HELD ON JUNE 20, 2011 AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL,

Mayor Tom Reid and P&Z Chairperson Jerry Koza, Jr. opened the series of public
hearings to order at 6:34 p.m. with the following present:

Ellis, Planning Director Lata Krishnarao, and Planning Office Coordinator Judy Krajca.
Senior Planner Harold Ellis explained the Joint Public Hearing process for the attending
public, and explained that the Planning & Zoning Commission meeting will immediately
follow the Joint Public Hearing.
Mayor Tom Reid called to order the Public Hearing for Zone Change No. 2011-07Z at
6:38 p.m.
NEW BUSINESS
CONSIDERATION & POSSIBLE ACTION — ZONE CHANGE NO. 2011-07Z
A request of J.G. Meade, Executor of Myrtlee Meade Estate, owner, for approval of a
zone change from the Single -Family Residential Estate (R -E) zone, to General
Business (GB) zone for approximately 18 acres on the following described property, to
wit:
Legal Description: Field Note Description of a 20.00 Acre Tract of Land Being all of
Lots 10 and 14 of Kanawha -Texas Company Subdivision of parts of Sections 18 and

P&Z Chairperson Jerry Koza, Jr. read the purpose of the hearing into the record.
Senior Planner Harold Ellis read the staff report stating staff recommends approval of
Zone Change No. 2011-07Z.
Mr. James Gregory Massey Meade, applicant, of 4613 Buescher Court, Pearland, TX
spoke briefly of his intent to zone the entire 18.000 acres to GB, with only one person
interested in putting in a Dance School on the north end of the property.
Mr. Gerald Bare of 4005 Manvel Rd., Pearland, TX spoke in opposition to this zone
change and stated that in the past, he had requested that this property be used for a
park.
Council Member Woody Owens asked staff for clarification of what exist on the four
corners of the intersection. Senior Planner Harold Ellis stated there was a grocery store
in the SW corner in the Manvel ETJ, a Nursery in the SE Corner of the Pearland ETJ, a
residential subdivision in the NE corner, and vacant land next to a Pearland ISD school.
P&Z Commissioner Henry Fuertes asked how many acres formed the minor node at the
intersection. Senior Planner Harold Ellis stated there was 25.000 acres in the minor
node at this intersection. Mr. Fuertes asked why the intersection just north was
considered a major node. Planning Director Lata Krishnarao stated that several years
before a developer rezoned the area for a medical use and 50 acres made it into a
major node.

zone change from the Spectrum District 1 (SP1) zone, to Planned Development (PD)
zone for 11.9337 acres on the following described property, to wit:

the proposed zone change.
Mr. George Frioux of 1600 W. Merit Parkway, South Jordan, Utah spoke on behalf of
the applicant.
P&Z Chairperson Jerry Koza, Jr. stated the city needs to work on the localized drainage
plan as discussed with the Spectrum Plan before too many more business move in, or
else everyone will have their own detention pond.

2011-07 at 6:57 p.m.

A request of Steve Upham, applicant, on behalf of First Church of Pearland, owner, for
approval of a Conditional Use Permit to allow for an alternative building material (new
technology) from what is permitted by -right in the City of Pearland's Unified
Development Code for an exterior building fagade material, in the General Business
(GB) and Single -Family Residential -1 (R-1) District, on the following described property,

Senior Planner Harold Ellis read the staff report stating staff recommended denial for
the following reasons:
• The structural support and durability of the structure is not in conformance with
the UDC.
• May not be compatible with, and preserve the character and integrity of the
adjacent developments and neighborhood
• Proposed use does not appear to incorporate features to minimize adverse
effects and visual impact on adjacent properties
• The proposed use may not meet the standards of the zoning district or corridor
overlay district
Mr. Charles Johnson of 2018 Fairwood, Pearland, TX spoke on behalf of the applicant
with regards to the history of the church, and the growth they are seeing and foresee.
Mr. Tom Ostrowski of Crosspoint Architects, 12126 Kimberley Lane, Houston, TX
presented the power point on behalf of the applicant.
Mr. Derek Penn of 9800 Richmond Avenue, Suite 580, Houston, TX spoke on behalf of
Sprung Structures.
Mr. Geoff Relick of 9800 Richmond Avenue, Suite 580, Houston, TX spoke on behalf of
Sprung Structures.
Tyler Walen, Family Pastor at First Church, 2412 Dixie Farm Road, Pearland, TX spoke

Council Member Scott Sherman asked about withstanding wind, hail, snow and flying
debris. Mr. Tom Ostrowski stated damage can be repaired, patched and resealed.
Council Member Scott Sherman inquired about the aluminum structure and the
longevity of the structure; and also inquired about the length of time they foresee using
this structure -- "is it temporary or permanent?". Mr. Tom Ostrowski replied originally
they looked at using it temporarily for approximately five years. But due to the longevity
of the structure, they would like to use it permanently.
Council Member Scott Sherman inquired why they would build two other new structures
and not this one. Mr. Charles Johnson replied that this would be strict for the youth, and
the other would be an events facility and daycare.

Council Member Felicia Kyle inquired how long before the other buildings would be
constructed. Mr. Charles Johnson replied that it would be 18 to 36 months from the
current date.
Council Member Felicia Kyle asked how many of these structures were near residential
areas and what types of uses. Mr. Derek Penn replied approximately 10-20 and uses
were banquet facilities and country clubs. Council Member Kyle stated she would not
want this in her backyard. Mr. Charles Johnson stated that he lives on one of the
streets behind the First Church and the church is willing to move the structure further
from the residences.
Council Member Ed Thompson stated his concern was the noise and asked how thick
the structure was. Mr. Derek Penn stated the structure is eight inches thick and the
acoustics can be enjoyed on the inside and not overbearing on the outside.
Council Member Woody Owens stated that the size was not much different than a three
story hotel being behind your home and suggested a visit to the site to view. Council
Member Owens added that it is not a bad looking facility and is durable.
Council Member Steve Saboe asked that if this project were not in the overlay district,
would the applicant be before the Council and Commission. Senior Planner Harold Ellis
replied that zoning requires a CUP.
Council Members Saboe, Kyle and Thompson inquired about the Building Officials
comments and if it was relevant in the P&Z Commission making a decision. Senior
Planner Harold Ellis stated that the Planning staff and the Building Official met with
Sprung Structures and based on what was said in the meeting, the applicants have
indicated that the structure would comply with the IBC requirements but documents
indicating this has not been provided.
Discussion ensued over the corridor overlay district, the adjoining neighbors and their
concerns, new technology, and the fapade requirements.

There was no one present to speak for or against the proposed Conditional Use Permit.
Council Member Woody Owens stated he was in favor of the CUP.
