Others in attendance: Jon Branson Assistant City Manager; Mike Hodge Assistant City Manager; Bonita J. Hall Director of Human Resources and Safety Management; Claire Bogard Finance Director; Vance Riley Fire Chief; Sparkle Anderson, Public Affairs Manager; Johnny Spires, Assistant Police Chief. The invocation was given by Councilmember Greg Hill and the Pledge of Allegiance was led by Alex Opekun, Boy Scout, Troop 211. MAYOR'S ACTIVITY REPORT: Tammy Dexter announced she is currently running for City Council Position No. 4. Ted Kalivoda announced he is currently running for Board of Regents, Position No. 1, and Alvin Community College. Mayor Reid reported he attended the Planning and Zoning presentation to the public; attended the Eagle Scout Court of Honor (5 Honorees), on March 3, Pearland Arts League Corks & Canvas Show, March 5, Council Agenda Meeting, Council Workshop and Special Meeting, March 6, Community Development Information Meeting, Greater 288 Partnership Quarterly Meeting, March 7-9, Texas Association of Regional Council State Quarterly Board of Directors Meeting COUNCIL ACTIVITY REPORTS: Councilmember Owens reported he attended the City of Pearland Chamber of Commerce Luncheon for the Pearland Independent School District 288 Partnership Quarterly Meeting; Houston Contractors Luncheon. Page 1 of 6 — 3/12/2012 Councilmember Sherrouse reported March 1, she attended the West Pearland Republics Women's Meeting Candidate Forum, March 2, Dawson High School girls varsity game and presented a proclamation on behalf of Mayor Reid for National Athletic Training Month, and started a hot dog eating contest at halftime, also attended the Pearland Chamber of Commerce Business Before Hours Breakfast; visited the Farmers Market, and the well attended Keep Pearland Beautiful plant sale. Mayor Pro -Tem Sherman reported the last two weeks he attended two Home Owners Association meetings in Shadow Creek Ranch, the Village of Emerald Bay and The Village of Reflection Bay; March 8, The Pearland Chamber of Commerce Young Professionals Group, Miniature Golf Tournament; March 9, Speaker at the Pearland Chamber of Commerce Business Before Hours and reminded everyone of the Red Hat Literacy Luncheon at the Adult Reading Center on March 15. Councilmember Hill reported on February 28, he attended the Shriner's IHop Pancake Breakfast, He was a guest speaker at the Leadership Presentation at Pearland Chamber of Commerce, Young Professional Breakfast; Pearland Chamber of Commerce monthly luncheon for the Pearland Independent School District; March 8, The Pearland Chamber of Commerce Young Professionals Group, Miniature Golf Tournament; March 9, Lions Club Casino Night raised about $14,000 net that will go back into the community probably for scholarships for high school students. Mayor Reid reported Councilmember Harris absent from the Chamber but may join in later during the meeting process. CITY MANAGER'S REPORT: City Manager Bill Eisen reported he did not have the opportunity to attend the Chamber of Commerce monthly luncheon where Pearland School Board President Virgil Gant and Doctor Kelly gave a presentation on Pearland Independent School District. He did have the opportunity that same day to hear the presentation at the 288 Partnership Quarterly Meeting. They shared a lot of good information about the quality of the district. Mr. Eisen stated he feels that it is a good illustration of why he feels Pearland Independent School District has been a big factor in the growth of the community. CITIZENS: Ted Kalivoda 11506 Starlight Bay Court addressed Council and stated he has been a Pearland Citizen for about 10 years he wanted to speak about the Bond Vote of 2007 and the Westside Sports Park that the voters have approved and are looking forward to constructing and having it built as soon as possible. CONSIDERATION AND POSSIBLE ACTION — RESOLUTION NO. R2012-32 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AWARDING A BID FOR THE PURCHASE OF STABILIZED ROAD MATERIALS. Mr. Jon Branson, Assistant City Manager. MATTERS REMOVED FROM CONSENT AGENDA: Councilmember Owens made the motion, seconded by Councilmember Sherrouse, to adopt Consent Agenda Items A through B as presented on the Consent