COUNCIL CHAMBERS OF CITY HALL 3519 LIBERTY DRIVE PEARLAND, TEXAS I. CALL REGULAR MEETING TO ORDER The Regular Meeting was called to order at 6:04 pm. with the following in attendance: Chairperson Dale Pillow Board Member Kerry Mohammadian Board Member Marvin Elam Board Member Willard Briley Board Member Don Glenn Also in attendance were Planner I Diana DuCroz, Deputy City Attorney Nghiem Doan, and Planning Administrative Secretary Judy Krajca. II. APPROVAL OF MINUTES: May 4, 2006 —Public Hearing Board Member Don Glenn made the motion to approve the minutes, and Board Member Willard Briley seconded. The vote was 5-0 for approval. III. NEW BUSINESS A. VARIANCE APPLICATION NO. 06-05 1. CONDUCT PUBLIC HEARING Chairperson Dale Pillow called the public hearing to order at 6:05 p.m. a. PURPOSE OF HEARING Chairperson Dale Pillow read the purpose of hearing as follows: A request by Blaine Falzon, applicant, for FWG Partners, Ltd, owner, for a variance from the requirements of Section 23.2(f) Fence Regulations of the Land Use and Development Ordinance of said City, on the following described property, to wit: Page 1 of 3 - Minutes - July 6, 2006 Lot C, Whispering Winds, Section Two, according to the map or plat thereof recorded in Volume 19, Pages 163 & 164, Plat Records of Brazoria County, Texas (2911 Broadway). b. STAFF REPORT Planner DuCroz gave the staff report stating that after the site plan was approved and construction had started, it was discovered that a city water line was located along the rear of the property, underneath the future location of the masonry wall. Even though the applicant was willing to construct the masonry fence, the city was concerned that the fence's foundation would damage the water line. The applicant is requesting that a variance be granted that would allow them to install a landscaping screen instead of a masonry wall. Staff recommends approval as the applicant is unable to build a masonry fence, at no fault of their own. Staff received no Public Comment forms. C. APPLICANT PRESENTATION The applicant was present but did not speak. d. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST There was no one present to speak for or against this variance request. e. STAFF/BOARD/APPLICANT DISCUSSION There was no comment from the Board/Staff. f. ADJOURNMENT OF PUBLIC HEARING Chairperson Pillow called for the hearing to be adjourned at 6 :09 p.m. 2. CONSIDER VARIANCE APPLICATION NO. 06-05 Board Member Kerry Mohammadian made a motion to approve Variance No. 06-05, and Board Member Marvin Elam seconded the motion. The vote was 5-0. The variance was approved. III.
