2012-01-16 CITY COUNCIL SPECIAL MEETING MINUTESMINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON MONDAY, JANUARY 16, 2012, AT 6:00 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. Mayor Reid called the meeting to order at 6:07 p.m. with the following present: Mayor Tom Reid Mayor Pro -Tem Ed Thompson Councilmember Woody Owens Councilmember Scott Sherman Councilmember Susan Sherrouse City Manager Bill Eisen City Attorney Darrin Coker City Secretary Young Lorfing Absent: Councilmember Felicia Harris. Others in attendance: Jon Branson Assistant City Manager; Mike Hodge Assistant City Manager; Matt Buchanan President of Economic Development Corporation. Council adjourned into Executive Session under Texas Government Code at 6:07 p.m. to discuss the following: EXECUTIVE SESSION UNDER TEXAS GOVERNMENT CODE 1. SECTION 551.074 — PERSONNEL MATTERS — REGARDING APPOINTMENTS TO THE CITY'S VARIOUS BOARDS AND COMMISSIONS. Mayor Tom Reid. Council returned from Executive Session at 6:54 p.m. COUNCIL ACTION — REGARDING APPOINTMENTS TO THE CITY'S VARIOUS BOARDS AND COMMISSIONS. City Council. No Council action taken. Mayor Reid recessed the Special Meeting at 6:55 p.m. to conduct Joint Public Hearings. Mayor Reid called the Special Meeting back to order at 7:47 p.m. FIRST AND ONLY READING OF ORDINANCE NO. 633-3 — AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AMENDING CHAPTER 13, HEALTH AND SANITATION, OF THE CITY OF PEARLAND Page 1 of 3 — 1/16/2012 CODE OF ORDINANCES, AS IT MAY HAVE BEEN, FROM TIME TO TIME, AMENDED, TO AMEND SECTION 13-17, ENTITLED UNSANITARY OR HAZARDOUS CONDITIONS UNLAWFUL; HAVING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE, AND A REPEALER CLAUSE; AND PROVIDING FOR CODIFICATION AND AN EFFECTIVE DATE; AND DECLARING AN EMERGENCY BECAUSE THE NEED TO REGULATE HEALTH AND SANITATION INURES TO THE BENEFIT OF THE PUBLIC AND, THEREFORE, BEARS DIRECTLY UPON THE HEALTH, SAFETY AND WELFARE OF THE CITIZENRY. Mr. Darrin Coker, City Attorney. Councilmember Sherrouse made the motion, seconded by Councilmember Owens to approve Ordinance No. 633-3 on its First and Only Reading as amended. City Attorney Darrin Coker gave an overview of the ordinance. Brief discussion ensued between Council and City Attorney Darrin Coker regarding the ordinance. Councilmember Sherrouse made the motion, seconded by Councilmember Sherman to amend Ordinance No. 633-3 Section (d) to read as follows: (d) Rubbish. A person, owner, tenant, agent or person responsible for any premises, occupied or unoccupied, commits an offense if said person keeps, stores, or accumulates thereon rubbish, including newspapers, abandoned vehicles, refrigerators, stoves, furniture, tires, and cans, on said premises for ten (10) days or more, unless the rubbish is completely enclosed in a building and not visible from a public street or the premises is lawfully operated as a landfill. Voting "Aye" Councilmembers Owens, Sherman, Thompson, and Sherrouse. Voting "No" None. Motion Passed 4 to 0, with Councilmember Harris absent. Mayor Reid called for the vote on the original motion as amended. Voting "Aye" Councilmembers Owens, Sherman, Thompson, and Sherrouse. Voting "No" None. Motion Passed 4 to 0, with Councilmember Harris absent. SECTION 551.087 — CONSULTATION WITH CITY ATTORNEY — REGARDING ECONOMIC DEVELOPMENT NEGOTIATIONS. Mr. Bill Eisen, City Manager. NEW BUSINESS CONTINUED: Council returned from Executive Session at 8:45 p.m. COUNCIL ACTION — REGARDING ECONOMIC DEVELOPMENT NEGOTIATIONS. City Council. No Council action taken.
