeking to move in. Nancy Murphy, owner, 2017 Victoria Court, League City, Texas spoke stating they were pleased to have a good tenant move in. Mr. Ronald Goyne, owner of Texas Master Plumber, 1218 Delores St., Kemah, Texas spoke and stated there would be no outside storage, no vehicles parked on the weekend as employees take their trucks home. There was no one present to speak for or against the conditional use permit. Council Member Woody Owens stated this was a better use than previously. P&Z Member Neil West stated he sees a temptation to park on the lot to the side. Planner II Ian Clowes stated there is no outside storage or parking allowed. Mr. West stated he would be concerned with non -storage items being placed there and would discuss during the P&Z regular meeting.
