2008-10-06 PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTESMINUTES OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD OCTOBER 6, 2008 AT 6:30 P.M., IN THE ENGINEERING CONFERENCE ROOM, COMMUNITY CENTER, CITY HALL, 3523 LIBERTY DRIVE, PEARLAND, TEXAS CALL TO ORDER P&Z Chairperson Henry Fuertes called the meeting to order at 6:39 p.m. with the following present: P&Z Chairperson Henry Fuertes P&Z Commissioner Susan Sherrouse P&Z Commissioner Neil West P&Z Commission Ron Capehart P&Z Commissioner Darrell Diggs (arrived at 6:48 p.m.) Also in attendance were: Planning Director Lata Krishnarao, Plans and Plat Administrator Richard Keller, Planner Tim Chi, Deputy City Attorney Nghiem Doan, and Planning Administrative Secretary Judy Krajca. APPROVAL OF MINUTES P&Z Commissioner Susan Sherrouse made the motion to approve the minutes of August 18, 2008, and P&Z Commissioner Ron Capehart seconded. The vote was 4-0. The minutes of August 18, 2008 were approved. P&Z Commissioner Ron Capehart made the motion to approve the minutes of September 22, 2008, and P&Z Commissioner Neil West seconded. The vote was 4-0. The minutes of September 22, 2008 were approved. NEW BUSINESS CONSIDERATION & POSSIBLE ACTION — Preliminary Plat of Ridge Rock Street Dedication and Detention Reserve A request by Christy Smidt, Kerry R. Gilbert & Associates, Inc., for Trails Development, Ltd., owner, for approval of a preliminary subdivision plat of 5.6 acres zoned Planned Unit Development. The applicant is proposing street right- of-way and six reserves located south of Broadway west of Kirby Drive and the property is described as follows: Being 5.6 acres out of the H. T. & B. R.R. Co. Survey Sec. 80 also known as the J. S. Talmage Survey A-564, City of Pearland, Brazoria County, Texas. P&Z Commissioner Susan Sherrouse made the motion to approve, and P&Z Commissioner Ron Capehart seconded. The vote was 4-0. The Preliminary Plat of Ridge Rock Street Dedication and Detention Reserves were approved. CONSIDERATION & POSSIBLE ACTION — Preliminary Plat of Lakes at Highland Glen Section Six A request by C. L. Davis, RPLS, C. L. Davis & Co., for Beazer Homes Texas, L.P., MHI Partnership, Ltd., and Newmark Homes, L.P., owners, for approval of a preliminary subdivision plat of 26.4967 acres zoned Planned Unit Development. The applicant is proposing 53 lots in 6 blocks and 9 reserves located east of Pearland Parkway at Forest Park Lane and the property is described as follows: Being 26.4967 acres out of the D.H.M. Hunter Survey, A-76, City of Pearland, Brazoria County, Texas. Plans and Plat Administrator Richard Keller stated that all outstanding items have been corrected, and staff recommends approval. P&Z Commissioner Ron Capehart made the motion to approve, and P&Z Commissioner Susan Sherrouse seconded. The vote was 4-0. The Preliminary Plat of Lakes at Highland Glen Section Six was approved. CONDUCT PUBLIC HEARING — Replat of Lots 1, 2, and 3 of Brazoria County Industrial Park Phase 1 A request by Armando Martinez, Jr., True Meridian, for Pearland Investment Partners, LLC, owner, for approval of a replat of Lots 1, 2, and 3 of Brazoria County Industrial Park Phase 1 zoned Heavy Industrial, M-2. The applicant is proposing one lot located at the northwest corner of Main Street (State Highway 35) and Industrial Drive and the property is described as follows: Being Lots 1, 2, and 3, 3.712 acres, of Brazoria County Industrial Park Phase 1, City of Pearland, Brazoria County, Texas. P&Z Chairperson Henry Fuertes opened a public hearing for the Replat of Lots 1, 2, and 3 of Brazoria County Industrial Park Phase 1 at 6:43 p.m. P&Z Chairperson Henry Fuertes read the purpose of the hearing. Page 2 of 5 P&Z Minutes 100608 Plans and Plat Administrator Richard Keller read the staff report summarizing that the replat was to make 3 lots into 1 lot. The applicant was not present to speak. There was no one present to speak for or against the replat. DISCUSSION ITEM — Letter from P&Z Commissioner Neil West P&Z Commissioner Darrell Diggs arrived at 6:48 p.m. P&Z Commissioner Neil West read parts of his letter, recapping that the Commission needs to follow procedures and direct all questions to the Chairperson. Mr. West also