TEXAS, HELD ON AUGUST 21, 2006, AT 6:30 P.M., IN THE COUNCIL
CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS
CALL TO ORDER
The public hearing was called to order at 6:35 p.m. Mayor Tom Reid opened the
hearing for both the City Council and the Planning and Zoning Commission, with
the following present:

P&Z Vice Chairperson Sheryl Greiner arrived at 7:26 p.m.
Senior Planner Theresa Grahmann explained the Joint Public Hearing process
for the attending public, and explained that the Planning & Zoning Commission
Meeting will immediately follow the Joint Public Hearing in the 2nd floor
conference room.
Mayor Reid opened the hearing for CUP 2006-7 at 6:38 p.m.
PURPOSE OF HEARING
A. CONDITIONAL USE PERMIT NO. 2006-7
A request by Jung H. Kwak, owner, for approval of a Conditional Use
Permit for an "Indoor Commercial Amusement" facility in the Cullen Mixed
Use District (C -MU), on the following property located at located on the
West Side of Cullen Boulevard, and Approximately 750 Feet North of FM
518 (Broadway Street)

Senior Planner Grahmann read the Staff report. Staff recommends
approval of the CUP. Staff received no public comment forms.
Mr. Kelly Hejtmanciz, the tenant, of 2710 Pedernales Falls Dr., Pearland,
Texas spoke on behalf of the owner, enlightening the Council and
Commission of what they seek to bring in.
The following spoke in favor of the facility: Mr. Eric Burch of 6802
Kevincrest Dr., Pearland, Texas; Mr. Jerry Silva of 2719 Livingston Dr.,
Pearland, Texas, They each boisted what a great establishment this would
be for family and friends. Mr. Jung H. Kwak, owner, of 2621 Sunfish Dr.,
Pearland, Texas. Spoke in favor of the business. His feelings were this
facility would improve the area.
There was some discussion from the Council and Commission, all in favor
of the idea. Mayor Reid asked Staff if there would be sufficient parking
spaces, and Ms. Grahmann replied that all requirements have been met.
The Public Hearing for Conditional Use Permit No. CUP 2006-7 was
adjourned at 6:51 p.m.
The Public Hearing for Conditional Use Permit No. 2006-8 opened at 6:52
p.m.
B. CONDITIONAL USE PERMIT NO. 2006-8
A request by Mays and Company, applicant for Sherwood Pearland CVS,
L.P., owner, for approval of a Conditional Use Permit for a "Minor Auto
Repair" facility in the General Business Retail District (GB), on the
property located on the South Side of FM 518 (Broadway Street), and
Approximately 600 Feet West of Pearland Parkway
P&Z Chairperson Sandars read the purpose into the record.
Senior Planner Grahmann presented the Staff Report. Ms. Grahmann
explained the difference between a Minor Auto Repair and a Major Auto
Repair facility. Staff recommends approval. There were no public
comment forms received.
The applicant was not present to speak.
There was no one present to speak for or against the Conditional Use
Permit.
There was much discussion about the driveway and issues of ingress and
egress. Councilmember Kyle stated that she discourages any outdoor
storage display, and expressed concern with eighteen wheeler vehicles

trying to access Pearland Parkway, and backtracking to the light at
Westminister. Councilmember Beckman stated she was in favor of the
facility as proposed. She stated that it was well laid out.
Assistant City Manager Nick Finan stated that requirements could be
made regarding large trucks or that the Planning & Zoning Commission
could table it to see what a Traffic Impact Analysis showed. Chairperson
Sandars stated she would like to see the bays open to the sides and not
front Broadway.
The Public Hearing for Amendments to the was adjourned at 7:12 p.m.
The Public Hearing for the Unified Development Code (UDC) opened at
7:14 p.m.
C. AMENDMENTS TO THE UNIFIED DEVELOPMENT CODE (UDC)
A request by the City of Pearland, for approval of Amendments to the
Unified Development Code, Ordinance No. 2000T.
P&Z Chairperson Sandars read the purpose into the record.
Planning Director Krishnarao presented the Staff Report. New packets
were prepared since the last workshop, and an additional packet was
distributed. Ms. Krishnarao gave a lengthy outline of the packet, and
stated that Staff would like to discuss with the Council/Commission the
Corridor Overlay District towards the end of the hearing.
There were two persons present to speak. Ms. Brenda Hanzik of 3311
Windfern Dr., Pearland, Texas spoke on behalf of Ms. Diana Ortiz'
Property on Ochoa Road. She spoke in regards to Section 3.2.14.2 Lots -
Determination and Regulation of Size. Also present to speak was Mr.
Alan Mueller, of 2401 Laura Lane, Pearland, Texas regarding Section
3.2.1.1 General Policy. He asked that careful consideration be taken and
not to put something into code that will tie their hands to any flexability
later on.
Much discussion ensued. Chairperson Sandars expressed concern with
things constantly needing to be checked. Deputy City Attorney Doan
referred to Section 3.2.1.1 General Policy. He asked that the Council and
Commission have faith in the Staff doing the inspections. He referred to
sub -section (b) (1). Councilmember Kyle stated she agreed with Mr. Doan
and that sub -section (b) (1) needed to left as is.
Assistant City Manager Finan asked the Council/Commission how they
would like to receive this information at the next workshop. Replies came
back with more of breakdown was needed, and asked that the pages be

The Public Hearing for Amendments to the Unified Development Code
was adjourned at 8:04 p.m.
