2011-07-18 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTESMINUTES — JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING & ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON JULY 18, 2011, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS Mayor Tom Reid and P&Z Vice Chairperson Jerry Koza, Jr. called the public hearing to order at 6:34 p.m., with the following present: Mayor Tom Reid Mayor Pro Tem Ed Thompson Council Member Woody Owens Council Member Scott Sherman Council Member Felicia Kyle Council Member Susan Sherrouse P&Z Chairperson Jerry Koza, Jr. P&Z Commissioner Neil West P&Z Commissioner Henry Fuertes P&Z Commissioner Darrell Diggs P&Z Commissioner Richard Golden Also in attendance were: City Manger Bill Eisen, Assistant City Manager Jon Branson, Assistant City Manager Mike Hodge, City Attorney Nghiem Doan, Planning Director Lata Krishnarao, Senior Planner Harold Ellis, and Planning Office Coordinator Judy Krajca. Senior Planner Harold Ellis explained the Joint Public Hearing process for the attending public, and explained that the Planning & Zoning Commission meeting would be held l after the Joint Public Hearing. Mayor Tom Reid opened the public hearing for Conditional Use Permit No. CUP 2011-09 at 6:36 p.m. CONDITIONAL USE PERMIT NO. CUP 2011-09 A request of Furniture Repair Solutions, LLC., applicant, on behalf of Michael McGibben, owner, for approval of a Conditional Use Permit to allow for a Furniture Repair Business (GB) District, on the following described property to wit: Legal Description: All of that certain 0.4784 acre tract situated in the A.C.H. & B RR Company Survey, Section 1, Abstract No. 147, Brazoria County, Texas, being the inclusive boundary of Tracts I and Il, as described in instrument filed for record in Volume 983, Page 714, of the Deed Records of Brazoria County, Texas General Location: 3520 E. Broadway, Pearland P&Z Chairperson Jerry Koza, Jr. read the purpose of the hearing into the record. JPH Minutes 07/18/2011 Page 1 of 3 Senior Planner Harold Ellis presented the staff report stating the property was currently zoned General Business (GB) and the Future Land Use Plan indicated Retail, Offices, and Services for the subject property. The site is two structures but one shopping center. A florist previously occupied this site. A CUP is required for a Furniture Repair Business to operate in the GB zone, with no outside storage or activity allowed. Two additional parking spaces are required and the applicant is willing to provide the needed spaces. Staff recommends approval of CUP 2011-09 with one condition: 1) Two additional parking spaces to be constructed on site, which can be accomplished on existing paving, by adding a stripe. Mr. Dale Jones, applicant, of 5705 Apple Springs Drive, Pearland, TX spoke briefly of starting this repair shop one year ago, while doing the repairs in his customers home; however, 50-60% of the repairs needed to be brought to a shop. Council Member Woody Owens asked why two additional parking spaces were needed in a shopping center that already existed. Senior Planner Harold Ellis stated that the parking standards were slightly higher for furniture repair shops. Council Member Woody Owens inquired if there was room to add two additional parking spaces. Senior Planner Harold Ellis replied yes, there was room on the side of the building that would involve restriping. P&Z Commissioner Neil West asked the applicant if any special equipment would be required for painting. Mr. Dale Jones replied, no.
