2008-08-18 CITY COUNCIL SPECIAL MEETING MINUTESMINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON MONDAY, AUGUST 18, 2008, AT 6:00 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. SECTION 551.074 — PERSONNEL MATTERS — REGARDING THE APPOINTMENT OF MUNICIPAL COURT JUDGES. City Council. 2. NEW BUSINESS (CONTINUED): Council returned from Executive Session at 6:41 p.m. Page 1 of 3 — 8/18/2008 Mayor Reid called for a recess at 6:41 p.m. Mayor Reid called the Special Meeting back to order at 7:03 p.m. COUNCIL ACTION — RESOLUTION NO. R2008-116 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, CONSENTING TO A GROUNDWATER REDUCTION AGREEMENT BETWEEN THE FORT BEND FRESHWATER SUPPLY DISTRICT NO.1 AND THE NORTH FORT BEND WATER AUTHORITY. Mr. Darrin Coker, City Attorney. Councilmember Cole made the motion, seconded by Councilmember Kyle, to approve Resolution No. R2008-116. City Attorney Darrin Coker stated Fort Bend Freshwater Supply District No. 1 is located partially within the City of Pearland Extraterritorial Jurisdiction ETJ because of an ETJ apportionment agreement with the City of Arcola. The Fort Bend Freshwater Supply District No. 1 is now seeking to enter into an agreement with the North Fort Bend Water Authority to allow them to participate in a ground water reduction program. The City does not have the ability to serve this area at this time and it is mandated by the Fort Bend Subsidence District that they transition to a ground water reduction program. The agreement with North Fort Bend Water Authority is the most logical way to enable the District to meet this transition requirement. Mayor Reid stated the Fort Bend Freshwater Supply District did not have the time constraints of Fort Bend County to contend with; they would not be approaching the City for approval of this item. Discussion ensued between Council and City Attorney Darrin Coker regarding the Resolution. Voting "Aye" Councilmembers Owens, Saboe, Beckman, Kyle, and Cole. Voting "No" None. Motion Passed 5 to 0.
