Mayor Reid called the public hearing to order at 6:30 p.m. with the following present: Mayor Mayor Pro -Tem Councilmember Councilmember Councilmember Councilmember City Manager City Attorney City Secretary Tom Reid Susan Sherrouse Woody Owens Scott Sherman Keith Ordeneaux Greg Hill Bill Eisen Darrin Coker Young LorFing Others in attendance: Jon Branson Assistant City Manager; Danny Cameron Public Works Director; Mike Hodge Assistant City Manager; Claire Bogard Finance Director; Skipper Jones Assistant Director of Capital Projects. PURPOSE OF HEARING — TO CONSIDER PUBLIC COMMENT AND TESTIMONY REGARDING THE ABANDONMENT OF AN UNUSED TWENTY -FOOT (20') ALLEYWAY. Mr. Darrin Coker, City Attorney. STAFF REVIEW TO CONSIDER THE ADOPTION OF THE ABANDONMENT OF AN UNUSED TWENTY -FOOT (20') ALLEYWAY. Mr. Darrin Coker, City Attorney. City Attorney Darrin Coker gave a report on the abandonment of an unused twenty -foot (20') alleyway. The property is Buc-ee's located at State Highway 35 and Walnut Street. The easement cuts directly under the islands where the gas pumps are located. The City does not object to the request to abandon the easement. Mr. Coker further reported he spoke to the Director of Public Works Danny Cameron and confirmed there are no utilities in the easement. The owner of Buc-ee's petitioned the City requesting the abandonment. CITIZEN COMMENTS: None. COUNCIL/STAFF DISCUSSION: Councilmember Owens asked if the property runs north and south. Page 1 of 2 — 7/23/2012 City Attorney Darrin Coker replied the property does run north and south. Councilmember Owens asked if the property next to Buc-ee's is clear. Director of Public Works Danny Cameron reported the property next to Buc-ee's is Goodyear Tire Company. The sewer line runs between State Highway 35 and Houston, behind Perry's Restaurant through the parking lot of Goodyear all the way to Walnut Street. City Attorney Darrin Coker reported the alleyway does exist on the property of Goodyear. If that property ever comes into redevelopment it would probably be replated and abandoned at that time. The alleyway extends across several properties located in the area. Councilmember Owens asked if the City could let the property owners know about the alleyway and the City have it abandoned. City Attorney Darrin Coker stated that as required by the City's Ordinance the property owners have been notified. The City only abandons property that has been requested. The property owners would have to petition the City and request for abandonment. ADJOURNMENT Meeting was adjourned at: 6:37 P.M.
