Senior Planner Angela Gantuah explained the Joint Public Hearing process for the
attending public, and explained' that the Planning & Zoning Commission meeting will
immediately follow the Joint Public Hearing.
Mayor Tom Reid called to order the Public Hearing for Conditional Use Permit No.
2010-05 at, 6:38 p.m.
A requiest of Shawn McDonald, applicant, on behalf of Allison Investments LLC.,
owners of 1855 Cullen Blvd. Suite 304, for a conditional use permiit for a health
club/gym, being located in, the Cullen Mixed -Use (C -MU) Zoning District, on the
following described property, to wit
Legal Description: Approximately 4,9;990 Acre Tract of Land being the north one-half
lot 3 of the Allison Richey Gulf Coast Home company Suburb Gardens Subdivision

Steven and' Katherine Blanchard of 5107 Blanco Dr., Pearlan'd, Texas stated that thiis is
not your typical health fitness club.
P&Z Commissioner Henry Fuertes asked how the health club fit into the Cullen Mixed -
Use District. It was his understanding that in the recent Future Land Use Plan Study
that the use was more retail. Senior Planner Angela Gantuah stated the use was in
line with, the UDC, and has set hours of business.

Mayor Tom Reid opened the Public Hearing for Zone Change No. 2010-02Z at 6:47
p.m.
A request of Claudia S. Wright, applicant, on behalf of George David Scott, owner, for
approval of a zone change from Single Family Residential -11 (R-1) Zoning District to
Office Professional (OP) Zoning District, on the following described property, to wit:
Legal Description: Approximately 5.63 acres of land out of Lot 29 of Walcott's Pearland
Subdivision, as recorded in Volume 35, Page 241 of the Deed: Records of Brazoria
County Texas and, a tract of land containing 0.3247 acre (14,145 square feet) being out
of Lot 29 of Walcott's Pearland Subdivision according to the Map or Plat Recorded in
Volume 35,, Page 241 and 242 of the Brazoria County Deed, Records (B.C.D.R.). Said
0.3247 Acre Tract also being part of a certain called 74,986 Acre Tract Recorded in
Brazoria County Clerk's File Number (B.C.C. F.) No. 94-040206.

Senior Planner Angela Gantuah presented the staff report and stated staff
recommends approval. Staff did not receive any public comments.
There was no one present to speak for or against the zone change.
There was much discussion with regards to the ingress and egress of the property.
Council Member Ed Thompson expressed concern and inquired where the driveway

access would be located. City Engineer Narc:iso Lira stated the school' district would
not agree to a shared parking agreement and so the applicant would have to use the
most western portion of the acreage for access. Further discussion ensued.

PZ Coissioner Neil West stated that maybe staff should require a traffic study
before considering. City Engineer Narci,so Lira stated that staff did have their Traffic:
Engineer look at this site and fe!lt the most western entrance of the property would be
okay.
