2011-02-09 ZONING BOARD OF ADJUSTMENT REGULAR MEETING MINUTESMINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF PEARLAND, TEXAS, HELD FEBRUARY 99 2011, AT 6:00 P.M., CITY HALL COUNCIL CHAMBERS, 3519 LIBERTY DRIVE, PEARLAND, TEXAS CALL TO ORDER Chairperson Dale Pillow called the meeting to order at 6:00 p.m. with the following in attendance: Chairperson Dale Pillow Board Member Don Glenn Board Member David Smith Alternate Board Member Jerry Acosta Alternate Board Member Shannon McAuliffe Also in attendance were Planner I Ian Clowes, Planning Director Lata Krishnarao, Deputy City Attorney Nghiem Doan, and Office Coordinator Judy Krajca. APPROVAL OF MINUTES Alternate Board Member Shannon McAuliffe made the motion to approve the January 6, 2011 minutes, and Board Member David Smith seconded. The vote was 5-0. The minutes of January 6, 2011 were approved. NEW BUSINESS Planner I Ian Clowes read the Public Hearing process. Chairperson Dale Pillow opened a public hearing for ZBA Application No. 2011-04 at 6:01 p.m. ZBA APPLICATION NO. 2011-04 Request of Denbury Onshore, LLC, applicant and Anne Demitriades, Alice Doner, Laverne Lang, and Tom Menefee, owners, for a special exception permitted in Section 2.7.3.7 (a) (3), of the Unified Development Code, Ordinance No. 2000-T, to allow for a resumption of a nonconforming use on the following described property: Lot 34, Section 29, H.T. & B.R.R. Company Survey, A-292 Allison Richey Gulf Coast Home Company's Suburban Garden Subdivision, Brazoria County, Vol. 2, Pg. 101, Plat Page 1 of 5 ZBA Minutes 02/09/2011 Records Brazoria County, Texas. (SW Corner of SH 35 and S. Hastings Field Rd., Pearland, TX) Chairperson Dale Pillow read the purpose of the hearing. Planner I Ian Clowes read the staff report stating the history of the Hastings Oil Field and that the use is allowed in a Heavy Industrial Zone (M-2) with a Conditional Use Permit; however, since the property is zoned Light Industrial (M-1), a special exception is being requested to allow for a resumption of a non -conforming use. Mr. James Fields of Denbury Onshore, LLC 5320 Legacy Drive, Plano, Texas spoke. Mr. Jim Williford of 9180 Country Road 414, Alvin, Texas spoke in opposition and stated the business operates 24 hours a day with no respect for the residents. Mr. Michael Sanders, Attorney, of 19 Briar Hollow Lane, Suite 235, Houston, Texas spoke in opposition for Ms. Mary Price of 5204 Main Street, Pearland, Texas. Mr. Sanders stated the well site has been moved to more than 500 feet from Ms. Price's home, since last August, and that this same request was denied previously and nothing new has been submitted. Mr. Sanders also commented that the relationship with Denbury Onshore, LLC has not been positive, due to the trash, and oil and water spill, and asked the Board to deny this again. Ms. Ann Wagner of 403 Sunset Drive, Friendswood, Texas spoke in favor of the special exception. Alternate Board Member Shannon McAuliffe inquired how long it takes to complete the process. Mr. James Fields stated three weeks at approximately 18-21 days. Mr. McAuliffe asked what would stay on the land. Mr. Fields stated the pipeline, wellhead and the Christmas trees. There would be no sheds, and no poles. Chairperson Dale Pillow inquired if this is a working field now. Mr. James Fields replied that it is currently an active field. Mr. James Fields explained the process of CO2 Injection into wellbores. Planner I Ian Clowes stated that if this is approved, a drilling permit must be granted by City Council, and staff would make sure these steps are in place. Mr. Clowes added that he had received numerous calls inquiring, but only received two public comment forms, and they were in favor. Chairperson Dale Pillow opened a public hearing for ZBA Application No. 2011-05 at 6:24 p.m. ZBA APPLICATION NO. 2011-05 Request of Denbury Onshore, LLC, applicant and Paula Gann, owner, for a special exception permitted in Section 2.7.3.7 (a) (3), of the Unified Development Code, Ordinance No. 2000-T, to allow for a resumption of a nonconforming use on the following described property 0.9183 Acres Out of Lot 21 Allison -Richey Gulf Coast Home Subdivision of Section 29 H.T. &B.R.R. Company Survey A-292, Volume 2 Page 101, Brazoria County Map Records, Brazoria County, Texas. (Located Approximately 412 ft. West of SH 35 and 630 ft. North of S. Hastings Field Rd.) Chairperson Dale Pillow read the purpose of the hearing. Planner I Ian Clowes read the staff report stating the history of the Hastings Oil Field and that the use is allowed in a Heavy Industrial Zone (M-2) with a Conditional Use Permit; however, since the property is zoned Light Industrial (M-1), a special exception is being requested to allow for a resumption of a non -conforming use. Denbury Onshore, LLC has a good track record, and they are trying to be good neighbors. There was no one to speak for or against the proposed request. There was no discussion from Staff / Board /Applicant. Chairperson Dale Pillow adjourned the public hearing for ZBA Application No. 2011-05 at 6:27 p.m. Board Member Don Glenn made the motion to approve, and Alternate Board Member Jerry Acosta seconded. Company Survey A-292, Volume 2 Page 101, Brazoria County Map Records, Brazoria County, Texas. (Located East and West of SH 35 and 630 ft. North of S. Hastings Field Rd.) Chairperson Dale Pillow read the purpose of the hearing. The vote was 5-0. ZBA Application No. 2011-06 was approved.