brought up the traffic problem in Pearland. Planning Director Krishnarao stated that a workshop has been set for October 20, 2008 with the City Engineer Narciso Lira and the Traffic Engineer Mr. Samson Ukaegbu to discuss traffic impact analysis and requirements. Ms. Krishnarao also stated that a discussion would ensue about a case in Flower Mound, Texas with regards to how cities have to be careful in requiring improvements. P&Z Chairperson Henry Fuertes commented that while the Commission was in Las Vegas, Nevada last April for the National APA Conference, they had the Page 3 of 5 P&Z Minutes 100608 opportunity to visit a mock P&Z meeting. Mr. Fuertes observed that it was a very formal meeting, and agreed that while being on the Commission the last two years in Pearland, the meetings have slacked off. P&Z Commissioner Neil West stated that the Commission has not been active in the community. P&Z Chairperson Henry Fuertes stated that a few months back, P&Z Commissioner Charles Gooden, Jr. had asked about the Commission actually doing some planning. Planning Director Lata Krishnarao stated that the Commission reviews the Capital Improvement Plan on a yearly basis, the Thoroughfare Plan, and the Comprehensive Plan is revisited every 10 years. Ms. Krishnarao added that in growing cities like us, the Comprehensive Plan is reviewed every five years. The City of Pearland reviewed the Comprehensive Plan in 1999, and revisited it in 2004. An update is in progress now. Three areas that are being looked at in the Comprehensive Plan are: current land use, future land use, and property zoning. Planning Director Krishnarao asked the Commission for some guidelines on what they want to learn. P&Z Chairperson Henry Fuertes offered that each Commissioner take specific roads/areas to study and become knowledgeable with that location. The biggest issue that seems to come up at meetings is buffering questions. P&Z Commissioner Neil West stated that if Commissioner Gooden, Jr. is interested, he should form a committee and set up directions he wants the city to take, and he should offer comments. Mr. West stated he was willing to serve on a committee. Commissioner Ron Capehart seconded his comment stating he also would be willing to serve on a committee, as did Commissioner Susan Sherrouse. P&Z Commissioner Darrell Diggs questioned the issue of four or more Commissioners being on a Committee together resulting in a quorum, and the need to post this. Deputy City Attorney Nghiem Doan stated that we would have to post a notice. Commissioner Diggs commented that suggestions be added at the meeting for all to listen to. Possibly done as a workshop. There was some discussion of a sub -committee being formed, and Deputy City Attorney Doan stated that a sub -committee could be formed, but if lengthy discussions ensued, the Commission may as well hold a workshop to discuss with the entire group. P&Z Commissioner Neil West spoke of several committees he has chartered over the years and stated that at first, they usually are not favorable, but eventually come around to voting for the idea. Page 4 of 5 P&Z Minutes 100608 The topic returned to the formality of the meetings, and Deputy City Attorney Nghiem Doan invited the Commissioners to attend a Zoning Board of Adjustment meeting. Mr. Doan stated that the topics are opened and followed thoroughly, and that they are always very efficient meetings. P&Z Chairperson Henry Fuertes stated that he needs to work harder to keep the meeting in control, and noted that everyone should address the Chairperson and that the Chairperson would address the Commission. Deputy City Attorney Doan stated that the Commission has the right to speak up, but lengthy discussions can drag out a meeting. DISCUSSION ITEMS Planning Administrative Secretary Judy Krajca went over the upcoming meeting and training scheduled for October 20, 2008, and spoke of the change in the Texas APA Conference. Commissioners Sherrouse, West, and Diggs all stated they would like to attend the EI Paso Conference in February 2009. Chairperson Fuertes stated he hopes to attend and asked to register him, but hold, off on making travel arrangements. Commissioner Capehart will not be attending the conference.
