2011-09-19 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTESMINUTES JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON SEPTEMBER 19, 2011, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS Mayor Tom Reid and P &Z Vice Chairperson Jerry Koza, Jr. called the public hearing to order at 6:37 p.m., with the following present: Mayor Tom Reid Mayor Pro Tem Ed Thompson Council Member Woody Owens Council Member Scott Sherman Council Member Felicia Kyle Council Member Susan Sherrouse P &Z Chairperson Jerry Koza, Jr. P &Z Commissioner Neil West P &Z Commissioner Henry Fuertes P &Z Commissioner Phil Cessac P &Z Commissioner Sheila Fischer Also in attendance were: City Manager Bill Eisen, Assistant City Manager Jon Branson, Assistant City Manager Mike Hodge, City Attorney Darrin Coker, Planning Director Lata Krishnarao, Senior Planner Harold Ellis, Planner II Evan DuVall and Planning Office Coordinator Judy Krajca. Senior Planner Harold Ellis explained the Joint Public Hearing process for the attending public, and explained that the Planning Zoning Commission meeting would be held after the Joint Public Hearing. Mayor Tom Reid opened the public hearing for Conditional Use Permit No. CUP 2011 10 at 6:41 p.m. CONSIDERATION POSSIBLE ACTION CONDITIONAL USE PERMIT NO. 2011- 10 A request of Mrs. Dale E. Pillow, applicant, on behalf of Adult Reading Center, Inc., owner, for approval of a Conditional Use Permit to allow for an Institution of Religious, Educational, or Philanthropic Nature (Adult Reading Center) in the Old Townsite Residential (OT -R) District, on property located at 2246 N. Washington, to wit: Legal Description: Lot Twenty -five (25), lot Twenty -six (26), lot Twenty -seven (27), lot Twenty -eight (28), lot Twenty -nine (29), lot Thirty (30), and lot Thirty -one (31), Block One (1), of PEARLAND TOWNSITE, an addition in Brazoria County, Texas, according to the map or plat thereof recorded in Volume 29, Page 41, of the Plat Records of Brazoria County, Texas General Location: 2246 N. Washington, Pearland Texas P &Z Chairperson Jerry Koza, Jr. read the purpose of hearing into the record. JPH Minutes of September 19, 2011 Page 1 of 5 Senior Planner Harold Ellis read the staff report stating the applicant wishes to expand the parking lot. Staff recommended approval. Ms. Dale Pillow, Executive Director of the Adult Reading Center, 2246 N Washington Pearland Texas spoke of their GED, and Literacy programs and a grant to convert the water heater to tankless along with other projects in order to go more Green. Ms. Pillow stated they would like to do a grass pave parking lot. Ms. Linda Cowles. President of Keep Pearland Beautiful, 3412 Shadycrest, Pearland Texas spoke in favor of the impervious parking. Mayor Tom Reid asked about the property and why only half was seeking a Conditional Use Permit. Ms. Pillow stated that it is two separate lots and have never joined the two lots. Council Member Woody Owens inquired who owned the parking lot across the street. Ms. Pillow stated it belonged to Harvest of Praise Church. The Adult Reading Center is seeking a shared parking agreement with the church, but has not been able to meet with the church. Mayor Tom Reid adjourned the public hearing for Conditional Use Permit No. CUP 2011 -10 at 6:55 p.m. Mayor Tom Reid opened the public hearing for Zone Change No. 2011 -09Z and Conditional Use Permit No. 2011 -11 concurrently at 6:55 p.m. CONSIDERATION POSSIBLE ACTION ZONE CHANGE NO. 2011 -09Z. A request of Ed R. Weatherall, applicant, on behalf of Rec -Time, Inc, owner, for approval of a zone change from the General Commercial (GC) zone and General Business (GB) zone, to General Commercial (GC) zone for 19.995 acres on the following described property, to wit: Legal Description: Minor Subdivision Plat of Rec -Time Subdivision, being a plat of part of lot 12 and all of lots 13, 14, 15, and 16 of the Dooley partition, as defined in the District Court of Harris County, Texas, Cause No. 86647 and being out of the James Hamilton Survey, Abstract No. 881, Harris County, Texas, and recorded as Film Code No. 600053, of the map records of Harris County General Location: Approximate