2007-05-07 CITY COUNCIL SPECIAL MEETING MINUTESMINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON MAY 7, 2007 AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. Mayor Reid called the meeting to order at 7:30 p.m. with the following present: Mayor Tom Reid Councilmember Kevin Cole Councilmember Helen Beckman Councilmember Felicia Kyle Councilmember Steve Saboe City Manager Bill Eisen City Attorney Darrin Coker Deputy City Secretary Sonia Blair Absent: Mayor Pro -Tem Richard Tetens Others in attendance: Mike Hodge Assistant City Manager. NEW BUSINESS COUNCIL ACTION — RESOLUTION NO. R2007-68 — A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, REINFORCING THE CITY'S POLICY OF PROHIBITING THE CONNECTION OF NEIGHBORHOOD COLLECTOR STREET STUB -OUTS TO COLLECTOR STREETS LOCATED IN ADJOINING NEIGHBORHOODS. Mr. Bill Eisen, City Manager. Councilmember Cole made the motion, seconded by Councilmember Kyle, to approve Resolution No. R2007-68. Green Tee Terrace Home Owners Association President Doug Smith stated there is a development being done next to the Green Tee Terrace Subdivision. The developer has given them a verbal guarantee that he will not connect the streets between the two neighborhoods, but has bulldozed an area that appears to be the beginning of a connection. The Green Tee Terrace Subdivision would like Council to pass the Resolution prohibiting the connection of neighborhood collector street stub -outs and allow the Green Tee Terrace Subdivision to build a permanent barricade to block any future connections. Mayor Reid stated he felt the City would need to review the plans for the structure before it would be able to approve anything. Councilmember Cole stated he understand that the developer would have to get approval from the City to connect the streets between the two neighborhoods. He feels it is important to memorialize how the current Council opposes this type of action. Page 1 of 2 — 5/7/2007 City Attorney Darrin Coker stated an Ordinance has been passed that would allow an encroachment to be approved administratively. Councilmember Cole stated, in addition to the Green Tee Terrace issue, the residents in the Shadycrest Subdivision are also having an issue with a Pearland Parkway connection. He would like to amend his motion to change the Ordinance to prohibit the connector streets in Green Tee Terrace and Shadycrest. Discussion ensued between Council and City Attorney Darrin Coker regarding the Resolution. Councilmember Cole made the motion, seconded by Councilmember Saboe, to amend Resolution No. R2007-68 to prohibit the connection of any street stub -out street in the Green Tee Terrace Subdivision and the Shadycrest Subdivision. Voting "Aye" Councilmembers Saboe, Beckman, Kyle, and Cole. Voting "No" None. Motion Passed 4 to 0, with Councilmember Tetens absent. Mayor Reid called for a vote on the amended motion. Voting "Aye" Councilmembers Saboe, Beckman, Kyle, and Cole. Voting "No" None. Motion Passed 4 to 0, with Councilmember Tetens absent.
