2011-01-17 CITY COUNCIL SPECIAL MEETING MINUTESMINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON MONDAY, JANUARY 17, 2011, AT 7:00 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. Mayor Reid called the meeting to order at 8:25 p.m. with the following present: Mayor Mayor Pro -Tem Councilmember Councilmember Councilmember Councilmember City Manager City Secretary Tom Reid Scott Sherman Woody Owens Steve Saboe Felicia Kyle Ed Thompson Bill Eisen Young Lorfing Others in attendance: Jon Branson Assistant City Manager; Glen Turner Director of Fire Services; Roland Garcia Fire Marshal; Mike Hodge Assistant City Manager; Lee Atchison, Fire Services Captain. NEW BUSINESS: COUNCIL ACTION — RESOLUTION NO. 2011-9 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING A MEMORANDUM OF UNDERSTANDING ASSOCIATED WITH AN ALL HAZARD INCIDENT MANAGEMENT TEAM. Mr. Roland Garcia, Fire Marshal. Mayor Pro -Tem Sherman made the motion, seconded by Councilmember Saboe, to remove Resolution No. R2011-9 from the table. Voting "Aye" Councilmembers Owens, Saboe, Sherman, Kyle, and Thompson. Voting "No" None. Motion Passed 5 to 0. Mayor Pro -Tem Sherman made the motion, seconded by Councilmember Saboe, to approve Resolution No, R2011-9. City Manager Bill Eisen stated this issue was discussed at a previous Council Meeting. At that time, Council asked for more information regarding specific areas of the agreement. One question raised was the amount of time required for the City to be reimbursed in the event that Staff was deployed and the source of the reimbursement. The entity providing reimbursement would be the Texas Forest Service. Reimbursement would take approximately thirty days after required documentation has been submitted. The question was also raised as to who would be responsible in the event that a Staff was injured during deployment. The agreement provides that the Page 1 of 2 — 1/17/2011 employees remain City employees and will be covered by the City's Workers' Compensation Coverage. Liability issues would be covered under the City's Texas Municipal League Liability Policy. Councilmember Kyle stated it is good to know that the City insurance coverage expands beyond the city limits and Staff will be covered. She would like to see the State alleviate the burden from the City if the funding is available. The reimbursement information was requested to ensure the City was not responsible for any substantial amount of money for a long period of time. Councilmember Kyle further stated she will trust that any required reimbursement will be honored and completed in a timely manner. Discussion ensued between Council, City Manager Bill Eisen, and Fire Marshal Roland Garcia regarding the Resolution. Voting "Aye" Councilmembers Owens, Saboe, Sherman, Kyle, and Thompson. Voting "No" None. Motion Passed 5 to 0. ADJOURNMENT Meeting was adjourned at 8:37p.m. Minutes approved as submitted and/or corrected this the 14th day of February, A.D., 2011.