Southeast corner of SH288 and Beltway 8, known as Advanced RV Resort Houston Pearland, 2850 S. Senior Planner Harold Ellis read the staff report stating the applicant was seeking a zone change from General Business (GB) and General Commercial (GC) to General Commercial (GC) zone for the entire parcel. Staff recommended approval; and, Senior Planner Harold Ellis read the staff report stating the applicant was seeking a Conditional Use Permt to allow for a Travel Trailer /RV Park /Campground (Long and Short Term) in the General Commercial (GC) District. Staff recommended approval. Mr. Ed Weatherall 2850 S Sam Houston parkway Houston Texas spoke of all the advertising for the RV park, their ranking as a RV Park and the positive exposure they have received. Mr. Weatherall also stated they have brochures available from the Pearland Chamber of Commerce and PEDC which brings people to Pearland to eat and shop while staying at the RV Park. There was no one present to speak for or against the Zone Change or Conditional Use Permit. Mr. Scott Sherman asked how many units would be added and how many were their currently. Mr. Weatherall stated 48 new units and currently has 150 units. Council Member Sherman asked if the drainage was already in place, and Mr. Weatherall replied yes, in Phase I. The Traffic Impact Analysis was also done for Phase I. Council Member Woody Owens asked Mr. Weatherall what most of the people were there for. Mr. Weatherall stated that many were visiting families, residents from Canada escaping the cold winters, and others were there for sports, medical and even contractors. Mr. Owens asked if Mr. Weatherall was a member of the Pearland Chamber of Commerce. Mr. Weatherall replied yes he was. JPH Minutes of September 19, 2011 Page 3 of 5 P &Z Commissioner Phil Cessac asked Mr. Weatherall how he came about having his property locked in with different zones. Senior Planner Harold Ellis explained the use was changed to General Business (GB). Originally, in 1999, the property was zoned General Commercial (GC) with a different use being proposed at that time. P &Z Commissioner Henry Fuertes asked how does staff feel about this type of business fitting into the BP -288 zoning district. Senior Planner Harold Ellis stated it does not fit in, but they are already there and there are no known issues with the current operation. Council Member Felicia Harris asked City Attorney Darrin Coker if they paid hotel /motel tax. City Attorney Coker replied they do not, but they do pay city taxes and impact fees. Mayor Tom Reid adjourned the public hearings for Zone Change No. 2011 -09Z and Conditional Use Permit No. CUP 2011 -11 concurrently at 7:12 p.m. CONSIDERATION POSSIBLE ACTION PROPOSED AMENDMENTS TO THE UNIFIED DEVELOPMENT CODE T -13 Mayor Tom Reid opened the public hearing for the Amendments to the Unified Development Code T -13 at 7:12 p.m. Planning Director Lata Krishnarao made a brief staff report stating the first reading for the UDC T -13 would be on October 10, 2011 and the second reading would be on October 24, 2011. There was no one present to speak for or against the Amendments to the UDC T -13. Council Member Felicia Harris commented on Section 2.2.3.5 after page 14, regarding the extended time period of the Conditional Use Permit (CUP), and to clarify at what point the extension begins. Ms. Harris also commented on Section 2.2.3.5, page 13 of 14, and stated subsection 5 should be changed to sub section (c). Planning Director Lata Krishnarao referred to the changes that were made after the workshop and stated she would make a note to insure this change was corrected. Council Member Woody Owens stated he did not agree that the Council should have to have a super majority vote to overrule the P &Z Commissions vote of denial, and stated he would like to see this on the next workshop agenda. Council Member Ed Thompson stated he agreed with this. Council Member Ed Thompson also inquired about the Tree Replacement Requirements. Planning Director Lata Krishnarao stated that this language was to clarify the merging of the Land Use and Urban Development Ordinance and the Tree Ordinance into the Unified Development Code.
