2008-04-21 CITY COUNCIL AND PLANNING AND ZONING COMMISSION JOINT PUBLIC HEARING MEETING MINUTESMINUTES OF THE JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON APRIL 21, 2008, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS CALL TO ORDER The public hearing was called to order at 7:12 p.m. Mayor Tom Reid opened the hearing for the City Council and for the Planning and Zoning Commission, with the following present: Mayor Tom Reid Council Member Kevin Cole Council Member Helen Beckman Council Member Woody Owens Council Member Felicia Kyle P & Z Chairperson Henry Fuertes P & Z Vice -Chairperson Jerry Koza, Jr. P & Z Commissioner Neil West P & Z Commissioner Susan Sherrouse P & Z Commissioner Darrell Diggs P & Z Commissioner Charles Gooden, Jr. P & Z Commissioner Ron Capehart Also in attendance: City Manager Bill Eisen; Assistant City Manager Nick Finan; Assistant City Manager Mike Hodge; City Attorney Darrin Coker; Deputy City Attorney Nghiem Doan; City Engineer Narciso Lira; Planning Director Lata Krishnarao; Senior Planner Theresa Grahmann; and Planning Administrative Secretary Judy Krajca. Senior Planner Theresa Grahmann explained the Joint Public Hearing process for the attending public, and explained that the Planning & Zoning Commission Meeting would be following the Joint Public Hearing. The public hearing for Conditional Use Permit No. CUP2008-15 was opened at 7:15 p.m. CONSIDERATION & POSSIBLE ACTION — Conditional Use Permit No. CUP2008-15 A request by Houston Flex Fuels, LLC, applicant for American Rice Growers Cooperative, Inc., owner, for approval of a Conditional Use Permit for a "bio - diesel plant" in the Light Industrial District (M-1), on the following described property, to wit: Legal Description: 6.2244 acres of land, Abstract 232, H.T. & B.R.R. Company Survey, Tract 28A-39, City of Pearland, Brazoria County, Texas General Location: Generally Located on the South Side of Halik Road, and Approximately 1,100 Feet West of State Highway 35 (Main Street) Page 1 of 4 JPH Minutes 4-21-08 Senior Planner Grahmann read the staff report with staff recommending approval. Staff did not receive any public comment forms. Mr. Mark Bateman of Houston Flex Fuels, LLC, 3306 Ashland Grove, Sugar Land, Texas spoke on behalf of the applicant. Mr. Bateman stated this business would bring in approximately 15-18 new jobs over the next few years. Houston Flex Fuels will do all cleanup of the existing facility, before putting in the new facility. Krysle Dolen, owner of 7 acres on Halik Road, Pearland, Texas spoke neither in favor or opposition, but with concern to the type of traffic, and the condition of the roads, along with the responsibility of the maintenance of the roads. Council/Commission/Staff discussed the issue of the roads, with staff stating a traffic impact analysis would be done, and that staff would need to look into the maintenance of the roads. Council Member Beckman stated she was in favor of the permitted use. P&Z Commissioner Diggs brought up the concern of safety, with Mr. Bateman addressing the issue that the facility would be up to code including sprinklers and safety measures in place. P&Z Commissioner Koza, Jr. brought up the issue of the transportation of the bio -diesel fuel. Mr. Bateman stated that most of it would come in by rail, but would be shipped out by rail and by 18 -wheelers. Council Member Kyle inquired about the types of odors that might be emitted and would the community smell the methanol. Much discussion ensued with Council Member Kyle stating her question of, will the community smell this. Mr. Bateman replied no. Council Member Cole brought up the issue of the toll road from McHard, down to Mykawa possibly crossing over the tracks in this area and the applicant needed to be aware of this. The public hearing for Conditional Use Permit No. CUP2008-15 was adjourned at 7:49 p.m. The public hearing for Zone Change No. 2008-09Z was opened at 7:50 p.m. CONSIDERATION & POSSIBLE ACTION — Zone Change No. 2008-09Z P&Z Chairperson Fuertes read the purpose of the hearing. Page 2 of 4 JPH Minutes 4-21-08 A request by Alan Mueller, applicant for Claudia Blakemore, owner, for an amendment to Ordinance No. 2000M, the Zoning Map of the City of Pearland, for approval of a change in zoning district from classification Spectrum District (SPD) District S5: The Light and Heavy Industrial District to Office and Professional District (OP), on the following described property, to wit: Legal Description: 1.00 acres of land, out of the S.G. Haynie Survey, Abstract 362, City of Pearland, Harris County, Texas General Location: Generally Located on the East Side of Almeda School Road, and Approximately 2,500 Feet North of Shadow Creek Parkway Alan Mueller, applicant, of 4201 Broadway, Pearland, TX spoke. Claudia Blakemore, owner, of 15117 Almeda School Road, Pearland, TX spoke. There was no one present to speak for or against the zone change. Council Member Cole stated he supported this zone change. Council Member Owens also voiced his support of this zone change. Commissioner Diggs asked if this was considered spot zoning, and could this be permitted without involving the zoning. Council stated they had no problem at this time, but change will probably come, and that change in that area might affect the Blakemore's property. The public hearing for Zone Change No. 2008-09Z was adjourned at 8:21 p.m. The public hearing for Zone Change No. 2008-10Z was opened at 8:21 p.m. CONSIDERATION & POSSIBLE ACTION — Zone Change No. 2008-10Z P&Z Chairperson Fuertes read the purpose of the hearing. A request by Kerry R. Gilbert and Associates, applicant for Beeman Strong, owner, for an amendment to Ordinance No. 2000M, the Zoning Map of the City of Pearland, for approval of a change in zoning district from classification General Business Retail District (GB), Single Family Residential — 3 District (R-3), and Single Family Residential — 2 District (R-2) to Planned Development District (PD), on the following described property, to wit: Legal Description: 53.342 acres of land, in the Thomas J. Green Survey, Abstract 198, and being a portion of that certain called 118.755 acre tract of land described as Tract 2 in the deed recorded in Volume 1421, Page 25, of the Brazoria County Deed Records, City of Pearland, Brazoria County, Texas Page 3 of 4 JPH Minutes 4-21-08 General Location: Generally Located at the Northwest Corner of FM 518 (Broadway Street) and Pearland Parkway Planning Director Krishnarao read the staff report listing the 18 additional comments based on comments received at the joint workshop. Kerry Gilbert of Kerry R. Gilbert and Associates, applicant, of 23501 Cinco Ranch Blvd, A-250, Katy, TX spoke. Mr. Gilbert stated they were not interested in complying with the first two items pertaining to Connectivity and Amenities for the Retail Strip Center for safety reasons. Mr. Gilbert added that in regards to the Connectivity, there would be too many trucks in the back of the shopping center and this would be unsafe for pedestrian's crossing over from the Whispering Winds Apartments. In regards to the amenities, Mr. Gilbert stated he would be adding water amenities and benches but not a play area, due to traffic. There was no one present to speak for or against the zone change. Council Member Cole agreed with Mr. Gilbert, stated that most residents do not like connectivity. Council Member Owens agreed with Council Member Cole.
