2006-05-22 CITY COUNCIL SPECIAL MEETING MINUTESMINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON MAY 22, 2006, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. Mayor Pro -Tem Cole called the meeting to order at 6:30 p.m. with the following present: Mayor Pro -Tem Councilmember Councilmember Councilmember Councilmember City Manager City Attorney City Secretary Absent: Mayor Tom Reid Kevin Cole Richard Tetens Woody Owens Larry Marcott Steve Saboe Bill Eisen Darrin Coker Young Lorfing Others in attendance: Assistant City Manager Nick Finan; Assistant City Manager Mike Hodge; and EMS Director Jeff Sundseth. NEW BUSINESS COUNCIL ACTION — RESOLUTION NO. R2006-65 — A RESOLUTION AND ORDER OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE GENERAL AND SPECIAL ELECTION HELD IN THE CITY OF PEARLAND, TEXAS, ON MAY 13, 2006. Mr. Bill Eisen, City Manager. Councilmember Tetens made the motion, seconded by Councilmember Marcott, to approve Resolution No. R2006-65. That the election described was duly called and notice thereof given in accordance with law; that said election was held in the manner required by law; that due returns of said election have been made by the proper officers; and it appeared from said returns, duly and legally made, that there were cast at such election 1,142 valid and legal votes; and that said election resulted in the following vote totals: FOR MEMBER OF THE COUNCIL, POSITION NUMBER TWO (2) NAME OF CANDIDATE NUMBER OF VOTES RECEIVED PERCENTAGE Helen Beckman 808 70.75% Page 1 of 4 —5/22/2006 FOR MEMBER OF THE COUNCIL, POSITION NUMBER FOUR (4) NAME OF CANDIDATE NUMBER OF VOTES RECEIVED PERCENTAGE Randy L. Patro 483 45.39 % Felicia Kyle 581 54.61 % PROPOSED CHARTER AMENDMENTS AMENDMENT NO. 1 AMENDING SECTION 1.02 FOR 745 .71.98% AGAINST 290 28.02% AMENDMENT NO. 2 AMENDING SECTION 3.01 FOR 766 74.95% AGAINST 256 25.05% AMENDMENT NO. 3 AMENDING SECTION 3.08 FOR 922 87.39% AGAINST 133 12.61% AMENDMENT NO. 4 AMENDING SECTION 6.13 FOR 867 85.08% AGAINST 152 14.92% AMENDMENT NO. 5 AMENDING SECTION 6.14 FOR 898 87.70% AGAINST 126 12.30% SECTION II. The City Council of the City of Pearland, Texas, hereby officially and affirmatively declares that the results as shown above are the real and true results of the election held on May 13, 2006, within the City of Pearland, Texas, that the candidate elected for Member of Council, Position Number Two (2) is declared to Helen Beckman and the candidate elected for Member of the Council, Position Number Four (4) is declared to Page 2 of 4 —5/22/2006 be Felicia Kyle, and said above parties are hereby declared duly elected to said respective offices, subject to taking of their Oaths of Office and Statements of Elected Officers as provided by the laws of the State of Texas. SECTION III. The City Council of the City of Pearland, Texas, hereby officially and affirmatively declares that Amendment Numbers 1 through 5 (attached hereto as Exhibit "A" passed. Voting "Aye" Councilmembers Tetens, Owens, Cole, Marcott, and Saboe. Voting "No" None. Motion Passed 5 to 0. MAYOR PRO -TEM ISSUANCE OF CERTIFICATE OF ELECTION TO NEWLY ELECTED OFFICIALS. Mayor Pro -Tem Cole. Mayor Pro -Tem Cole presented Helen Beckman and Felicia Kyle with a Certificate of Election. ADMINISTRATION OF OATH OF OFFICE TO NEWLY ELECTED OFFICIALS. Hon. Judge K. Randall Hufstetler. Brazoria County Judge K. Randall Hufstetler administered the Oath of Office to Councilmember Helen Beckman for Council Position No. 2 and Councilmember Felicia Kyle for the position No. 4. Councilmember Marcott stated six years and thirteen days ago, he was elected to his seat on Council for the first time and later the second time. At that time he was going on the basis of growth, infrastructure and communications and he feels that it has been one heck of a ride. Pearland was 37,000 people back then and now the City has over 70,000 people. That is a lot of growth and a lot of things have transpired. One of his issues was to continue to have a small town feel in Pearland and keep the integrity of the neighborhoods. The tax base was another issue and it has been worked in the right way. Pearland has and is moving in the right direction with its growth and has many completed and ongoing projects for improvement. He hopes the new Council will continue to move forward in a positive direction. He would like to thank the Citizens, his wife and Council for the last six years, he has enjoyed serving the City of Pearland. Councilmember Owens stated the last six years has been trying and challenging, but it has also been a lot of fun. Many good things have been achieved and all of it has been done without one tax increase. The Council has done a good job achieving the goals of Page 3 of 4 —5/22/2006 the City. The City of Pearland has one of the best Volunteer Fire Stations around and now it has the equipment to go with it. The staff members of the City have worked hard along with the Council and the community has been improved and become a great city to live in. He has enjoyed serving the City of Pearland for the last six years and is proud that he was able to be a part of it. Councilmember Larry Marcott stated when he was sworn in six years ago, Councilmember Tetens stated that the decision Council makes have ever -lasting impact on the City. He has tried to think of this during the time he served on Council and hope the new Council will remember this as they go through their terms. COUNCIL ACTION — ELECTION OF MAYOR PRO -TEM. City Council. Councilmember Saboe made the motion, seconded by Councilmember Beckman, to elect Richard Tetens Mayor Pro -Tem. Voting "Aye" Councilmembers Cole, Kyle, Beckman, and Saboe. Voting "Abstain" Councilmember Tetens. Voting "No" None. Motion Passed 4 to 0, with 1 abstention.