Agenda. Voting "Aye" Councilmembers Owens, Sherrouse, Sherman, and Hill. Voting "No" None. Motion Passed 4 to 0, with Councilmember Harris absent. MATTERS REMOVED FROM CONSENT AGENDA: None. FIRST READING OF ORDINANCE NO. 1461 — AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, FINDING THAT THE CITY HAS ESTABLISHED GUIDELINES AND CRITERIA FOR GRANTING TAX ABATEMENT PURSUANT TO RESOLUTION NO. R2011-12; DESIGNATING AND DESCRIBING A REINVESTMENT ZONE (TO BE KNOWN AS REINVESTMENT ZONE #22), IN ACCORDANCE WITH THE PROPERTY REDEVELOPMENT AND TAX ABATEMENT ACT; FINDING THAT THE IMPROVEMENTS SOUGHT ARE FEASIBLE AND PRACTICAL AND WOULD BE A BENEFIT TO THE LAND TO BE INCLUDED IN THE ZONE AND THE MUNICIPALITY AFTER THE EXPIRATION OF THE TAX ABATEMENT AGREEMENT; AUTHORIZING THE CITY MANAGER TO SIGN TAX ABATEMENT AGREEMENTS WHEN APPROVED BY THE CITY COUNCIL; HAVING A SAVINGS CLAUSE AND A SEVERABILITY CLAUSE; AND AN EFFECTIVE DATE. Mr. Darrin Coker, City Attorney. Page 3 of 6 — 3/12/2012 Councilmember Sherrouse, made the motion, seconded by Councilmember Owens, to approve Ordinance No. 1461 on its first reading. City Manager Bill Eisen stated earlier this evening the City Council held a Public Hearing with regards to creating of this Reinvestment Zone. This being one of two readings being required to creating this Zone assuming this moves forward. Staff will bring to Council the actual Tax Abatement Agreements. Voting "Aye" Councilmembers Hill, Sherman, Sherrouse, and Owens. Voting "No" None. Motion Passed 4 to 0, with Councilmember Harris absent. COUNCIL ACTION — RESOLUTION NO. R2011-162 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO ENTER INTO A MUTUAL AID LAW ENFORCEMENT AGREEMENT. Mr. J.C. Doyle, Police Chief. Mayor Pro -Tem Sherman, made the motion, seconded by Councilmember Ownes, to approve Resolution No. R2012-162. City Manager Bill Eisen stated this agreement is active between the City of Pearland and other cities, counties and result in sharing resources for purposes of establishing a Narcotics Task Force. Councilmember Hill asked for clarification on how the forfeitures and the revenues would be distributed between the agencies involved. City Manager Bill Eisen stated they would be equally distributed among the various agencies involved. Councilmember Owens asked if the distribution covered all the agencies at one time or how that would work. Assistant City Attorney Larry Provins stated the distributions take place one time a year between all the agencies involved. Voting "Aye" Councilmembers Owens, Sherrouse, Sherman, and Hill. Bill Eisen, City Manager. Councilmember Hill, made the motion, seconded by Councilmember Owens, to approve Resolution No. R2012-31. City Manager Bill Eisen stated this is a project that has been underway for sometime regarding the design and improvements to the Barry Rose Wastewater treatment plant. The improvements will include replacement of aged equipment which should increase the operating efficiency and reduce cost of operations. Voting "Aye" Councilmembers Hill, Sherman, Sherrouse, and Owens. Voting "No" None. Motion Passed 4 to 0, with Councilmember Harris absent. FIRST READING OF ORDINANCE NO. 1286-1 — AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AMENDING CHAPTER 14, ARTICLE III, JUNKED VEHICLES, OF THE CITY OF PEARLAND CODE OF ORDINANCES, FOR THE; HAVING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE, AND A REPEALER CLAUSE; PROVIDING FOR PUBLICATION, CODIFICATION, AND AN EFFECTIVE DATE. Mr. Darrin Coker, CifyAttorney. Councilmember Owens, made the motion, seconded by Mayor Pro -Tem Sherman, to approve Ordinance No. 1268-1 on its first reading. City Manager Bill Eisen stated this change in the City's junked vehicle ordinance. The purpose of the proposed change is to align the City's Ordinance with the State Laws that govern junked vehicles. The only change is to the section in the ordinance is to replace the word "or' with the word "and." Mr. Eisen gave brief overview of the ordinance. Discussion ensued between Council and Assistant City Attorney Lawrence Provins regarding the ordinance. Voting "Aye" Councilmembers Hill, Sherman, Sherrouse, and Owens. Voting "No" None. Motion Passed 4 to 0, with Councilmember Harris absent.
