2006-06-19 CITY COUNCIL PUBLIC HEARING MEETING MINUTESMINUTES OF A PUBLIC HEARING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON JUNE 19, 2006, AT 6:00 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. Mayor Reid called the meeting to order at 6:05 p.m. with the following present: Mayor Tom Reid Councilmember Kevin Cole Councilmember Helen Beckman Councilmember Felicia Kyle City Manager Bill Eisen City Attorney Darrin Coker City Secretary Young Lorfing Absent: Mayor Pro -Tem Tetens and Councilmember Saboe Others in attendance: Public Works Director Danny Cameron; Director of Finance Claire Manthei; Interim Project Director Jennifer Phan; and Executive Director of Economic Development Corporation Fred Welch. PURPOSE OF HEARING — PUBLIC COMMENT AND TESTIMONY REGARDING THE ABANDONMENT OF UNUSED PORTION OF THE SCOTT STREET RIGHT-OF-WAY LOCATED BETWEEN STATE HIGHWAY 35 AND MYKAWA ROAD. Mr. Darrin Coker, City Attorney. STAFF REVIEW OF THE ADOPTION OF ABANDONMENT OF UNUSED PORTION OF THE SCOTT STREET RIGHT-OF-WAY LOCATED BETWEEN STATE HIGHWAY 35 AND MYKAWA ROAD. Mr. Darrin Coker, City Attorney. City Attorney Darrin Coker stated the purpose of the Public Hearing is for the abandonment of a right-of-way easement. By City Ordinance the City Council is required to hold a Public Hearing prior to considering the abandonment of an existing roadway. This 40 -foot roadway easement is located to the North of McHard Road overpass and to the east of Mykawa Road. Chem Central, who is trying to market the property to Bison Lumber to be used as a lumberyard, owns the property. There is a 40 -foot roadway easement that bisects the property and the property is located within a 50 -foot water and sewer easement that belongs to the City and has utilities there. A meeting was held with the property owner and Public Works Director Danny Cameron. Staff has no opposition to the proposed use of the land. Bison Lumber has also been working with the Pearland Economic Development Corporation. The City would retain the 50 -foot water and sewer easement. Staff does not have any objections to the abandonment of the 40 -foot easement; however, the property owner would be required to execute protective covenants that would protect the City from any liabilities and hold the owner financially responsible for any work that needs to be done on the property. COUNCIL/STAFF DISCUSSION Councilmember Kyle asked if the issue of the protective covenant had been raised with the property owner and if he has agreed to it. City Attorney Darrin Coker stated the issue has been raised and the property owner has agreed to the arrangement. This item is scheduled to be on the Council Agenda on June 26, 2006 as an Ordinance with the protective covenants as exhibits. The Ordinance would not become effective until the protective covenants were in place. Councilmember Kevin Cole asked if the whole property is being used for the lumberyard and if the property will need to be re -platted. City Attorney Darrin Coker stated the entire property will be used for the lumberyard and he is not sure if the property will need to be re -platted.
